Joining us now maggie haberman, also with us ross garber, an impeachment law professor at tulane law school. Good to see both of you this morning. Ross, as john pointed out, this as youre looking at this, youre saying a 10 out of 10 in terms of concern for his legal troubles, specifically involving the manhattan d. A. s office. Why . Yeah, so thats where id be focused. Ive been representing Public Officials and former Public Officials an executives for decades in these kinds of cases. As i look at the manhattan d. A. s investigation, if i were representing trump, i would be very worried. You know, theres this case that hasnt been finally resolved about getting the president s Financial Information, but already we know from Court Filings the Manhattan District Attorney has already gotten a lot of the Trump Organizations financial records. And the reason id be concerned is these kinds of cases are investigated and brought all the time. And the focus for me, if i were representing trump, would be on a kind of case where on the one hand there are representations made to tax authorities, which if you lie to tax authorities, that is a crime on the one hand. And representations made to business concerns. For example, to get loans. If you intentionally lie about Financial Information to get loans, that can be a crime too. What prosecutors wind of doing is comparing representations about Financial Information made to tax authorities with representations about Financial Information made to, say, get loans. If those things dont jive, thats a potentially very big issue. Again, those kinds of cases are investigated and brought all the time. Id be very worried about that kind of thing if i were representing trump. Maggie habehaberman, based o your reporting, what has the former president most concerned . That case in fact, john, the one in new york, in manhattan by the District Attorney has vexed them for some time. They were initially happy they were able to get a stay on the question of whether his tax returns would have to be able to be turned over through subpoena to the District Attorney. That has not been decided yet. But as ross says, the District Attorney has gotten a bunch of other information and he has zeroed in on a couple of areas that the former president has Real Estate Holdings in, a couple of ways in which he fashioned those Real Estate Holdings. I think that is the case that has not just the former president but his family and the Trump Organization most concerned. But there are a bunch of other cases, not just active right now. There is the potential the former president was warned while the events were unfolding on january 6th and after for Civil Litigation related to it. So he has a lot more potentially coming his way that we dont even see right now. The possibility of that Civil Litigation, ross, how concerning should that be from a legal perspective . So donald trump is an expert in Civil Litigation. Hes been sued umpteen times over the years. And so while i think if i were him id be a little bit concerned about those kinds of things, hes very accustomed to dealing with lawsuits. I think the bigger issues are the criminal investigations. New york, but we also know about additional criminal investigations going on, for example, in georgia over the over the call with georgias secretary of state. Id be a little bit concerned about that one too. Maggie, what are the former president s plans now . We saw a statement he put out on saturday after the senate did not convict him. But what is he going to do . There was a question whether he would hold a News Conference in maralago. Hes not going to do that right now, john. Its possible that it will get put on. Hes still donald trump. There is still the danger in saying hes not going to do something and having him change his mind because he sees news reports saying hes not going to do it. But as of last night the plans for a Press Conference is off or discussions about it are off. He has communicated to some advisers that he sees the value of laying low for the moment. How long he can keep that up, well see. I do think without twitter to lure him back into speaking constantly, it has been easier for him to stay out of sight. He may be laying low but we are seeing other names within the trump orbit floated. Im thinking most recently of lara trump as were looking at whats happening with the censure with senator burr in north carolina, which is on the heels of ivanka trump being floated as a possible Senate Candidate in florida. How much of that is really about, maggie, keeping the trump brand out there and keeping this strong press on the party . So just for chronology purposes, lara trump was thinking about running for the race long about this ivanka trump in florida float began. Look, its impossible to discount that the trumps are not doing some of this for publicity. I do Think Lara Trump was looking at that race. She has told people shell decide in the next couple of months and i think the events of january 6th as our reporting showed sort of soured her interest in doing this and made the trumps recognize they would have a problem. But as time as gone on, things have gotten easier. In terms of ivanka trump, i think its much mess likely that she runs, but it is interesting how concerned allies of marco rubio appear to be about it and it speaks to the hold they