20 minutes ago. we have seen fbi agents walking around interacting with the law enforcement here on the scene. around 2:49 p.m. local time boulder police tweeted a warning for people to avoid the area because of an active shooter. authorities have not provided any information about the suspect or any of the victims. we did see images of a shirtless man who's handcuffed. he had blood running down his leg. he was not wearing any shoes. he was taken away in handcuffs and placed into an ambulance and that ambulance left the scene. we don't know what relationship or what role he played in the shooting that's just the information we have. right now a very heavy police presence. we are still waiting for concrete information from authorities. it has been nearly two hours, more than that since the shooting took place. we don't even know frankly the operation is ongoing or not. we simply have no concrete information. nothing has been confirmed from police. have we heard anything about when police may give us a formal update here. >> we are in what they are referring to the media staging area. there is some top potential briefings but we don't know what time or by whom. the agents are taking charge here and who's going to speak to the fed. there is a lot of loose threads right now that they are still pursuing. you can imagine this is a monday afternoon, erin, there is a snowstorm moving into this area a great time ago shopping to get your supplies for r the in coming snow storm and this incident took place, a shooting at a local super market in america. >> all right, lucy, thank you very much. liuucy is going to be back withs as she learns more. thank you, lucy, we'll talk to her as she gets more. i want to go to one of the witnesses. ryan borowski, i am so glad you are safe and thank you for joining us. i can't imagine how terrifying this was for you. you were just in the grocery store. tell me when you first realized something was wrong. >> um -- a loud bang, thought some employee dropped something. a second loud bang and third and we were all running. we knew by the third to run, at least everybody near me did. i was luckily walking away from the sound of the bullets when they started. we ran to the back of the store and out the back door and employees showed us the way. we told employees what was going on so everybody helped each other and we just ran to safety as quickly as we could. it is surprising that now that two hours and i feel like i know more than what's being reported. i texted my wife at 2:35 to call me immediately. i guess it was two-minutes before that maybe. >> ryan, as you pointed out it is amazing two hours have past and there is little that we actual lly know. >> there are two entr entrances -- sorry, one there and one there. the west entrance was where i came in and i was walking towards the east entrance to get some ice cream, changed my mind and i walked the other way and the shots seemed to be coming from the east entrance or where the south check-out machines would be. i didn't see the shooter. i saw terrified faces running towards me and that's when i turned and ran the other direction. >> so can i ask you, i know this is hard to remember and you know you got to be in shock, ryan, but when it happened, was it sort of all in a row quickly or was there a longer break between the first and the second and the second and third and you know again who knows how you feel about your memory but any information would be so important. >> i would say pop, pop, pop, pop something like that. somebody else told me they heard 13 shots i said maybe eight -- i don't know. >> still seems like a lot. after that first series of shots, you said everybody started to run. our reporter was saying i know you got more snow coming in, how many people did you see in the store? >> you know in colorado we do get those blizzard panic grocery store super market sweeps, it did not seem like it was bad today. i was not bumping into people but when we were running out the back door, can you still hear me? >> you froze but i can hear you. >> sorry, somebody was trying to interrupt. when we ran out the back door, we were all sing filed and i had my hand on one person's back and another person had their hanha hands on my back. there we go. i am sorry. yeah, we were not tripping on each other and nobody fell down. when we got to the back of the house, there were some people who just started to run into like a pantry or some sort of storage area and a dead end and employees made sure to show them the way out. i just threw my grocery on a shelf and took off for my life. >> i mean it is incredible how calm you were but also one thing that just standing out -- >> it was 2.5 hours. >> yeah, it is a terrifying thing and we don't know how many people killed or who was the shooter. but you are talking about the people helping each other and being calm. it really does stand out. could you ever imagine you would have been in a situation like this where you are? >> in boulder? no. boulder feels liking a bubble. a bubble bursts and that's heartbreaking to think that. many people die today and -- it does not feel safe anymore sometimes and this feels like the safest spot in america and i nearly got killed for getting a soda you know and a bag of chips. does not feel good. >> ryan, i appreciate -- >> go ahead. i mean - yeah, it is so amazing that everybody was helping each other out and that our instincts were on the same page and we ran and i don't know why other people didn't and i am sorry that they froze and i wish that this didn't happen and i wish i had an answer for why it did. i wanted to be over and my car is in the park paragrlot so i