He is being sued by Virgina Giuffre for alleged sexual abuse. Heres our legal correspondent dominic casciani. Overnight, documents were published in the us court dealing with the Virginia Giuffre Case with allegations with the Virginia Giuffre Case of allegations against Prince Andrew. The judge ordered that she and her lawyers could serve the case on Prince Andrews us based attorney, a lawyer in los angeles. Serving means putting the allegations in the hands of somebody who is either the defendant or their legal team. That is effectively the really important step to then progress the case. What has happened so far is that lawyers for Prince Andrew have said he has not been properly served, so the case could not progress. The rationale for keeping the Pcr Testing in particular, rather than lateral Flow Testing, is it does enable you to do the Genome Sequencing of potential new variants. And thats been the argument for keeping it as a Pcr Test. But look, we also wanT To try to help people get back to life as normal, so if the case can be made for changes, then obviously we will consider that. Some scientists argue they are still needed. I would like to see Pcr Tests remain, because they have given us so much information already from the sequencing. So we know when delta was introduced, when the Delta Variant came in, thaT This virus was imported over 500 times. And we would not have that information if we were not doing the Screening And Sequencing that is associated with that. Heres our legal correspondent dominic casciani. Overnight, documents were published in the us court dealing with the Virginia Giuffre Case of allegations against Prince Andrew. The judge ordered that she and her lawyers could serve the case on Prince Andrews us based attorney, a lawyer in los angeles. Serving means putting the allegations in the hands of somebody who is either the defendant or their legal team. That is effectively the really important step to then progress the case. What has happened so far is that lawyers for Prince Andrew have said he has not been properly served, so the case could not progress. Thejudge has said we have goT To get on with this and he has made the order. In the uk, where they are trying to serve the documents on the prince, the High Court has said it is giving the princes lawyers until next friday to challenge a decision thaT The High Court here should be involved. The industry also wants the more expensive Pcr Tests that all travellers have to do when they arrive in the uk to be replaced by the cheaper lateral Flow Tests. It worries the cost is putting off travellers. Previously, people talked up the need for Pcr Tests because we didnt have the vaccination that protected us from all known strains. Everythings changed now. Weve got 80 of the country vaccinated. I i mean, how long do we have to go on . I the argument for Pcr Testing has been thaT They are more sensitive, and so can pick up cases earlier, and, unlike lateral Flow Tests, they can be used to identify variants of concern. Whether the government will scrap Pcr Tests altogether is still in the balance. The rationale for keeping the Pcr Testing in particular, rather than lateral Flow Testing, is it does enable you to do the Genome Sequencing of potential new variants. And thats been the argument for keeping it as a Pcr Test. But look, we also wanT To try to help people get back to life as normal, so if the case can be made for changes, then obviously we will consider that. Some scientists argue they are still needed. I would like to see Pcr Tests remain, because they have given us so much information already from the sequencing. So we know when delta was introduced, when the Delta Variant came in, thaT This virus was imported over 500 times. And we would not have that information if we were not doing the Screening And Sequencing that is associated with that. The government has said its top priority is to protect Public Health, and that decisions on the Traffic Light System are informed by the latest Risk Assessment from Thejoint Biosecurity Centre and wider Public Health factors. So what happened was the Tavistock And Portman trust sought leave to appeal, that appeal was heard, thejudgement was handed down this afternoon, and whaT The judges aT The Court Of Appeal found was thaT The other court was quite wrong that it was inappropriate for the courT To intervene in this area, that it should be lefT To doctors by and large to determine whether a young person is competent. Thats the key word here has the competence to make a decision about something so important. They said thaT The court was also wrong to make the guidance, and of course what has happened, as a result of the original High Court hearing, all new cases were not being prescribed drugs because, for those under 16, certainly, that would have to be decided by the court. In the year ending march 2020, there were 1. 6 million female victims of domestic abuse in england and wales. 618,000 female victims of sexual assault, and 892,000 female victims of stalking. The report said that while police have made vast improvements in dealing with violence against females, there are continued failings, and called for a fundamental cross system change, asking for iT To be prioritised as highly as countering terrorism. Suzanne Van Hagan was killed by her partner in 2013. Prior to her death, incidents of domestic abuse were reported to police, yet no effective action was taken to protect her. I was briefly looking aT The reporT Today, one of the key things we as a family have always wanted was for all of the agencies to work together. In my sisters case, suzanne van hagen, this did not happen, they did not communicate well enough together, and unfortunately we felT This was one of the key reasons why unfortunately my sister passed away from Domestic Violence. Charity womens aid says Domestic Violence increased significantly during the pandemic. We have to remember that domestic Abuse And Violence against women is a gendered crime, they are gendered issues, so if you look aT The stats for last year, the number of cases that were in court, some 92,000 plus, 84 of the victims were female and over 92 of the perpetrators or defendants, if you like, were male. I am not surprised by the findings but i am very impressed by how they have marshalled all the evidence thatjustifies them saying there is an epidemic of male violence against women. Most women Feeling Unsafe and having to calculate how they get from a to b, especially when its dark outside. And, really, in terms of sexual assaults, too much of the cultural