still have on the party. It seems like every sentence or tweet that comes out of his mouth is specifically designed just in case ivanka trump wants to run in florida. Ross, one of the ideas that has been floated by some republicans but mostly democrats since Saturday Night has been the idea of a September 11thstyle commission to investigate everything that happened on january 6th. I wonder what you think that would end up what would be the goal of that and what jeopardy would the former president be under there as well . Yeah, so one of the things we didnt know before and know now is that an Impeachment Investigation is often not a great way to actually find facts. I think we could all list probably a dozen questions that we still have about what happened on january 6th and about the president s role both before, during and then also after. And so, you know, a congressional investigation is the way to kind of get those facts and get them out to the public. Based on what we know right now, im not if i were trump i probably wouldnt be that worried about a criminal investigation of trump in that case. But there are more facts that could come out and that would be my concern if i were if i were representing donald trump is, you know, we dont know what we dont know and the more facts that get unearthed. For example, did the president former president have advance notice of Potential Violence . That would be an issue that if i were him id be concerned if he has reason to be concerned, if he knows the truth, right . Maggie, just very quickly, what level of concern do you think there is in the former president s orbit of that type of investigation . I think there is concern about it. I think that has continued to be the case. We know that the washington District Attorney is continuing to look at charging the former president. They are aware that there is a lot thats unknown. I do think there will be some kind of investigation in the house that they are also concerned about because people have not been called under oath yet. Some of this stuff is knowable, right . What was the president watching . What did you hear him say, that kind of stuff. If you could ever get that testimony, we would learn a lot more. Maggie haberman, thank you for your reporting. The Biden Administration looking to push through this Coronavirus Relief bill, 1. 9 trillion, pushing lawmakers to make that happen quickly. I can tell you in speaking with white house officials over the last week that they were focused on trying to show that they were governing amid this Impeachment Trial. But at the same time very much looking forward to that trial being over so that they could reclaim the spotlight, and that is what you will see President Biden doing this week now that the Impeachment Trial of his predecessor is in the books. We will see the president tomorrow at a cnn town hall in the state of wisconsin talking about Coronavirus Relief, the importance of it for the economy as well as for the Health Crisis brought about by this pandemic. And then on thursday you will see the president travel to michigan to tour a Pfizer Vaccine manufacturing site as well. You can be sure that the subtext, perhaps more than the subtext, more overtly than that, will be the Coronavirus Relief package that President Biden is pushing. Now, to be clear over the last week we have already seen House Democrats working through this Impeachment Trial to actually write President Bidens 1. 9 trillion Coronavirus Relief package into legislation. We saw the meat on the bones of those 1,400 stimulus checks, of expanding affordable child care as well. This week were expected to see the House Budget Committee begin to assemble all of those different bills into one piece of legislation in order for that to move forward to the senate. At the same time, President Biden will be working to drum up public support for this package. Last week we saw him meet with bipartisan mayors and governors to talk about the bipartisan support that exists of the perhaps not in washington yet but certainly around the country for this Coronavirus Relief bill. But again, the timeline is really ticking here. 27 days before march 14th, which is the crucial deadline that the white house and House Democrats are looking at. That is when those federal supplemental Unemployment Benefits expire. And so 27 days to not only get this through the house but then to have it go through the senate. Then again, if the Senate Passes a different version of the bill, it has to go back to the house, so 27 days not that much time but the white house certainly working towards that goal. Erica. Almost 50 degrees below normal in oklahoma for the high temperatures today alone. Record lows at least well, still going on right now, temperatures are still going down. We have ice and we have snow. And we have Rolling Blackouts in texas. The 2 Million People you talked about in texas are Rolling Blackouts trying to stabilize the grid because so many people need the electricity. There is the snow right now. It is snowing in louisiana. It will be icing in nashville later today. Heres what the forecast looks like. That pink is the ice. So mississippi, alabama, nashville, all the way up even to south lexington, kentucky, ice today. To the north, heavy snow. Cincinnati, columbus, all the way back up even toward buffalo. Some republicans