Reporter yeah. In fact ground action in the senate to a halt, and all because of one senator. Joe manchin, West Virginia democrat. Someone whos vote is so critical in the 50 50 senate to amend this bill you need 51 votes. If they dont have bipartisan support all democrats need to join hands and also get the Vice President to come and break a tie. But because of the jobless benefits, a lastminute deal that democrats cut with the white house, joe manchin is not onboard with that yet and thats essentially stalled action in the senate. This lastminute deal reached would extend jobless benefits at 300 a week through september. But it also includes a plan that would ensure that the first 10,200 of jobless income from jobless benefit would not be taxed. The last part, the nontaxable part of the jobless benefits was not part of the original proposal that extends jobless benefits at 400 through august. This new plan goes an additional month including a taxfree plan. Joe manchin im told is not yet sold on this new plan. In fact, he has been approached by republicans to back an alternative jobless benefit plan at just 300 down from 400 going through july, not including this tax of 10,000 10,200 of a taxfree income as part of this plan. That is not part of the republican proposal. The concern is will joe manchin not support the democratic effort to amend the bill and, in fact, side with republicans instead and move forward with a republican plan paring back the joshless benefits. As a result democrats essentially ground the cham fw ber to a halt. One on minimum wage which failed. In fact that vote is still open trying to sort this out with joe manczing. This shows, brianna, how much power one individual senator can have to essentially delay, derail, this entire process. Its President Bidens 1. 9 trillion plan heading into a series of amendments votes that could take hours and hours and hours and right now stuck on an important issue. March 14th jobless benefits expire. What does it look like in this plan and what will democrat ultimately agree on . Big questions Going Forward. Well keep our eyes up there on capitol hill. A study that looks at covid rates from march through december of last year, and it found that places with Mask Mandates had a nearly 2 percentage point drop in cases and deaths 100 days after taking effect. When it comes to onsite restaurant dining, inside our outside, places that allowed it had a roughly 1 percentage point jump in cases after 100 days and nearly 3 percentage increase in deaths. The idea he was saying there that there is not enough demand to warrant them taking the Johnson Johnson vaccine, i would be very surprised if that were true. There are so many people, im sure, in detroit and all across the country, who are clamoring for a chance to take any vaccine, to get some kind of protection against this virus. Yeah. Its so dismaying to hear this. This is a question a lot of people had. I had it and looked into it and discovered with the Johnson Johnson vaccine that 100 of people after the period of about a month didnt go to the hospital at all. I mean, thats amazing. Thats an amazing result for a vaccine. Reporter and what we want. Yes, right . I mean, its pretty thats what you would hope for. The white house weighed in today trying to clarify saying the mayors comments were misinterpreted. Weve been in constant dialogue with the mayor who said, in fact that is not what he said. Or however it was reported. In fact, he is very eager for the Johnson Johnson vaccine, and i think we would reiterate the message that for all of us, the first vaccine we have an opportunity to take makes absolute sense to take. I mean, abby, we heard what he said. Reporter right. Yeah. I mean, the context here is that mayor dougan is an ally of the Biden Administration, of joe bidens thats all fine. But the reality is that andy slavitt is acting as effectively as a Public Health adviser here and this was an opportunity to say pretty clearly there is no reason that any, you know, jurisdiction in this country should reject vaccines of any kind, but certainly not the Johnson Johnson vaccine, and people should feel confident that the vaccine is worth getting. I also thought, you know, as you pointed out, brianna, whats really, i think, disappointing about that, that comment was saying thats not what he said. That is what he said. He did say that he was you know that they he was going to try to get his constituents the best, and that maybe at some point later he might get the Johnson Johnson vaccine, but because it was not effective, did not want it right at this moment. You cant twist that. That was pretty clear, and i think condemning it and putting it in its right place is a really important thing to do from a Public Health perspective, just as it is important to do from the perspective of just reflecting what was actually said and what the truth is of the situation. Weve been talking for weeks about the question of the president s involvement, and whether theres more evidence that was going to come out, and this is one step closer with the first charge inside the administration. I think its serious. I think it shows the danger of the president s incitement of insurrection using the big lie, even reaching a sitting