baggage of, oh, well, she must have brought it on herself, or its just her word against his. I think whaT Theyve done is they bring together in this report all the evidence, they propose change which i think there will be a big agreement on. The big question is, what is the government going to do in response . And i hope whaT Theyll do, having commissioned this report, is implement it and then they will save lives and save, really, millions of Peoples Misery as a result of domestic Violence And Violence against women and girls. From my reading of the report, it recommends changes in structures and processes, it recommends changes to the law, and it recommends more resources. I suppose The Big Question is, how can that all be achieved . Well, i think it can be achieved and it must be achieved. The criminalJustice System is there for women and girls, as well as men. Its there to protect people women being killed by their Husband Or Partner as well as being killed by terrorists. Its there to deal with Sexual Violence as well as organised crime. We just need to have violence against women and girls as one of the priorities, alongside public order, terrorism and organised crime. And its true we do need additional resources, buT These are resources which are going to protect children from misery, women from Feeling Unsafe, and will ultimately save lives. We cant simplyjust say, oh, Theres Nothing we can do, we cant afford to protect women from male violence. We can and must. Our democracy is there to deliverfor women, and weve got a Home Secretary now and its at her feet, really, to take this forward. Does that make you optimistic thaT This could be a moment of real change, and thaT This wontjust be yet another reporT That everyone applauds buT Then gets put on a shelf somewhere . Well, im hoping so because there is a very big consensus abouT The scale of the problem, and a very big agreement about whaT This report proposes. Weve got a woman as Home Secretary as the same time as a woman metropolitan commissioner for the firsT Time, aT The same time as a Woman Inspector of constabulary. Weve actually got women in senior positions and now its down to them to deliver for women in the country. Its also down, isnt it, to a change in culture . And i wonder if that is a change in Police Culture and the report has highlighted vast differences between the ways different Police Forces approach this but also in public attitude, and that attitude i am sure youll recognise well, we dont know what goes on behind closed doors. What can be done to change public attitudes to this . I donT Think its public attitudes as a whole, because i think that women are very well aware thaT Theyve got a right noT To be killed or assaulted in their own Home And Theyve got a righT To walk down The Street without being harassed by predatory men, and theyve got a righT To be listened to if they claim they have been raped. And i think theres just a hangover from male hierarchies in the police, and in other organisations in the pasT That have just assumed Theres Nothing that can be done about it, and i think we are hopefully at a Turning Point where we say, we are noT The sort of society where we expect women as opposed to men having to feel cautious about how they go home from school or how they go home at night after work, and thaT They shouldnt have to look over their shoulder and that women should be safe in their own home. That was the Labour Mp Harriet harman talking to me a little earlier. There have been new developments both here and in the us in the legal case involving Prince Andrew. He is being sued by Virgina Giuffre for alleged sexual abuse. Heres our legal correspondent dominic casciani. Overnight, documents were published in the us court dealing with the Virginia Giuffre Case of allegations against Prince Andrew. The judge ordered that she and her lawyers could serve the case on Prince Andrews us based attorney, a lawyer in los angeles. Serving means putting the allegations in the hands of somebody who is either the defendant or their legal team. That is effectively the really important step to then progress the case. What has happened so far is that lawyers for Prince Andrew have said he has not been properly served, so the case could not progress. Thejudge has said we have goT To get on with this and he has made the order. In the uk, where they are trying to serve the documents on the prince, the High Court has said it is giving the princes lawyers until next friday to challenge a decision thaT The High Court here should be involved. There is a lot in play, but what is going on here, time is running out and it looks increasingly the prince may face a situation where he has to accept service, so theres a lot going on. Dominic casciani there. The welsh government has announced tighter rules for getting into nightclubs and large scale events. From october 11th, people will need a pass showing theyve been vaccinated or a negative lateral Flow Test result. It comes at a time of rising Covid Infection rates in wales. Hywel griffith reports. In his new role as Housing Secretary, Michael Gove has paused controversial Government Planning reforms. Its understood Mr Gove wants to discuss the reforms with conservative mps and understand their concerns. Heres our political correspondent nick eardley. Borisjohnson has promised to build 300,000 extra houses a year by 2025, and to do that he was planning to Liberalise Planning Laws to make it much easier for developers to build new buildings in certain parts of england. BuT That plan was extremely controversial, not least among conservative mps. They feared it would undermine local democracy, and here at westminster perhaps just as significantly they feared it would have a big impact on the Conservative Party in the south of england, as well. When the Housing Secretary Robert Jenrick was sacked on wednesday, there was a lot of speculation thaT This could open the door to a rethink on those plans, and it seems that Michael Gove is at least prepared to think abouT The idea of redoing these plans in a slightly different way. I understand that he has paused putting these plans through parliament, he wants to speak to conservative mps to figure out whaT Their concerns are, and, in the words of one government source, take stock. That has been welcomed by the tories who were deeply sceptical abouT These Planning Reforms. It does not mean theyve definitely been scrapped, but it certainly leaves a question open abouT Their future. I donT Think it is for us to convince people thaT The Planning Reform is a good idea. Obviously