Around the world. This is new day. Wednesday, march 31st. John berman is off. John avlon is taking his last sip of coffee while he has to be with me. Buckle up. The prosecutors build their case up against Derek Chauvin after an emotional day with six witnesses who watched George Floyd Die with a Police Officers knee on his neck for up to nine minutes. A firefighter said she was desperate to help floyd. She will be back on the stand today. Four of the witnesses who testified were younger than 18 at the time of floyds death including the teenager who recorded that now infamous video. Well bring you all the key moments and what to expect ahead. Were also following a developing story about republican congressman and trump supporter matt gaetz. Investigators are looking at whether he had a sexual relationship with a 17yearold girl. That may include Sex Trafficking charges. Gates denies the claims and says its part of an extortion scheme. Omar jiminez has the story. Omar. Reporter well, john, today is day 15 of the trial. On the other side was, without a doubt, the most emotional and contentious day of court of what happened. It was told through the lens of eyewitnesss who were literally steps away from george floyd as he was pinned under the knee of Derek Chauvin and who in some cases now are still haunted by what they saw. Six eyewitnesses took the stand, all recounting the scene of George Floyds death. Donna williams, first on the stand, stood feet away. He was so disturbed he called 911 to report it. They played the audio for the co court. I called the police on the police. Why did you do that . Because i believe i witnessed a murder. Reporter as part of a k contentious exchange, the crowd grew loud. You called him a tough guy. I did. Those terms grew more and more angry, would you agree with that . Reporter over witnesses echoed williams feelings highlighting what they saw has haunted them since may. I stayed up apologizing and apologizing to george floyd for not doing more. I have a black father, a black brother, black friends, and i look at that and i look at how that could have been one of them. Reporter that was then 17yearold darnell frazier. She recorded the video. She testified along with her 9yearold cousin who was also at the scene. They both appeared via audio only given their ages at the time of the incident. What was it about the scene that caused you dom to come bac . It wasnt right. He was suffering. He was in pain. I saw the officer put a knee on george floyd. I was sad and kind of mad. Reporter she testified that even after pair paramedics arri Derek Chauvins knee was still on his any. He gave a motion like basically telling him to remove his knee even when they came, even nonresponsive. Reporter the firefighter said i would have been able to provide medical attention to the best of my abilities, and this human was denied that right. When you couldnt do that, how did that make you feel . Totally distressed. Were you frustrated . Yes. And emotions were running high throughout the day. On the other end of the spectrum, the judge had to even scold that witness for arguing with the Defense Attorney as he had do with an earlier witness during the day as well. But court ended yesterday in the middle of her testimony, so thats where theyll pick things up when court gets back into session later this morning. Alisyn . It was compelling and very striking to hear how many people who happened upon that incident felt compelled to call the police because what they were seeing wasnt right. I mean all of these were people who have seen, you know, some sort of exchanges before. Certainly the emt has seen Police Encounters before, but that moment to them, they all felt compelled to call the police because what they were seeing didnt make sense to them. Much like we heard from the 911 dispatcher, all very compelling. And listen. People talking, engineering at officers from the sidelines is not anything uncommon. Its inherent. Were dealing with a 19year veteran in Derek Chauvin, so hes not new to any of this. That anything on the sidewalk was disconcerting and took him out of his game, if you will, is intellectually dishonest. This is an officer who used his feet in addition. Its outrageous. Joey, thats where i want to take this. Youre obviously a Defense Attorney and weve seen the Defense Attorneys in the case try to demonize the victim and then the witnesses. I want to get your take on whether this is a wise stwrrate . Do you recall him saying, dont you dare touch me like that. I swear ill slap the [ bleep ] out of you. Yeah. Is it fair you grew angrier and angrier . No. I was professional, stayed in my body, and did not get angry. You recall the angry witness, the prosecution not having any of it. Whats your take . I understand everyone does differently. No one has a monopoly on wisdom. Im going to tell you is the fact of the matter is what you argue has to make sense. If you argue the crowd was angry and youre so concerned they were deflecting from you, what do you do . The logical person gets them out of there. To me, if someones angry and im concerned about a 17yearold, were you concerned about the 17yearold . The 9yearold . The other two minors that testified . The paramedic who wanted to render aid and was desperate to do so . Its inconsistent from any of the evidence. The most inconsistent part is if youre so concerned about the angry crowd, get your knee off of his neck, get him into an ambulance or get him in a car and get him out of there. Its problematic, and it goes against human nature and doesnt resonate with the jury. Sergeant dorsey, what about the fact that george floyd was in handcuffs . He was already, you know, powerless basically, and the