ak here. i can leave and i wanted to be over and i want to see it end so i don't even know -- >> ryan, thank you very much. >> thank you. >> we are trying to get information of what happened, ryan was there when it happened and the number of people who died and senseless act of vio violent. the boulder mayor tweeted words can't do no justice to the tra tragedy that unfold ed. it feels like nowhere is safe, he just went to get a back of chips and ice cream and people d died. i want to go to tim clemente. you heard ryan spoke there, what struck you the most? >> our thought s and prayers go out to the families and everybody involved in this. the fear that somebody has to go to going there and getting a bag of chips and sodas and he almost died, family members don't know if their loved ones are coming home from the super market. it is an ongoing situation where there were more than one shooter involved? i don't know. there is so many conflicting details have come out. it is tragic every time something like this happens for any community when people are so adversity affected that they can't go to a grocery store without some kind of violence. >> john, we are waiting updates for the police. it is amazing to him that he says he knows more than the world at large. it has been a couple of hours since it initially began. there is a lot of reports out there and none of which we can confirm. why do you think this is taking so long for them to tell us what's happening? >> erin, first of all, the police are doing their job and you know what we are seeing right now, we almost had a front row seat to this incident between social media and digital media and then our reporting, we are living in this on demand instant gratification environment, we had to take a step back and understand. testimony police respond is really in two phases. it is the initial respond to the crisis and addressing the threat. after the threat has been neutralized, the focus shifts to safety and addressing the victims. the police in law enforcement have a very large crime scene that they have to now process. so they're just still in the infancy of their investigations and trying to understand and piece all of this together themselves. the public information officer will come out but they want to make sure they're putting out information that are factually correct. i expect to see very soon the public information officer will be coming out to give a broad view of what's going on and understand is the scene safe and are there other suspects at large and reassure the public that have control of this environment. second of ail, they're going to come out and talk about reunifications and bringing families together and loved ones injured or deceased in this. so those are going to be the first thing coming out shortly. >> tim, one thing that ryan said and again you know there is shock of eye witnesses and so i don't present this. he heard the first shot and thought maybe something was something. he said it was sort of pop, pop, pop, pop. anything from what you heard from what he described happening set to appear by the check-out area. >> repetition of firing either all those pops were from the same gun. if they were, the shooter picking out from multiple targets. i did see one report the individual may have an ar-15. semiautomatic rifles. we have seen those used in several shootings over the years. it is a popular sporting rifle in america and common. it would be tragic to know somebody inside a super market hunting human beings. that's what it sounds like to me. unfortunately, other people became targets of the predator. >> so tim, i want to let everyone know we are anticipating that the police will be briefing everyone at 7:45 eastern standard time. we'll bring it to you live. we got that information. that's going to happen the next 30 minutes. tim, what do you think the police are focused on. obviously we did talk about one person who came out shirdless without socks and blood and was put into an ambulance but we have no idea and in handcuffs. we don't know what that person's role is in this at all. police officers there under the impression of the shooter a and -- in a situation like this it is unfortunate, you see it in schools shootings where they make kids come out with their hands up or on top of their heads because they don't know who's a threat or who's not. the first thing is deal with the immediate threat. the shooter hopefully there are not anymore accomplices or shooters involved and preserving life. they want to get in there quickly as possible and treat the wounded when it is safe to do so. that's a sticky point on whether there should be concerns of officer safety, there has to be concerns for their own safety. supervisor, either tactical units come into look for threats and hopefully rendering aid to anybody that was injured and last thing you do is take care of the dead after you preserve whatever lives that are still. >> as you are speaking the fbi is on the scene and as we await that briefing, jonathan, let me ask you about the location. it is a grocery store. you heard ryan say boulder is a bubble and safe, what does the location tell you? >> i want to go back to ryan's comment, he felt like he lives in a bubble. this incident underscores the danger and the dynamic of these events. grocery store is a soft target location. we have not had a lot of these mass shooting situations through the pandemic. we are starting to see them come back again. soft target locations that attracts large groups of people remains target of opportunities for attackers. these environments are susceptible for an incident at any time. however think of what ryan was