calling for him to be kbeeimpeached. This is on the heels of democrats calling for him to be stripped of his Emergency Powers upon allegations that cuomos administration covered up the scope of Nursing Home Deaths due to coronavirus. Reporter good morning, erica. This is only just beginning. The new York Assembly republican leader is calling to the democrat leaders to call a special session this week to discuss expanding those expansive Emergency Powers you just mentioned, powers granted to the governor during the pandemic. This is something that both parties have said they would support. This is a very big deal. Reporter new York Governor Andrew Cuomo is facing calls he be investigated. State republicans going so far as to say he should be impeached. The gravity of this coverup cannot be overstated. Reporter this after his top aide admitted to withholding data for months that revealed thousands more confirmed and presumed covid19 deaths of longterm Care Facility residents than previously disclosed. Throughout the pandemic, you know, between his emmy for his Coronavirus Press briefings to Governor Cuomos book to his speech at the Democratic National convention, Governor Cuomo has been held up as the model governor in his coronavirus response, even though new york was so hard hit by the virus early on. Reporter but now, according to a transcript of a private video call. Melissa derosa told Democratic State lawmakers that in response to questions basically we froze because then we were in a position that we werent sure what we were going to give to the Department Of Justice or what we give to you guys, what we start saying is going to be used against us. 14 Democratic State senators saying in a statement cuomo should be stripped of his Emergency Powers. State riepublicans echoing thei call and going further. The Cuomo Administration purposely lied and withheld evidence and information to avoid prosecution. Andrew cuomo must be prosecuted, and andrew cuomo must be impeached if this evidence exists. Reporter some 15,000 residents of Nursing Homes died. About a third of all covid deaths statewide. The true death toll was revealed after new York Attorney general and cuomo ally Letitia James issues a scathing report accusing the state of undercounting deaths in these facilities by 50 by only publicly reporting twhhose who died on site, not those who died in hospitals or where else. Whether a person died in a hospital or died in a nursing home, its people died. I wish none of it happened. I wish there was no covid. I wish no old people died. Reporter cuomo has faced criticism over a march 2020 state Health Department advisory that required Nursing Homes to admit and readmit patients with covid, something critics say may have further fueled the outbreak in those facilities. Cuomo has said the policy was in line with federal guidance. It was the absolute worst decision anybody could make in a time of a pandemic. Reporter the controversial directive was scrapped in may. The Associated Press reporting more than 9,000 recovering coronavirus patients in new york were transferred to Nursing Homes from hospitals early in the pandemic. And what makes this so challenging for the governor is that this is someone who was put on a pedestal with the accolades and bestselling book and talk of higher office. So now at least for many people, that image has been sharttered. This is all still playing out, but its impossible to imagine this controversy not being a topic of conversation when it comes to cuomo running for reelection in 2022. Certainly not a conversation ending any time soon. Thank you. Joining us now is Jesse Mckinley. Great to have you with us this morning. As we look at what is in the works here, right, these bipartisan calls to strip Governor Cuomo of his Emergency Powers, some push for impeachment from republican lawmakers, what is the reality of what we could see happen . I think impeachment new york is a very Democratic State. Both houses of the State Legislature are dominated by democrats. I dont think theres political will to impeach. But as i pointed out, the political fallout from this just seems to be beginning. The governor is anticipated to make his first remarks about this today. I think hes going to get hit pretty hard by questions about why the data was withheld and how political this actually was. Yeah, the thing about his response and we played a little bit of it in the piece there, he seems to be saying nothing to see here, theres nothing to see here, why does it matter where they died . If it didnt matter, why then are there allegations of a coverup . Why then is there evidence that your administration tried to hide where all these people were dying, and it gets to the criticism over the policy that was in place. Part of this might just be Governor Cuomos unwillingness to say i wish we hadnt had that policy or that policy was proven wrong in the end. Go ahead, jesse. Yeah, theres an uncomfortable dichotomy here. Governor cuomo for months and months and months said im the data guy, im the science guy, follow the facts, just the facts, maam, et cetera. And then when this issue of these major facts about 15,000 deaths in the states Nursing Homes was sitting there apparently available to the state government, they didnt release it. So those two facts just dont right and theres no way to reconcile those. I