fact that chauvins attorney is trying to argue this is what theyre trained for, i mean thats not what the firefighters thought. Shes, again, seen lots of this. How can that be what theyre trained for . Theyre trying to construct a narrative and tell you what they saw. Let me tell you what they saw. They saw chauvin arrive on the scene and put on black gloves. Thats because theyre about to do some work. They took him out of the police car and put him on the ground to inflict punishment on him. As joey said, if it was a problem, they could have left him in the back of the car and drive off. They put him on the ground do what they did. The questions the Defense Attorney is asking is not evidence, but certainly the response from the eyewitnesses should hold much more weight than the question of the Defense Attorney. Joey, you made the point very clearly what the Defense Attorney needs to argue needs to make sense, all right . I want to ask you putting yourself in the position of the Defense Attorney, george floyd is in handcuffs. Emt is saying this man is in distress. The crowd is saying get off his neck, hes not breathing. Its been nine minutes. How can you as a Defense Attorney justify this as a reasonable use of force given all that evidence. I think its with great difficult you do that. Then, again, theyre operating in the realm of very difficult facts in my view, this is a theory. There are three pillars to the case. The fact is no one, right, unless youre a doctor can opine as to death. If youre going to say there were drugs in the system, youre going to argue that. Theres no evidence of restricted breathing. Then you make an argument and talk to the witnesses. You dont know how he died. You dont know what the medical examiner indicated, do you . Stick with that because that now relates to your theory. You want to pivot to selfdefense, tell them youre not familiar with police procedure, you dont know police protocols, youre not understanding of the nature of police work, are you . And if you want to demonize it, you go with the issue. You dont know how he got to the ground, what the issues were, how noncompliant he was. To be complaining of crowds, its problematic and doesnt make sense. To me it has to make sense. Finally, john, a jury has to make sense, and if they dont, youre not doing your job. Republican congressman matt gaetz is denying having a sexual relationship with a 17yearold girl. The New York Times reports the Justice Department opened an investigation into gaetz in the final months of the trump administration. Reporter good morning, john. Yesterday the New York Times reported that the justice, still an attorney general, opened an investigation into congressman matt gaetz about whether or not he had a sexual relationship with a 17yearold woman and whether or not he had traveled across state lines with her. Gaetz is denying this fervently and hes arguing actually his family was part of a potential threat here from a former Department Of Justice official who he says was trying to get millions of dollars out of he and his father in an effort to make this investigation go away. Now, gaetz has leveled these gaegss against this former Department Of Justice official saying he and his father were so concerned about it they went to the fbi and his father agreed to wear a wire to try to catch this individual. During that fox news interview last night, gaetz actually named this person as david magee, a former prosecutor for the Justice Department. Now, mcgee has issued a statement to the Washington Post fervently denying these allegations. I want to read you that statement. We should also say cnn has reached out to david magee. He says, quote, its blatantly false. Its a blatant attempt to distract from the fact that hes under investigation for Sex Trafficking of minors. I have no connection with that case at all, other than, one of a thousand people who have heard the rumors. Theres an investigation into a former florida politician. Gaetz said hes the subject of the investigation, but not the target of it. Cnn has continued to reach out to the Department Of Justice who say they cannot confirm or deny the existence of an investigation. Thank you. Target, accusations, denials. Theres a lot going on. Joining us all to make sense of it all is margaret t talev. Theres a lot going on in this fl fl flurry of accusations. How do you make sense of it . Look. These are incredibly serious allegations about a sitting member of congress. I think you have to take a pause and think about it. Truly unusual. To have someone under this kind of Investigation Punch back so aggressively, do his own kind of going offense with this essentially media tour to not only defend himself but deny all of it is also extraordinary and highly unusual. Why does this matter other than the actual allegations at hand . Its shock on both counts, shock on the investigation. Also extraordinary. But why is this important . This is one of former President Trumps closest defenders. Republicans want to recapture control in the midterms. Think of all the issues. This could impact all of that. And because its an investigation, its undoubtedly going to dig into all kinds of politicians and associates. Email, twitter, telephone calls, text messages, communications, and its all tied, it appears, to another case about a different former public official in florida whos been indicted on child sexual allegations. Can we zero in . Frankly this is very convoluted, but heres the part i understand. Matt gaetz last night was very quick to say hes never traveled with a 17yearold. Its demonstrably true i didnt travel. He ought to think about revoking his fifth amendment rights. He went on tuckers show and made