saying. they were able to identify there was a threat. he didn't see it. he heard it. he was triggered off the sound eventually and what did they do? they follow protocols we talked about all the time, run, hide and ran. they took action. they had some semblance of a point to get away from and create distance from that threat. those are proactive steps everybody should be thinking about all the time. we just don't know when these incidents are going to occur. there is no safe place anymore. boulder, colorado is just another example of the unpredictability of these tragic shootings. >> which just continues to happen in this country. tim, when we get that update from police in about 20 minutes, what are you going to be listening for? >> how many victims and shooters and whether or not the shooter is apprehended or identified. you have a community in absolute terror wondering what's happening, where is it safe or where is it not safe? that was the day of the insurrection. there is senator ron johnson, this itime he's questioning the actual events and what video evidence have shown the world. >> very honestly, i didn't feel threatened on january 6th. there was much more violence on the house side. there is no violence on the senate side in terms o f the chamber. >> there is no violence on the senate side. that does not add up from the video evidence. here is the evidence from trump's impeachment hear ing. you see the red dots where rioters broke into the capitol. officer goodman can be seen running past mit romney telling the senator to turn around in order to get to safety. the door to the left is the doors to the chamber. we learned the mob came within 100 feet of the former vice president. mike pence and his family being ushered to safety after being hunkered down in a room. and not just johnson and brooks. here are two men that led the charge to challenge the electoral college results on the day of the insurrection that left five people dead. >> i think josh hawley shown some real courage in going after him, josh is terrific. somebody that's terrific is ted cruz. those riders remember, the lies those who then had been saying. again here is the video. evan is live. michael sherwin, trump's appo appointee, she's he's calling i it is here and it is quite damming and surprising. >> it was surprising for one big reason. this is not a building the justice department, you don't normally get a window into the deliberations that are ongoing. that's what you got from michael sherwin, he said out loud that he seized enough evidence to bring sedition charges of people charged if the capitol riot. we know that's something we pr previously reported that this is something that prosecutors are recommending and it is now in the hands of the leader here at the justice department. mayor garland is a former judge, he does not believe in saying a lot of things publicly about ongoing investigations and that's the reason why. there was a few people who are not happy that sherwin went this far in that interview. this is a law sedition that's not commonly used by the justice department. the last time was over ten years ago in michigan. it was a case that ended up dismissing the charges. it is not commonly brought. it is going to be a big political decision by mayor garland and the leaders here and the biden administration as to whether to bring sedition. >> evan, thank you very much. >> pretty incredible. it leads you where it leads you. "outfront" now, lawrence chibes. you hear evan talks about how surprising to hear this ongoing case. this is a crucial case involving the former president of the united states, michael sherwin says federal investigators are looking into everything and maybe former president trump is culpable. they're all saying the same thing. they're all there for one reason. that reason is former president trump. do you think there is a real legal case against trump? >> there may well be and would count on mayor garland and his justice department to get to the bottom of it. sedition is one of two major criminal charges the federal government can bring. it is based on an 1861 statue. 1863, congress added a criminal law making it a crime to give aid comfort to an insurrection. that's the law that it looks to me as though this president or former president probably violated and that seems to be where the evidence points to. ten years in prison but also permanent -- or barring from holding any part of office. that law is less troublesome to many people than the sedition law which as your reporters said have been used very rarely. it is all about treason. this is much more targeted to people who given aid to the insurrection. it sure looks like that's what donald trump did. it is not a matter of politics or revenge against the former president or a matter of just turning the page. it will be matter of following the evidence where it leads. mayor garland is just the right man for the job. >> let me ask you to be clear here when you say that the former president could be barred from office and face ten years in prison if charged and found guilty, under what charge, just to make sure i understand. >> it is the charge of giving aid and comfort to an insurrection under 18 u.s. code, section 2383. it is very fundamental and criminal statues on the books. it is meant to be enforced and not ignored. it applies not only conspireing to overthrow the government which is the sedition law but it is meant to apply to people engaged in or give aid to comfort to insurrection. that was exactly going on. when a mob was riled up by the president who knew what he was doing and saying and watched with glee as people's lives were taken and