think cuomo is going to have to answer those questions today. And also just to follow up on that, just put in perspective for us why it does matter. Were talking about covidrelated deaths for nursing home residents. Why does it matter, because it does, whether they passed in the facility or whether it happened at a hospital . Because the governor seemed to say it doesnt. Well, keep in mind the actual death toll, the number of people that died has not changed. But also cuomo for months and months and months once again said, look, were one of the lowest percentage states in terms of Nursing Home Deaths. Were 46th, were 46th. This turns out not to be true when you look at the real numbers. If the numbers were being cooked or withheld, that allows them to make a more credible case that hes doing a better job. If those numbers are not correct, then he was not doing ipso facto as good a job and that hurts his reputation. And i think this goes back to reputation, not only for his 2022 reelection campaign, which once again in a state like new york looks pretty solid, but looking ahead towards 2024 when potentially a president ial campaign might have been in the works. You said impeachment is unlikely because democrats are in such solid control of both chambers at this point, but stripping him of Emergency Powers would also be possible. How would that happen and how likely do you see that scenario . I think it will probably get through the state senate this week. The State Assembly seems less likely to do it. Keep in mindi, that would be somewhat of a censure but it would not i think we just lost jesse. Frozen jesse there. We did invite the governor to come on the show and they did not respond to the invitation. What Jesse Mckinley was getting at is impeachment is unlikely. Stripping him of Emergency Powers may be also unlikely. But just the mere push which could be bipartisan, theres democrats calling for this too, is a rebuke on how Governor Cuomos administration has handled things. Donald trump was acquitted but he was not vindicated. This was the most bipartisan Impeachment Trial vote in american history. Seven republicans voting to convict the expresident for inciting an insurrection. But the velocity of lies from trumps lawyers was stunning even by recent standards. To be fair, they didnt have a lot to work with. They only used two and a half hours of the 16 they had been allotted, and they spent fully onequarter of it on video. Mostly what aboutism mashups designed to reflect on democrats. The remainder of their statements required a boatload of fact checks. From flatout falsehoods the entire premise of his remarks was that the democratic process would and should play out according to the letter of the law. To surreal whoppers like saying trump was the most antimob rule president this country has ever seen. And there were a litany of easily disproven lies, like saying there was no evidence the 2016 election was hacked, repetitions of trumps false claims of fraud in georgia, saying that the rioters didnt attend trumps rally speech or claiming that the attack came from extremists of various different stripes and political persuasions. But perhaps the most egregious lie came in response to this direct question from Senators Romney and collins. And here was michael van van der veens response. The answer is no. At no point was the president informed the Vice President was in any danger. Sounded pretty definitive, right . But it was false because senator Tommy Tuberville told trump that his vp had been taken out of the chamber right before trumps tweet calling pence a coward. The National Security advisor said the vp was in harms way. The Shouting Match between Kevin Mccarthy and President Trump which showed trump callously disregarding the safety of congress while it was under attack. So as van der veen said on another subject this is not only intellectually dishonest, folks, its downright scary. We know that politicians are accountable only to voters, but whats the recourse for lawyers . Well, as it turns out, in pennsylvania where two of trumps lawyers are members of the bar, there is a requirement that lawyers practice candor towards the tribunal. It says specifically that a lawyer shall not knowingly make a false statement of Material Fact and penalties range from private reprimand, to censure and disbarment. This is rare, but so are Impeachment Trials. Maybe its no surprise that defending the big lie requires lots of smaller lies, but its a mistake to take it all in stride. That just defines dooef yancy down. As the Senate Chaplain said at the start of the trial could it really be that simple . Could it really be just truth striding against falsehood . Yes, it really should be that simple. And thats your reality check. Really should be candor toward the tribunal, huh . Thats it. Panic in the disco. All right, john, appreciate it. Thank you. As attorneys for former President Donald Trump were defending him in his second Impeachment Trial, a different legal team was busy in florida at a Town Council Meeting where they were fighting for the former president s right to live at his maralago estate fulltime. There is no reason in the world that this body should ever determine that former President Trump shouldnt reside at the club he owns. Hes got a right to live there under all of those documents and the zoning code