Government Official who had topsecret Security Clearance, and my own belief is based on all of the evidence weve seen so far that this is not the last of the shoes that are going to drop of official involvement in these terrible, terrible events. And to that point, right now the doj is investigating communications between lawmakers, hill staff, and insurrectionists on the day of the riot. You know, were still awaiting, obviously, the findings of that to see if they were witting or unwitting even in commune caucuses, or not. What are the implications if these communications did take place, if there was assistance . Well, the evidence in plain sight was that there was incitement of insurrection, not just by donald trump with his words that whipped his mob after months of telling them their democracy was stolen, he lit the fuse in his words through the bomb down Pennsylvania Avenue at kh capitol hill, but the lawmakers also involved, representative mel brooks sued today another lawsuit brought today by a member of congress in connection with it. Mo brooks spoke at that insurrection tailgate on, on january 6th. So i think the implications are that were going to see more troubling evidence emerge. We already have enough evidence to block the lines and i dont think its going to stop with just those who stokpoke at the rally. Democratic congress Man E Swalwell is suing. The second to file a civil suit against the president for what happened on january 6th. Do these lawsuits have teeth . Brianna, i think they do have teeth. The first one by representative bennie thompson, now a second one by representative swalwell, both of them are backed by an allstar cast of really outstanding lawyers, and theyre going to push these lawsuits forward, and there are going to are more lawsuits and theres movement in the criminal investigations of donald trump as well. So its definitely a sense of the walls closing in, because of the strength of the evidence, brianna. Donald trump did incite insurrection and the law does not let any american get away with that. It doesnt matter if youre a current president , a former president. If you incite insurrection youre going to pay the price and thats what these lawsuits are starting to demonstrate. The New York Times is reporting aides to new York Governor Andrew Cuomo Rewrote A Nursing Home report to conceal a markedly number of high Nursing Home Deaths at the height of the pandemic. The times interviewed multiple people and the death toll 50 higher than what was cited publicly by the Cuomo Administration. Gavd David Goodman covers the economic and Health Impacts of the pandemic in new york state. David, cuomos critics accused him and his aides of a monthslong effort to covers the truth. Cuomo adamantly denies this. Tell us what you uncovered. What we found is that as far back at june of last year the Health Officials in the state knew, or had good dadata, about the number of people who died in lived in Nursing Homes from the pandemic and prepared to put that number in a Report Seeking to look at factors that caused those deaths in Nursing Homes, and if you remember back to that time, the governor was riding very high, being praised for his leadership on the pandemic, and for his nationally televised press conferences, and, but he was being criticized at the same time by republicans and some others for handling of Nursing Homes. So the governor and others in the administration were eager to push back on this notion and so the Health Department at the time was studies this, and wanted to put in their report that roughly 9,000, between 9,000 and 10,000 died at that time but the Cuomo Administration said only about 6,500 had died at that point. When they discovered the Health Department wanted to update numbers abscesnd give a fuller picture what happened and thats when aides of Governor Cuomo stepped in. Does anything have to do with that late march order saying a directive to hospitals and Nursing Homes saying that Nursing Homes needed to admit Covid Patients . That they couldnt require a test for patients coming from a hospital who had had coronavirus . Whats the relation here . Right. I mean, it has everything to do with that. The report that was being put together by the Health Department was looking at that order, among other things to see what were the reasons why new york had such a high number of nursing home residents dieing during the pandemic. And so this was the main crux of the criticism of the governor, that he had taken an active role in nursing home policy, and sent back into Nursing Homes people that tested positive and people said he was in part to blame for the number of deaths. This study was meant to look at that. In fact, the study came to the conclusion that that order had, was not a main driver of the deaths in Nursing Homes. Ironically, the Health Department reached that same Conclusion Even with the higher number of deaths. In their report that they sent to the Governors Office. Even so, the governor and his aides were unwilling or did not want the higher number to come out at that time, and so took it out of the report. The governor did cancel that order in the summer. I just want to be clear about that, and cuomo has said that the order should not have meant that