people's lives were taken. that's what this is all about. i don't think it is appropriate for people in the justice department to talk about the evidence trail right now. it is going to be looked at closely and we'll see what happens. >> i know you know the attorney general mayor garland for many dec decades. sherwin, his successor is channing phillips, they are not talking because they're in active investigation. when do you think we are going to know? well, you know i don't have a crystal ball. mayor garland was methodical. he's a terrific prosecutor in the oklahoma city bombing. he's an expert in domestic terrorism and that's certainly what this was. i don't think he's going to tip his hands. the evidence is going to be developed medthodically. sooner rather than later we'll see something but i would not hazard a prediction about exactly when. >> professor tribe, i always appreciate your time. thank you very much. i want to go matthew doud, you had the former president today and i understand that this does not surprise people but it should deeply disturb them because it just fulfill the profound truths of anything that happened that it was rigged and stolen and that he won and he continued to slam mike pence and trump slams on mcconnell. so what does it say about the republican party? >> well, erin, i think what it says about the republican party is donald trump knows who the republican party is today. the majority of the republican party has ended up. donald trump did not create this. i keep on trying to tell people. the republican party caught this virus years before donald trump and it began to spread. certain leaders had protocols in place to keep the spread from happening and try to keep it from going too far and try to stay at least close to truth and our democratic institutions. what donald trump did was he got reiterate of all the protocols on the virus. he got rid of them all and allowed it to spread and allow people to see this is who the republican party is. so i think he's exactly right when he says people like josh hawley or ted cruz. i think it is more of governor desantis or south dakota. this is who the republican party is. on this day i am going to say one thing with this boulder colorado shooting which is so awful, i am going to give you a feedback here, the last 50 years, 1.5 million people die from shootings from gun deaths. the last 50 years, there is been 1,500 proven voter fraud out of 3 billion votes cast. what's the republican party doing? >> reporter: absolutely tragedy. the footage of live stream of some of the attacks show. you can hear one person think, we don't know if there is an aing a activity e shooter some where. we got people down inside king soopers, it is horrifying of what took place around 2:30 on monday and boulder. we don't know the details and press conference is expected to start in in minutes now. we'll hear from the police commander and the district attorney. police have not given out any information of what took place inside the super market. we know that there were individuals inside and there was an active shooter and footage of a shirtless man who did not have shoes on. he was just wearing shorts and he had blood running his legs. no details of who that individual was and we are hoping to get more details here. we are about a block away from where i was earlier, the king soopers maybe a block from here. heavy police presence, we have seen fbi agents as well. the operation or investigation is ongoing and we are eagerly awaiting these details from the officers of what took place this afternoon in boulder. erin. >> lucy, thank you very much. this is expected to gubegin any moment. we'll bring it to you live. charles ramsey and tim clemente is back with me. >> we know eye witness video was there showing inside and outside the store and report gunshots as an eye witness describing to us like a pop, pop, pop, pop and when you look at this right now, we are about to hear this briefing. what is the most important thing for you to hear, chief? well, a couple of things, we'll get more accurate information in terms of the number of people injured, killed and hopefully that's not the case but you know it could very well be. is the shooter in custody? what other information can you give of that individual? response time will come up so that there is some kind of timeline that'll be given by the authorities as we speak. right now i think just knowing the extent of injury and deaths is tragic. right now they're probably notifying families. it is tragedy. >> tim, we know the fbi is part of this investigation, what does that tell you? >> it tells us that either they were called in by the locals for their assistance or some attributes that they have or the locals don't have or that could be anything from possibly record checks or fugitives or man hunt if the individual got away, it could be the fbi had tactical team and there is one close by and they could have been consulted or to the scene to assist with tactical situation inside the market or the suspect left the scene and located some where else. i agree with chief ramsey, the primary concern is making sure loss of life and those that are wounded is minimized and hopefully we get good information coming from this press conference that tells us the initial report is exagg exaggerated. >> that's very much of what we hope. we do anticipate to hear from comman commander yamaguchi. we really have not gotten any of these details over those past few hours. ordinarily we may know a little bit more and not because police toll us but we may know a little bit more. what do you think is happening here? >> well, they want to give you