says he has a right to live there as well. This guy as he wanders the property is like the mayor of the town of maralago if you will. Joining me now to discuss is the State Attorney for palm beach county, florida. Good to have you with us this morning. So weve been talking a fair amount about this, even leading into the president moving to florida fulltime. And one thing that came up was this agreement from 1993 that nobody could live there fulltime and the president would remain a member of the club. Well, apparently as of january 25th, he signed a document saying hes now an employee. Hes now the president. And, therefore, should be allowed to live on property as an employee. How is that sitting at this point . Well, its not sitting well, erica, with the neighbors, because they believe that the 1993 agreement prohibits anyone from living on premises. And back in 1993, trumps own lawyer, a different lawyer than today, said to the town council that he would not be living there and that he would be a member, like every other member, he can use the guest suites. So somehow thats been changed to today where he is now an employee. So i guess you could say that he went from hosting The Apprentice to being an apprentice. So thats going to be the big legal question moving forward. I think the most interesting thing is that the town lawyer actually seems to buy that argument. And so this thing could be helded to the courts. Well, buys that argument because, and correct me if im wrong here, employees actually can live on site at a club. So now that the president is an employee, actually he is sort of a host if were talking about hosting because as i understand it, his duties as president are saying that he will evaluate the performance of employees and attend events held at the club and welcome and thank those who are attending. Thats right. Thats it. Its the definition of employee. Now, the contract between trump and the town of palm beach is to me pretty clear. But the lawyer for donald trump says that there is an ambiguity whether he can live there so, therefore, you must look outside the agreement to the town zoning code. And the zoning code says that employees who work on premises can live on premises. That includes corporate officers. But, you know, theres a Slippery Slope Argument too that says that, well, then does the agreement mean anything then . Doesnt anyone who can be labeled an employee then can live at maralago . It could essentially be a hotel because he can just make anyone who wants to stay there a temporary employee and now katie bar the door. A couple of questions on that for you. That zoning code that allows an employee to live on site, does that apply to the employees family . If the superintendent lives in the building, then their family may live with them. Does this then include the former first lady, barron trump . No, they would have to be designated as an employee as well. So so a minor would have to be designated as an employee . Well, according to the zoning code, it just says that employees can live on premises. So it would be up to the lawyers to have to say, well, the employee has a family and they could live there too, but it keeps getting to be stretched. To me, i think the most problematic side of the argument is that you have a contract in place. The contract says only members can live on premises and thats temporarily. You cant stay more than 21 nights. So to get to where the employees can do it, you have to look outside the four corners of the contract. Well, at the same time, trumps own lawyer back in shoot, i think we lost that connection. But it is fascinating to look at, right . I hope that history will record that a majority of the senate, 57 senators stood and issued their verdict of guilty of this president of high crimes and misdemeanors. It did not meet the constitutional threshold of twothirds. But it was the most bipartisan impeachment in history. I think history will record the shame, the disgraceful nature of this presidency and certainly that he was impeached twice. One of the things i sat through was listening to Mitch Mcconnell afterwards, basically call the former president s actions a Dereliction Of Duty. Yet, he voted to acquit. So how will you assess his level of political kucourageousness there . Its quite low. That was a searing moment. I stood in the chamber after they voted. Each senator literally stands and says his or her verdict. So we watched as Mitch Mcconnell stood and said not guilty and then within minutes he stood in that same place and said there is no question that trump is practically and morally responsible and he called the president s actions a disgraceful Dereliction Of Duty. I think history will record that Mitch Mcconnell is guilty of a disgraceful Dereliction Of Duty. How did it hit you personally . I was interested in you being there and seeing it. Its hard to believe there are surprises anymore in this day and age. But how surprised were you . I was not surprised. I think i was pleasantly surprised that we got to 57. We certainly argued the case put forward all the him daing evidence that we possibly could that was facttual, that showed the egregious behavior of a president inciting insurrection. Then his inaction afterwards, not even sending to find out how this Vice President or a coequal branch of government was. So on the one hand, we