that is for the governmenT To convince people. But we believe that a lot of people have overreacted to the proposals in the White Paper, which was of course just a consultation. We still dont know whats going to go into the planning bill, we dont know whaT The detail will be, but we never accepted or wanted a Planning System that didnt allow local people to have a say in the development of their Areas. These proposed plans have now been posed. Have now been paused. Can you, from the home Builders Federation, build the 300,000 homes a year the government says we need while these plans are on pause . Its always worrying when government introduced the idea of reform of any system. Because in the intervening period, there is a great deal of uncertainty and that is uncertainty for everyone, local authorities, for local communities, and, of course, the development industry. We dont wanT To see any further delays in the reform of the Planning System, and therefore, we would like to see the details on whaT The government are going to do. We need to build 300,000 houses a year in this country, and we need to get on and do that. Just so im clear in my own mind, does this mean that new Houses Wont be built while this is being paused . The Planning System is a really vital part of delivering housing in this country. Without an implementable planning consent, you cannot build a house therefore we need to plan for these houses, we need to make decisions on planning applications speedily and efficiently, and we need to bring forward land on which to develop. So, yes, more uncertainty, more delay, does threaten the delivery of 300,000 houses. We use the Phrase Housing Crisis is that an accurate description, do you think . Two men have appeared in court charged with the murder of the journalist Lyra Mckee, who was shot during rioting in londonderry in 2019. The men aged 21 and 33 were arrested on wednesday morning, and have had a number of other charges brought againsT Them, including firearms possession, rioting and arson. Lyra was 29, she was pretty well known in Northern Ireland as a journalist. So it was a murder that sparked a huge wave of public sympathy and outrage. This morning, at londonderry magistrates� court, two men appeared charged with her murder they appeared via video link. They were peter gearoid cavanagh, who was 33, from derry, and also and jordan devine, whos 21, similarly from this city. Charged with the murder, theyre also facing several other charges for example, having a Gun And Ammunition with intenT To endanger life, rioting, having and throwing Petrol Bombs, and arson. There were some exchanges during the court hearing. A detective told the courT That, in gearoid cavanaghs case, well, they believe he was identified in images footage from the night as being present and as escorting, in the detectives words the gunman around the time of the shooting. That was disputed by gearoid cavanaghs Defence Lawyer he said it was beond belief that anybody could be identified he said it was beyond belief that anybody could be identified from those images. Injordan devines case the detective said it was the police and prosecutions view that he had encouraged the gunman by punching the air and by cheering, and also lifting items from the scene later on in the evening. Again, the Defence Barrister said the evidence was weak and said, in fact, there was a zero substantial evidence against his client. Well, its a pretty blunt assessment, strong words from him. As we approach the climate summit in glasgow what happens is, under the Paris Agreement on Climate Change, countries or take part in that agreement, which is pretty much every country on earth, every five years is meanT To senT To the un and updated climate plan explaining how they are going to reduce their emissions. Well, many countries have submitted plans of that kind and if you add them up, you do see some reduction overall in emissions from them. But many countries, including them. But many countries, including the biggest polluters, have not updated their plans and crucially, china, saudi arabia, india and turkey. So withouT Them, emissions, according to the un, are still on track to increase. In fact, the Calculation Theyve done and this is the biT Thats causing shock waves is a projecT That by 2030, global emissions will be 16 bigger than they are right now. They hold that figure of 16 in mind because, not long ago, we had un climate scientist saying thaT To head off the worst dangers of global warming, particularly middle of the century later on, we need to be cutting emissions roughly by half, by 45 by 2030. So actually, the world is going in the wrong direction. And weve heard from antonio gutierrez, the Executive Secretary of the uns climate programme, has talked about a huge cause for concern because the world has broadly talked abouT The world has broadly talked abouT The need to act on Climate Change, but when you add up whaT The collective total is from all the different governments, we just arent getting there. If you are not fully vaccinated, you will still need to take a Predeparture Test, you will need to quarantine when you get back to the uk, and you will need to take a two Pcr Tests unless you do test and release, which allows you out after five days and you test negative. Initially that Pcr Test was staying, buT The intention is to get rid of that for people who are fully vaccinated by The End of october. So initially it will stay from the 4th of october, we dont have the exact date when Pcr Tests will go, and when that eventually goes, youll instead take a lateral Flow Test. This might all sound confusing the big issue here has been that Pcr Tests are a lot more expensive than lateral Flow Tests, so the Travel Industry ideally dont want any testing because its an added cost, buT They dont want Pcr Test because it is so much more expensive and is putting people off travelling, particularly families who might have to buy 3 5 tests to go on holiday. The Travel Industry will now be asking, this is happening before The End of october, but when . Because of half term. The government says they wanT To get rid of it before people come back from half term and would be hit by it. BuT Thats The Big Question, when exactly will this come into place . And other question would be, when people are considering to book a holiday for half term. We saw earlier in the year what happened with portugal and mexico, the rules are scrapped, then suddenly they are reimposed again and people have flown ouT To these places and they are in a pickle and need to get back.