there were folks going to these Nursing Homes from hospitals, bust at the same time we know that happened, there were a lot of people who went from hospitals into Nursing Homes. Has the governor responded to this story . What theyve said in response to the story was that the findings of the report and, you know, new analysis with fuller data since released in recent months, came to the conclusion that that order didnt result in a much higher number of deaths in the Nursing Homes. I think whats at issue here and so relative and frankly surprising about what we were able to uncover is just the degree to which they were willing to shape the data to fit the narrative they had at the time. Even if the report was going to be a positive report in terms what they were looking for it was going to absolve in large measure the governors policies they is still didnt want this bigger number in there. The bigger number would have been taken as a sign the pandemic wasnt as controlled as the governor was saying it was at the time. One of the most fascinating parts of what youve uncovered in this and we appreciate you sharing your reporting with us, David Goodman. Thank you. Thank you. My next guest lost her mother to covid19 after she was transferred to a long Island Nursing Home after a surgery. Vivian diaz filed the suit against the facility citing Gross Negligence and testified last summer before the new York State Assembly that officials did not safeguard patients like her mother Anna Martinez from the virus despite earlier warnings. My mother and many others contracted the virus at the nursing home, and today i am still under the belief that she was unaware and uninformed as to what was happening to her. As someone who spoke limited english, it appears she was not informed as to her condition and she, as she never shared that information with us who were always her best advocates. Vivian is with us now to talk more about this. Since vivians moms death i want to add, she cofounded the Facebook Advocacy Group voices foy seniors. Vivian, thank you so much for being with us. We know it has been an incredibly difficult year for you and your family with the loss of your mom, and i wonder, when you hear this report accusing the Governors Office of intentionally changing a Health Report so that the number didnt appear as bad as it was when it came to Nursing Home Deaths, you know, what its your reaction to than . Reaction to that . Now we see that the void referred to is avoid in honesty. We knew all along the numbers werent correct and feeling a little vindicated at this moment. How do you feel about overall Governor Cuomos handling of the States Coronavirus response . Well, to be honest, we felt insulted. All of these months, hearing him talk about going on the view, a book and parading different events, touting his success, and here we are the families holding on to whats left of the dry grass, and needing numbers and accountability to maybe fix this situation Going Forward. Do you think he should resign . Not only him. I think he should resign, his top staff should resign and definitely Howard Zucker should resign. You are right now suing your moms nursing home. We did reach out to them for comment. We have not heard back. I want to be clear about that. Tell us why youre suing them, and what happened while your mom was living there. Completely two different issues. Andrew cuomo had his play in this situation but my mothers nursing home was cited previous to this pandemic 31 times for not being adequately prepared for Infectious Disease protocols. My issue is, had they been prepared previously then maybe my mother would still be alive today, but the reality is that they werent and we would like them to hopefully change the situation so that other senior perishes in their facility. We saw from the a. G. s report there were a number of Nursing Homes in new york that were not doing well even before the pandemic, and that was a precursor to them doing very poorly in the middle of the pandemic. The Cuomo Administration has pointed to Nursing Homes making incorrect decisions about bringing in patients who knowingly had covid. They say that order that went out in march should have been, in a way, followed with with law in the state that said Nursing Homes should only bring in patients they should properly care for. When you hear that argument made what do you say . My mother was in a facility that could not properly care for her. Reality, once she became sick we were not informed or told and with a hospital 100 feet away they did nothing to send her to get proper attention. So were just baffleds to why he would mandate when we read this correctly, that they would have no choice but to take covidpositive patients and turn around and give them immunity. We want answers to those questions. Many families like yours who are suing Nursing Homes are finding its going to be very difficult. Immunity put in place for Nursing Homes and hospitals. What is your reaction to that . We wont be deterred. What accountability and justice, it may not be exactly what were expecting but the fact we have this conversation and hopefully can fix Nursing Homes Going Forward is a victory in itself. No matter what the victory looks like well continue to go