a lot of statement. Its punishable if You Travel Cross State Lines to be involved in a commercial sex act. The timing stix out for me. The fact that the investigation was started months ago under the trump administration, thats important for two reasons. He cant claim he was targeted. Two. The timing is important. Gaetz said on fox his family was first contacted in what he describes as an Extortion Attempt a couple of weeks ago, midmarch, but the criminal investigation predates that significantly. This is all based off this socalled Extortion Attempt. Doj had been looking at this well before that. Margaret, theres scandal and then theres substance, and i want to make sure we hit on that. Today President Biden is going to announce one of the most ambitious infrastructure bills ever put forth before america. This plan is mammoth month. This thing is massive. So my question to you, margaret, is this. There was a time when democrats were worried about being called tax and spend by republicans. Thats out the window. Democrats are biting big, thinking they can go big with spending. Is that how you see it . I think youre right about that. You mentioned 2 trillion. A few hours into the trial a few witnesses have testified including a firefighter and several teens who described actions they wish they would have taken to prevent george floyd from dying. Any of those could have been a star witness in an ordinary trial. This is no ordinary trial. They give firsthand accounts outside of key thoughts. A key theme is emerging he. Every person who saw what Derek Chauvin was doing to george floyd recognized it was wrong, dangerous, and potentially lethal. Lets take a listen. My instincts were telling me something was wrong, something is not right. I dont know what, but something wasnt right. I called the police on the police. Okay. Why did you do that . Because i believe i witnessed a murder. I almost walked away at first because it was a lot to watch, but i knew it was wrong, and i couldnt just walk away. He wasnt moving, and he was cuffed. Thats three grown men is a lot of putting all their weight on somebody. Thats too much. A couple key details emerged. That firefighter emt said she tried to intervene. She tried to come to George Floyds aid, take a pulse, and she was turned away by the police. A second witness said it looked to them it looked like Derek Chauvin was trying to drive his knee harder into George Floyds neck. Those details really matter to an attorney. How about the defense of Derek Chauvin . Have they made any accidents in the prosecutions case . Its still early. I dont think theyve identified a major weakness yet. The major thing is the unruly crowd, which to me is not compelling, completely not convincing whatsoever. The notion that the Police Officers were so upset or distracted by the crowd, what was hardly unruly. That they couldnt do their job is hard to swallow. That back fired when he was crossexamining the emt firefighter. Lets watch that one. Do you think it would make your job fighting the file harder if someone was yelling and you, telling you you were doing it wrong . Im very confident in the training ive been given, so i would not be concerned. What if they started calling you names. Like i said, i know my job, and i would be confident in doing my job, and theres nothing anybody could say that would distract me. She just annihilated the urn ruhle crowd defense. The defense made another mistake. When they were crossexamining the one witness, darnella blabl blazier, they asked her how its affected her. Lets watch that moment. Would you tell the ladies and gentlemen how your viewing, experiencing what happened to george floyd has affected your life. When i look at george floyd, i look at my dad, i look at my uncles, my cousins. Whats next . What are we going to see today . So the firefighter emt who we saw before, shell be on the stand when this trial resumes in a couple of hours. I think were going to see more eyewitnesss who were there outside of key foods. At some point down the line, this will start to get more technical, into the expert witnesses. Were going to see two types of expert witnesses. One, well see experts on the Police Training and use of force including police chief arradondo. Thats going to be remarkable to see him testify against one of his own former officers, and second, well start to hear from medical experts on whether the death can be tied to Derek Chauvins actions. Earlier this month there was a secret Service Agent who required medical attention. Mondays nip bite was a park Service Employee on the south lawn. The white house told me major was out for a walk on the lawn when this incident happened. The worker, im told, needed to stop work and, again, be treated by the white house medical unit. The white house said the worker later returned to work. This is becoming an issue, and i dont think anyone blames the dog here. I want to make that clear. The dog is in a new environmental. The white house has a lot of people, unfamiliar faces. The president himself addressed the issue, the first issue earlier this month and said 85 of the people there love major and the other 15 perhaps might be afraid of dogs is what he said. But he said major isloveable, major was receiving training. He returned to the white house within the week and here we are again talking about yet another incident with the dog. Perhaps the white house environment is not the best place for major. Hes 3 years old. It might be too much environment, too many unfamiliar faces. This may be something the white house may experience again and so certainly people are talking about poor major and his problems with staff. Who will speak up for major . 3yearold major.