as much as accurate information as possible. i know people want to know and know quickly. it is the responsibility of authorities to provide as much accurate information as possible. if you have a situation where people are actually killed, they need to be able to identify those individuals and try to make some contact with next to kin. there is a lot of things that are going on when you have a situation like this. you want to get all the authorities together so they are fully briefed and fbi and state and local police and all those groups that came together to deal with this particular case and have one spokesperson. and so they got to coordinate all that. >> the investigation is still early. what do you think police will tell us? >> hopefully there is a suspect in custody. that's a primary concern. a number of victims of the upmost concern for the community at large. family members and notification is vitally important and knowing whether or not this was a single shooter. i doubt at this time they have much by way of motive. it could be that they have a family member or former spouse that was the primary target. those kinds of things may be available to law enforcement by now. if they identify the suspect or apprehended. >> we got in this video, i want to show it, it is disturbing and i want people to understand here. as we try to understand what happened and await details from the police. this is the video i mentioned from an eye witness that shows motionless bodies inside and out the store. let me show it to you. >> we don't know, there is an active shooter some where. >> could be in the store. >> he went into the store. >> guys, we got people down inside king soopers. holy [ bleep ] [ bleep ]. chief, you heard the sound of what appears to be a gunshot there, we blurred out but there was also a body. this was taken as this was still ongoing. yeah, i don't have the return so i didn't see the video but i can imagine having someone laying motionless that's obviously something is very disturbing. the question is how many people were shot or even killed in this incident. that one gunshot we don't even know if that was the gunman taking his own life. that's not uncommon when you have an active shooter. we don't know the answer to any of those kiends of things yet. we will as soon as the press conference is he will. probably a lot of the most critical information in terms o f the shooter and in terms of the number of people injured or killed or a timeline and all those kinds of things. who's doing what role this they're playing as well as providing additional information, doing background on the individual who is responsible for this and so forth. >> and tim, when you -- that video, i don't know if you could see it but obviously, you had the person taking the video briefly interacting with what appeared to be someone who worked at the grocery store kind of coming in where you have the sliding double doors and one of the sides by the cash registers and okay, so we're just going to watch it here as i'm talking to you. then when he goes in, you see a motionless body over by some of the cash registers and then you hear a gunshot. it does give you a bit of a sense of time here that there was already an awareness that something horrific had happened, and someone is coming in with -- you know, on their phone videoing and then you're still hearing a gunshot. >> yeah, that leads me to believe it's very much was an active scene when that individual entered the store. the one person that is laying on the ground, you know, there is a host of situations that could cause them to be on the ground. they could have had a heart attack at the sound of gunfire. they could be playing possum. there is a lot of different possibilities. we don't have to assume that person lost their life but that's certainly a possibility and the fact shots were still being fired including the one on the video, that means that there were other targets that this individual was aiming for and as chief ramsey said, it's very common for active shooters to take their own life and/or to be shot by police in the end of a scenario like this so it's very possible that the shooter himself may have taken his life and maybe we heard that shot on that video. >> chief ramsey, also i want to go back to the information we have as we saw them take that man out of the grocery store who was walking in handcuffs without a shirt, without socks on and with blood coming down his leg. he was put into an ambulance and taken away. he had handcuffs on. that's all i can tell you. can't tell you anything more about him. what do you take away from hearing that? >> this is very ychaotic. he may have been a suspect. maybe he was the shooter. i don't know. i wouldn't assume he's the shooter. i've been to scenes where people are temporarily restrained until you find out the person may not be the person in custody is the shooter. police don't know what they have. we can only hope and pray there was not any loss of life in this particular incident because right now the people are the most important part in the store that may have been injured or god forbid killed. >> you know, earlier i was told and sort of broke down he had gone into the grocery store to get chips, soda, change his mind to get ice cream so he walked away from the cash registers and was just emotional in the sense of i could have died going to the grocery store and someone indeed may have died going to the grocery store. this shooting that we are, you know, as i said moein a moment l get a press conference is on the heels of the shooting in georgia. i want to go to kaitlan collins. this is the second shooting in just days