forward, push forward. My mother deserved it and the 15,000 seniors that died deserve it as well. Vivian thank you so much. When you look at this, and this specifically this agreement when it comes to reducing the cap on the relief checks, do you see this as joe biden abandoning progressives . I see it as a really disappointing development. We obviously are now ultimately sending money to less people than the Trump Administration and the, you know, Senate Majority republicans, willing to, there are going to be about 17 Million People who will get less money. This is not the promise that we made. This is not who we are given the opportunity to be as majority in the senate and have the white house. So ultimately it is a failure when we compromise ourselves out of delivering on behalf of the American People and in keeping our propositions. I mean, just to be clear. Youre saying that trump wanted to deliver more in the way of checks for americans than biden . Yeah. So the last checks that we were able to send had given, you know, 17 million more people than we were ultimately doing with the caps now. And that, you know is going to be something that were going to have to explain, and i dont know if many of us have a logical explanation on why we are delivering less than what the republicans were willing to compromise us on delivering on baflgt to the American People. Moderate democrats part of why it cgot cut down. What do you say to those democrats . Again, i just want to remind them that, you know, you are giving the opportunity to have the majority in the senate, because the people believed that you were going to fight for them. There were promises that were made and they ultimately have to be kept. We are legislators entrusted to deliver, and, you know, were not going to be able to blame republicans for our inability to deliver on the promises that we made. This is just us now negotiating amongst ourselves. The house is controlled by democrats. The senate is controlled by democrats. The white house is in the hands of an administration that is democratic, and so, you know, i dont know how this makes any political sense, and it certainly does not make any policy sense. I want to listen to something that the Senate Minority leader Mitch Mcconnell said. He said people wont work if they get 1,400 checks. Lets listen. So i want analysis of the democrats extra bonus for workers who stay home will result in more than 60 of workers earning more money staying home than they would earn from returning to work. More money by staying home than theyd earn from returning to work. What a great idea. This isnt state unemployment insurance. Its barred from our kids and grandkids to pay yet an additional cash bonus for not working. What do you say to that . I mean, thats just a really foolish statement to make. We know that there are more americans that are working when they were back last year in may and june, given support to people who have been economically struggling and you are faced with dire financial situations. Its not us deciding that we are not giving people the opportunity to go to work when they have that chance. This is just republicans being out of touch with what, you know, regular americans go through every single day, struggling to feed their children, keep roofs over their heads and pay their basic bills. I want to turn to a different subject now, because federal investigators are examining records of communications between members of congress and the protrump mob that attacked the capitol. No rungdoing uncovered so far but this is in progress and we dont know what the findings are going to be exactly. But what do you know about this . I mean, we dont know much. We are, you know, Learning Bits and pieces. You know, this investigation into the events of january 6th. The insurrection and the rebellion against our government is not something that is going to happen in a month or two. It might ultimately take a year, but, you know, what were learning right now is quite disturbing. Its something that many of is have feared, and i im hopeful that the investigation will be done diligently and ultimately we will know what the results of that investigation are. Do you have reason to believe that any of your fellow lawmakers may have communicated with the members of the mob . So we know from reports and their presence in the events prior to january, the january 6th insurrection that many of them have been credited by the folks who have organized the march for helping get people there, and so you can make some sort of correlation to, you know, whether those people who have been mentioned in previous reports will be indicted, or indicated in some of the investigations that are happening right now. We ultimately, you know, have to reserve our opinions on this and just wait for the results of the investigation, because we dont want to jeopardize, you know, this investigation thats taking place, but its been really alarming to learn, and its been alarming to see just the number of republicans that are condemning the fact that there is even investigations into members of congress. In this regard. Youve been calling for accountability from saudi arabia, the Biden Administration concluded that the Saudi Crown Prince is