went for conviction. We wanted 67 votes. Unfortunately, we did not have 67 senators of conscience. We needed ten more. We simply didnt get them. Explain to us what you got, what the managers got by winning a vote on the ability to call witnesses and it would have been congresswoman Jamie Herrera butler, what do you get about winning that vote to call witnesses but then actually not doing so . I mean, the statement was out there. The statement that she says so reading it into the record, why would that be sufficient . Well, what happened there and it was a success. First of all, i couldnt give credit to coming forward and wanting to milwaukee that statement. The statement, should the president s State Of Mind when he is on the phone with representative pittsburgh car think, mccarthy saying, what are you doing . How are you going to help us . The president is more interested in whats going on and the work i guess of the insurrection is on behalf of his big lie, we got the other side, the president s council to stipulate that that was the president s State Of Mind, that that statement was accurate. So that was the calling of witnesses. It could have devolved into an attempt to get more witnesses. You know, were still waiting for don mcgan. You remember out of the judiciary more than a year ago. That would have evolved into a Subpoena Fight and the calling of bogus witness. What we did was we showed witness. Every senator in that world witnessed. The world witnessed an eens by the president of the United States. You have been supportive of the idea of having a September 11thstyle commission. So what questions would you like answered investigating the attack on january 6th . Oh, i hope there is a very full investigation of this historically dark moment in our countrys history. I think, i hope that many, many more heroes will come forward with evidence of what they know of what the president was doing, of those who aided and abetted him doing, exactly the harm that was caused. You saw the custodian had to clean up bloodsustained floors, sweep up chards of glass and splintered wood. There are will heroes, people who took pride in their work and did their duty. Id like a full investigation to so we lift up the heroes and point out shameful behavior. If we dont learn from this, we are destined to have it repeat itself. You are in the midst of an incredibly busy few weeks, personally. Not only were you a House Impeachment Manager during this historic try. You have a book you cowrote with your son harry that details your familys struggle with his opioid addiction. And i want to read a passage from the book here and this gets to do with the moment that you confronted him. You say, quote, i dont remember saying much more. Quote, you are stealing from us, from daddy and me. Its got to be for drugs harrys facebook broke and his big eyes darked, filled in with tears, for the first time in years, he had nothing to say. He admitted it was drugs. I knew instinctively what to ask. It was the only thing that mattered to me and pj, are you ready to get help . Talk to me about why you wrote this book and why you with in. Thank you for raising the book. I do think as important as impeachment and of course the work of the congress is the crisis, the Opioid Overdose and addiction crisis is so real in this country. We wrote the book and you can imagine, we had no idea it was released on the very week that we completed impeachment. We wrote the book because we hoped that our story offers others hope that maybe they will see and my stumble to my struggles and harrys stumbles and his falling into deep, dark addiction, that there is hope in recovery and that you can raise a hand and say, please help me. I think too often and i have learned through the writing of this book and really literally in conversations with harry, that addicts think there is no hope, that sometimes Addiction Steals so much of them, steams their personality, steals their feelings of right and wrong, steals their sense of any sort of pride or selfconfidence. They get robbed of all of those things, that they dont think there is help available or that it will never work. There is hope in recovery harry is now years into recovery. I think i should know the exact date was October 30th Of 2012 when we confronted him and he said yes to help and he has been sober ever since and hes helped others in recovery. So there is hope and we have to do anything we can to remove stigma around addiction. Any time anyone discusses it openly like this, it does help. Is it ever fully out of your mind . You say you are eight years into recovery. Does it ever escape your thoughts . No we do know that it is every day something that those who struggle with Substance Abuse disorder have to deal with. But as you can read in the book, it does lift, from harrys explanation, the craving, the needs to use, does begin to lift after a certain peermt, certainly, its always in the back of our minds, its always in our hearts. I just keep praying for harry and all who struggle with any kind of substance disuse disorder, really, there is help in recovery. Hes the father of two children and another one is on the way. As i said, he is helping others. Harry, we never stop being parents, you can be a house him people. Manager, you never stop being parents. Congratulations to you. Thank you for having me.