that this new administration has to deal with. >> reporter: yeah, this is ans is spect of being president where these things come up unexpectedly and you have a list of aaggaenda items and often ths can pop up unfortunately. one thing we witnessed is president biden did not really use the issue to advocate for gun reform. that's unlike of course, the president he served when he was vice president, barack obama who did bring it up when talking about the atlanta shootings last week and so right now we are still waiting to hear from the white house on whether even president biden has been briefed on what is going on in colorado. they have not said that he has been briefed yet, though typically, presidents are briefed pretty quickly after something like this happened on what we do know as we're still gathering information and so i do think that a second shooting in a week, erin, is going to bring this to the forefront and there are going to be questions about where the president wants to move on guns. what is his position on this. of course, we know what he said back on the campaign trail. we know it's been going on on capitol hill with the house recently passing the background check bill that the senate has yet to take up and we've heard from multiple hill sources that's something that would probably have to undergo significant changes before it would go anywhere in this senate but this is something like this that could bring this issue to the forefront for this white house and so we'll wait to see what it is that president biden says, of course, they are still gathering the facts about what has happened inside this supermarket in colorado but it is often moments like this that elevate those issues for presidents and of course, president biden did make a statement on february 14th, the anniversary this year of the parkland shooting talking about that and talking about gun control measures that could be taken there and it is often something presidents are faced with in a situation like this. so we are still waiting, erin, to see that president biden has been briefed on this shooting and we'll let you know as soon as he is. >> all right. thank you very much. and you know, while caitlin was speaking, you're watching video here but we have more video from the eyewitness who shot the video, you know, walking into the door of the grocery store where you saw the motionless figure and heard the gunshot. also was able to capture when police were first arriving in their tactical gear. so let me play that for you. tim and chief ramsey are still with me. let me play it for all of you to see. so, tim, you're seeing a police officer there and you can see off to the left of your screen other officers, you can see approaching king soopers there. obviously, using the car sort of blocks, right? and then another one to the right. obviously coming in in some sort of a formation here. >> yeah, the objective in situation where there is an active shooter is generally most departments don't want an officer to respond solo to go in alone but sometimes that's absolutely necessary and it takes place. when you can have two or three men form a stick in a tactical situation, they line up those officers. i actually can't see the video but your description tells me they were using cover, using vehicles for cover and leapfrogging to move fordtowarde entrance of the building. at some time you have to break cover and move into the fatal funnel, the entrance to the threat zone and what they are looking for is the immediate threat, the shooter. they don't know who has a gun, what kind of gun they have, what they are dressed like, who the targets might be so it's difficult for law enforcement to ascertain and discern what is a threat and isn't in that situation. >> chief ramsey, it obviously appears whenever they got the call, though, they did go in in an organized fashion. here you see -- you described it accurately, tim. several officers using cars for cover as they got closer and closer and see a group of three sort of running up to the store then going behind the cars. you've got two more officers here all with their guns. chief ramsey, this is knot a small operation. by the time they got here, they were extremely organized. >> well, you know, they train for this. active shooter training, departments across the country undergo that training and we learn from columbine that you can't just wait for the swat team to show up. you know, the first responders are going to be the men and women out there on patrol you can't randomly shoot people. difficult to tell from this but clearly, that's what the training entails. >> right. yeah, no, we can't tell from this and i would presume after this video was filmed, the person who filmed it went up to the entrance, right, and that's when you saw the other video of it that we showed viewers with the motionless body where you heard the shot. tim, let me just give you one more question here as a final word. what do you expect to hear first from the i would presume the commander first speaking. >> obviously, the first and most important thing is information on the suspect, if they're still at large or been apprehended. put the community at ease and how many victims and lives if there have been any lost and how many people were injured. >> i appreciate both of you and our breaking news continues with anderson. good ervening. we're awaiting to hear from authorities in boulder, colorado, the scene of a second mass shooting in less than a week. this time at a supermarket in boulder, colorado. >> if there is shooter, active shooter somewhere, could be in the store. >> there is one in there. >> he went in the store?
