Denying all allegations about Sex Trafficking and prostitution but adding to his legal team. I want to get straight to the dramatic testimony in the trial of Derek Chauvin. Cnn sarah sidner reports. Reporter the prosecutions 21st witness and former officer Derek Chauvins murder trial was his ultimate boss. The chief of police. What is the officer supposed to do to a personal in crisis . Attempt to deescalate that situation. The chief testified he first learned of the severity of his officers actions against george floyd by a Community Member. Close to midnight, a Community Member had contacted me and said, chief, almost verbatim but said, chief, have you seen the video of your officer choking and killing that man . The chief Testified Chauvin violated the departments Neck Restraint Policy and he detailed its use of force policy which also takes into account the severity of a potential crime. Clearly when mr. Floyd was no longer responsive and even motionless to continue to apply that level of force to a person proned out, handcuffed behind their back, that in no way, shape or form is anything that is by policy, is not part of our training, and it is certainly not part of our ethics or our values. We also heard from the Emergency Room doctor who treated floyd when the ambulance dropped him off at the hospital unresponsive. Did you pronounce him formally dead . Yes. Did you receive a report that he had received cpr from any of the officers who may have been on the scene on may 25th, 2020 . No. Its well known that any amount of time that a patient spends in Cardiac Arrest without immediate cpr markedly decreases the chance of a good outcome. Dr. Bradford said he believes george floyd died from a lack of oxygen. The prosecution is trying to prove it was from the 9 29 chauvin had his knee on his neck. The defense is trying to refute that saying it was illicit drugs in floyds system, coupled with his medical history. Certain drugs can cause high poxia. Specifically fentanyl . Thats correct. How about methamphetamine . It can. Combination of the two . Yes. But the doctor testified paramedics normally report to him Drug Overdoses or extreme agitation. Did they say to you for purposes of caring or giving treatment on mr. Floyd that they felt he had suffered a Drug Overdose . Not in the information they gave, no. The commander in charge of Police Training in may testified what she saw chauvin do to floyd was not consistent with their training. How does this differ . I dont know what kind of improvised position that is. So thats not what we train. Im going to bring in sara sidner now. The prosecution asked the police chief a lot of questions about the departments use of force policy. Talk to me with that and what it mean for chauvin. Reporter yeah. He really went into detail. It seemed like he had encyclopediaic knowledge. The prosecution put on the screen for the chief to read, some of the reasons use of force would be necessary. If a person is actively resisting, if the officers life is in danger or other people around them are in danger as well. And the last one was, they have to consider the severity of the crime. If you think about it, it was over a 20 alleged Counterfeit Bill that george floyd is accused of paying for cigarettes for. So if you look at the totality in the testimony that you heard, the police chief was like, this is not in concert with what our training is when it comes to use of force. And certainly not having his knee on his neck in the prone position for 9 29. He also that, it was not ethically a part of what the office should do and he was very cheer about their role in society and their role here in minneapolis. That they are part of the community to serve and protect the community. Sara sidner, thank you. Joining me, the Krr Legal An List and political commentator, good evening to both of you. Good to see you. Im going on start with you. Today Minneapolis Police chief testifying that chauvins actions were in no way shape or form part of their departments policy or training and, quote, certainly not part of our ethics or values. How powerful was that testimony . This was incredibly damning. The word is send cyclo teedic knowledge. The Defense Policy was hey, this Veteran Lieutenant who oversees homicide. You have an out of touch status. It was a very patronizing way. This is the person who sets the policy, who has such a breadth of experience that theres to way you can tell him with a the training looks like, what the policy is. Having this person after multiple members of the Law Enforcement community distance themselves from derek ever Derek Chauvin and say, hes not one of us. What he did was not what we do. And making that very important leap that a prosecutor has to from reasonable use of force, going over the line to now criminal assault. Remember, that has to be part of the underlying element that is proven. That there was a transformation, for reasonable use of force to criminal assault. Theyre building a really good case for that. Attorney sellars youre an attorney, right . Yeah. I had to take bar, yeah. I think it is important for people to know that. Thats why youre here speaking about it. So six members of the Minneapolis Police department have taken the stand in this trial for the prosecution against chauvin. What kind of a message does that send to the jury . I think thats really powerful. In many of these cases, you dont see Law Enforcement testifying against one of their own. It started off where you had the emts come forward and testify. Youve had sergeanted, commanders, and now the chief of police speak out against someone of their own ranks. We cannot discount how powerful that is. One of the things the prosecution has done is theyve followed through with their promise they laid out in opening arguments. Many times prosecutors get trimmed up because they dont follow through. Here day after day after day, they ten to build the case. It was so strong that, i practice criminal defense. It is difficult to see how a Criminal Defense Attorney can wiggle his way out of a guilty verdict on any of the charges that are present before the jury. We know based bomb the testimony today that nothing he did, nothing did he was reasonable. And so that is when you start to teeter out of this scope and you start to recognize that there was some malice. These words are very important when it comes to intent. There was reckless know, wanton disregard. All of those things matter because he was not following the proper procedure and protocol. Last week was about compassion. It pulled at our heart strings. Today was