responsible for the death of Washington Post columnist Jamal Khashoggi yet President Biden passed on the chance to otherwise hold him accountable. What message does that send to you . I think every minute that mbs escapes punishment is a moment where the United States interest in human rights and saudi citizens are at risk. You know, if the United States truly supports freedom of expression, democracy, human rights, there is no reason not to sanctions mbs. And our own intelligence found approved a murder of a u. S. Resident and a saudi journalist by the crown prince. Khashoggis murder is something we already decided to sanction others for, and in any measure of law and order, we dont just punish those who carry out the murder. We also punish those that sanction the murder, and in this situation we must do everything that we can to keep those values and principles intact. An investigation is now under way after a zoom call to discuss Racial Disparities in one Maryland Countys Covid Vaccine rollout allegedly turned racist when two montgomery Maryland County staffers left themselves unmuted and mocked a Latina Council members accent as she led the conversation. I want you to hear this, and its hard to understand what the two unseen staffers are saying on the recording, so we had it captioned. You can read their comments as you listen to the Council Member speaking. Were still perceived as a totally its like were like some other hologram of a county that doesnt look anything of what actually, who we actually are. I love how her accent comes out. And for some reason it gets perpetuated at the state level. Were the most diverse county. Were the large one. We understand that these issues have proceeded and weve responded to that. Weve done that without guidance or support from the state. I am now joined by that Montgomery County maryland Council Member nancy navarro. It looks like you didnt hear them at the time, Council Member. How did this come to your attention . Well, you know, youre right. I did not hear it as i was speaking. I was actually responding to a comment made by our Health Officers where we were discussing the glaring disparities in vaccination rates among our black and latino population. At this moment only 11 of our black population and 8 of the latino population have been vaccinated, and when you compare that to our white population at 53 , we have a lot of work to do, but its been difficult because our vaccine distribution, of course, is guided by the state, and so i was making that comment, and i was, you know, pleading with the state to please pay more attention and allow us at the local level to lead our counties because we know our communities, and when we then paused for our lunch recess because this was our weekly legislative session, my staff contacted me and said, listen, something happened. Because actually some people did notice, people that were listening did notice but they were also laughing when someone else was speaking so thats how i learned about it, and it was it was just a very it was a startling situation at first because, of course, i am very passionate about these issues of Racial Equity and Social Justice especially in light of this pandemic and and having led the work to pass the Racial Equity and Social Justice legislation in 2019. Yeah, yeah. And we have done a lot to address these issues, and at this point its a matter of life and death. It certainly is. Look, weve covered that a lot on this show as well, hugely important issues. I do want to ask you because, unfortunately, im Running Out Of Time here. I want to know what you want to come of this. Hr is investigating. The council is supporting you in a statement. The Media Company that employed the man at least has condemned his actions. What do you want to come of this . Well, i think that the investigation and the process should run its course, and i think appropriate disciplinary action should be put into place, but i also think that we need to be very serious about things like Staff Diversity and things like, you know, actual training and spaces that are safe for our black and brown staffing because these are analysts. These are people that also have an influence in how decisionmakers go about their business, how we serve our residents this. All is very connected, and it struck a chord because people are actually writing to me from all over the country expressing support but also they see themselves reflected in this particular moment in terms of how they are perceived, how their accent is perceived or how people are otherized so i think for us as policymakers is things we have to take very seriously because they are additive. People talk about microaggressions and these are additive and the result in this particular Decision Making informs policy but im not surprised right now we are encountering such disparities during this horrible time with covid19. This is nothing new, and i think that there are dots here that we are connecting so it is my hope, that you know, the leadership of the council, the staff leadership as well, that they take appropriate measures to ensure that this doesnt happen again and that our, you know, staffers of color are treated with respect and that there is a safe environment for them as well.