the day where the prosecution truly got themselves a guilty verdict if theyre able to get it. Do you agree with that . Well, you know, a jury pool is comprised of not just 12 human beings but 12 wild cards. So in terms of managing expectations, there are so many elements here. Hes right about the idea of the presentation of evidence. Whether it is persuasive ultimately is another question. Remember, part of the role of prosecutors for the very reason he is talking about, theyre aware of the psychology of the benefit of the doubt extended to Police Officers in this country. Nobody believes that an officer wakes up in the morning, puts on his or her uniform and goes out with an intent to kill wearing that badge. The fact that it has happened in this scenario is of course, part of the factual predicating of the charges bust prosecution has to be aware that they have to distance and make the jurors comfortable with prosecuting not a Police Officer, per se, but somebody who is acting under the color of law. Somebody who was using that badge as a pretext you areal reason to commit assault and murder. So making these gass the different Law Enforcement officials who are saying, hes not one of us. What hes doing is not what we do. It goes back to that opening statement. This is not about all police, not about all policing. This is about this person. The prosecution is very waefrl they have to make these jurors feel comfortable about prosecuting someone who said they were a Police Officer but was acting in a way that made them a cop in name only. And thats where they have to go. Listen, im glad that you mentioned you practiced criminal defense. Youre looking at this from the sense, i would imagine, the way the defense is conducting themselves in court. Today, we also heard from the e. R. Doctor who treated george floyd, testifying that he most likely was killed by lack of oxygen. Not a Drug Overdose. It was another testimony that was clearly damning for the defense. Am i correct . It was. Then you heard words like as fiction i cant. When the Criminal Defense Attorney, he didnt score many points today and he hasnt, i check with her often. He hasnt scored many points throughout this trial. He did say would fentanyl lead to as fgixia . Yes. You can see hes trying the build out this argument that will come down to causation. If they get a guilty verdict, it will be because of the testimony today. That is going to come town to causation. The jurors will have to go in the back and determine whether or not that knee was a substantial cause of his death or whether or not there was something else. For me, you, and laura sitting here, we probably think it is patently absurd to think anything other than the action. Officer. However, again, these jurors, theyre wild cards. All it takes is one. I keep reminding people, it only takes one person to go back and think in their mind frame that this is a trial about george floyd. Not Derek Chauvin. He also denied allegations of prosecution and sleeping with an underage girl writing, first, i have never, ever paid for sex. And second, i as an adult man have not slept with a 17yearold. One thing gaids did not address in his oped, the separate set of allegations first report by cnn that he was showing pictures of nude women to other lawmakers including when he was on or near the floor of the house. That conduct is not under criminal investigation but it is another in a series of escalating scandals surrounding the lawmaker. Even as he denies the allegations in the oped today, cnn has learned he is building a legal teem defend him as this moves forward. His lead attorney has added another lawyer with experience in white color crime. It is not clear when the second attorney was added but it is suggesting they may be preparing to possibly have to defend against Financial Transactions in addition to any specific sexual encounters. Today we were also hearing from a former gates staffer who said, the fbi reached out to him. The staffer is nathan nelson. He is gaetzs former director of military affairs. In a Florida Press conference today, he said two fbi agents questioned him at his house last week about gaetz alleged criminal conduct. They apparently asked him if he left his job working for the congressman because of this time of behavior. Now, nelson denied having any knowledge of any illegal activities. He said his departure was not related to the federal investigation. But don nelson is one of the only people who has come out to defend gaetz. When actually pressed by report orders the specifics of the criminal allegations, nelson said he didnt actually have any specific knowledge of the investigation and he actually hand even spent on to the congressman in months. What do you make of the time line in terms of this wrapping up . Well, first, that nelson guy, he didnt provide any information. I would have called his prorns a nothing burger but would be an insult to nothing burgers. What a waste of time. I think this investigation will wrap up pretty soon. Usually jnlly, you talk to the target, or the subject, toward the end. And the fact that gaetz blew off this whole undercover investigation into extortion just seems like it is all coming to a head. And i have to believe theres going to be a charge pretty soon. I saw his op ed today. And he is relying on two defenses. Hes never paid for sex or that he is an adult man, has not slept with a 17yearold. Even if you accept both of those as true, costill be charged and convicted with child Sex Trafficking. It doesnt require that you pay or sex or that you had sex. If you enticed or recruited or transported someone in exchange for something of value, that may not be cash or that may be paid by Joel Greenberg, youre still guilty of human trafficking. Okay. So two things. So it sounds like youre saying, he is in a lot more trouble than, than were believing right now. And he knows it. He is beefing up his legal team. May be in a lot more trouble. On one side hes making the case in the court of Public Opinion that it is the swamp out to get me. The deep state. When he needs a lawyer in a court of law, he is turning to people with experience in the same department of justice. Youll notice hes not hiring rudy giuliani. He doesnt want a huckster. He wants professional lawyers and thats what hes depending on. So you will see two different defenses. One in the court of Public Opinion. Extortion and the deep state. And the other in court of law. You can tell a lot about a person by who represents them, correct . Correct. Kirsten, in his op ed, he didnt address the cnn reporting that said he showed naked photos of women that he claims he slept with on the house floor. The investigation aside, doesnt the gop need to do something to address this part of it . You would think. I mean, again that logic again. Yeah. The logic, the logic. So they dont hold people responsible if they think there is to be some sort of back lash from the trump base which is completely dictated on what donald trump does. And nobody really knows what donald trump is thinking. Im not saying that is the right way to be handling it. I dont think it is. I think they should be dealing with this issue. It is a pretty serious thing done doing. On the house floor. It is unacceptable, creating a sexually hostile environment. We can sit here all night and talk about the things are wrong with it. But they seem unwilling to deal with this because they dont want to do anything that could potentially upset the trump base. The same story over and over again. Dave, where do you see this going . I just spoke to you a couple days ago and every time we speak, or i see you do an interview, there has been some new development that seems to be a bit more troubled for matt gaetz. There are really three investigations here. It is the third one that is the midwest problematic for gaetz. First you have the investigation into allegations that he was involved in human trafficking. You have the allegation of extortion, going nowhere. But also, as the investigation into Joel Greenberg that is the key here. That i believe Joel Greenberg has probably already flipped on matt gaetz. Why wouldnt he . Hes facing decades of prison himself. He is stuck in a jail cell awaiting trial because he violated the terms of his rel release. I suspect hes already flipped. Thank you. These bills restriction early voting hours. They limit the number of Voting Locations and they restrict the number of boxes that you can have in the county. They even require people with disabilities to provide Additional Information about the disabilities. They have poll watchers to actually video record people voting when they need assistance. If they have a reasonable suspicion that something may be going. On can you imagine how suppressive and intimidating that can be . They impose civil and criminal penalties on local officials if they should violate any of these socalled laws. These are bills that are highly suppressive in name, highly intimidating and pretty much intended to restrict peoples access to the voting booth. We have to remember this was built on the big lie. This is a solution in search of a problem. There was no widespread voter fraud that needed to be corrected and these bills needed to be placed into law. There is no problem here that these bills are intended to fix. These bills are intended to restrict access to the voting booth and hopefully the federal government and people in congress and the United States senate are taking note. Certainly, i hope they will not allow a fbi rule to remain in place that as the senator from georgia said, that will frequent minority in the senate. But at the same time, wont protect peoples right to vote in all 50 states. Republicans have now been the party of Corporate America but now that has been strained over voting rights. He thought he was getting a onetime 500 donation. It seemed deceitful. Thousands overlooked it and the Trump Campaign ran with it. In the fall or the late summer as the Trump Campaign faced financial pressures, they made a really important change. They took that box. Instead of taking donations out every month, they began taking them out every week. Banks and Credit Card Companies have been flooded with calls from donors, the times reports, leaving the Trump Campaign and the rnc to refund a massive amount of money. The new york time reporting from midoctober through december of 2020, the Trump Campaign and the rnc made more than 530,000 refunds. Amounting to more than 64 million. By comparison, the Biden Campaign and the dnc refunded 37,000 donations, amounting to 5. 6 million. We did very well with the fundraising. A lot of it came in small donations. The boost of money that came when President Trump was in need of it the most. Just weeks before the election, and short on cash. That money that they took from donors through recurring donations just really add up functionally to being a de facto loan with no interest from their own supporters. And refunded only after the election with funds the campaign collected to from motor baseless claims of election fraud. Former President Trump releasing a Statement Calling the New York Times reporting misleading saying many people were so enthusiastic that they gave over and over and in certain cases, where they would give too much, we would promptly refund their contributions. Bars and restaurants are among the mostrisky venues in during this pandemic. And, you know, i would just plead with my fellow citizens to say, look. If you have not been vaccinated and you go into into a bar, you are taking an enormous risk. And its not just a risk to you. Its a risk to your parents and your friends. And and your neighbors. Its its just not worth it. If you have had both of your vaccines or the the single dose from of the j j and you are a coupleweeks past your last dose, and you want to go into a place and get a drink. Or have dinner. Have at it. But if you have not been vaccinated, it is not safe to eat indoors. And or or particularly, have a drink at a bar. Yeah, but people are doing it, because they are doing it, because they dont want to go get tested. They figure, if they do go get tested, theyre requesting to have going to have to quarantine, right . They are going to have to report. Its very dangerous, when someone does that. When they sort of defy the rules. Not sort of. When they do defy the rules, that way. Right. But again, this is not just about them. Its about us. And their behavior. You know, if you do something foolish and it just affects you, well, you know, thats your problem. But if you do something foolish and it affects me, its my problem. And that is what is happening all over the country. Particularly, in young people. This virus have surging through young, largelyunvaccinated people. Thats where our vaccines should go. It should go to to the young, and unvaccinated. And, you know, the folks that, maybe, should display a little bit more maturity, little bit more community spirit. Restrain themselves, until this pandemic is put down, once and for all. We have the ability to do this, and its coming soon. But but more people are going to die, if we continue to act foolishly.
