A Police Officer has been found guilty of the manslaughter of the former footballer Dalian Atkinson. A trial at Birmingham Crown court heard that Pc Benjamin Monk tasered Mr Atkinson for 33 seconds, and kicked him twice in the head. The former Aston Villa Striker died outside his fathers home in telford in 2016. Monk was cleared of murder. Jurors are still deliberating an Assault Charge against his colleague. Lets go live now to our correspondent in birmingham, Phil Mackie. Yes, jane, yes,jane, i yes, jane, i followed the case throughout, for five years nearly, since Dalian Atkinson died that night in August 2016 in telford. Just before midday, we had verdicts from thejury, who have been deliberating for more than 18 hours per stop its been a seven week trial. And they cleared Pc Benjamin Monk of count one murder but found him guilty of count two, thats manslaughter. He is the first officer to have been convicted of such a charge whilst on duty for more than 30 years. Let me take you back five years. What had happened was that Dalian Atkinson, a former Premier League Footballer, a big hero here in birmingham, when he played with Aston Villa, but he also played with Aston Villa, but he also played for Sheffield Wednesday and ipswich town, was suffering from really Ill Health at the time, and on the eve of a hospital appointment, his behaviour had been described as bizarre and erratic. He drove to his Fathers House in telford in the early hours of the morning and started shouting and banging, demanding to be let in, shouting that he was the messiah. Neighbours were woken up, they dialled 999 and two officers responded to the call, including Pc Monk. Pc monk had a taser, which he fired twice unsuccessfully, it didnt stop Dalian Atkinson, and as he advanced on him for the third time, he deployed a taser again, and on that occasion Dalian Atkinson was incapacitated and fell to the ground. Now, during the trial, the Judge Melbourne Inman qc told jurors that up to that Point Everything happened lawfully. That was what happened lawfully. That was what happened next was the crux of the case. During his own evidence, Pc Monk said he was terrified and acted in self defence, feared that Dalian Atkinson would get up again but the jury clearly disagreed with him and have convicted him now of manslaughter. At some stage you will have to be a sentence for that but the jury is back out deliberating again because his colleague on the night, Pc Maryellen Beth Lynn Smith was also charged with assault, a charge she denies, and there are still deliberations on that. People working in the Travel Industry are taking part in a day of protests across the uk, calling for the list of countries deemed safe for tourists to be expanded, and for more support for the sector. The government has always said that its international Travel Policy is guided by protecting Public Health, and there are concerns about letting in new variants that might be vaccine resistant. The number of children at home isolating has increased to its highest rate since all pupils returned to class in march. For many parents and pupils, it is back to remote learning, and increasing anxiety about how much more time will be missed in school. I believe the impact is absolutely huge. The normal protocol is that people dont usually go back to the area that theyre in, if they are close to the victim, and that was the case for me, and then his Release Date comes, and i had another phone call, and they said that, because of his Ill Health, that they are happy to leave him go back to the area. I was constantly then looking over my shoulder, thinking, am i going to see him . And then, lo and behold, i was in sainsbury� s and he was walking out, and it completely shook me to my core. Since we filmed with leah, she says a relative has again seen him at a nearby takeaway. Again, she has raised her concerns with probation. I feel like, back when i was a child, and i wasnt listened to, and it wasjust brushed under the carpet, this is how im feeling again. To be able to heal, to move forward and be the person i am supposed to be, i need things in place, and for him not to be in my space, and stopping me from moving forward and healing. The Probation Service say they sincerely apologise for the distress caused to leah, and they have taken immediate action to remind the offender of his licence conditions. They add, those posing an increased risk will be returned to custody. Seeing things on the media helped me come to my decision to take it to court, and i think its really, really important that other young women, other young people that are going through the same thing, see a face out there thats been through it, and even though im still struggling, there is light at the end of the tunnel. At times there have been more than 20 aircraft above the warship and there have been warnings from russian Coast Guard vessels and indeed we have heard shots fired, we believe they were out of range. Hms defender continued its journey through the crimea, Territorial Waters, within 12 miles of crimea, and we could see the coast. They did not deviate from its course and it completed its transit which took over one hour. A Police Officer has been found guilty of the manslaughter of the former footballer Dalian Atkinson. A trial at Birmingham Crown court heard that Pc Benjamin Monk tasered Mr Atkinson for 33 seconds, and kicked him twice in the head. The former Aston Villa Striker died outside his fathers home in telford in 2016. Monk was cleared of murder. Jurors are still deliberating an Assault Charge against his colleague. Heres our correspondent in birmingham, Phil Mackie, with the details. Let me take you back five years. What had happened was Dalian Atkinson, a former Premier League Footballer, a big hero here in birmingham when he played with Aston Villa but also Sheffield Wednesday and ipswich town, was suffering from really Ill Health at the time, and on the eve of a hospital appointment, his behaviour had been described as bizarre and erratic. He drove to his Fathers House in telford in the early hours of the morning and started shouting and banging, demanding to be let in, shouting that he was the messiah. Neighbours were woken up, they dialled 999 and two officers responded to the call, including Pc Monk. Pc monk had a taser, which he fired twice unsuccessfully, it didnt stop Dalian Atkinson, and as he advanced on him for the third time, he deployed a taseragain, and on that occasion Dalian Atkinson was incapacitated and fell to the ground. Now, during the trial, thejudge melvin Inman Qc told jurors that up to that Point Everything happened lawfully. That was what happened next was the crux of the it was what happened next was the crux of the case. What the prosecutors had argued was that in depressing the trigger for 33 seconds, the standard is five, he had held down the triggerfor too long and then he kicked him twice in the head, so hard that it left an imprint of the laces on his forehead, which had they said, led to him suffering from the cardiac arrest. During his own evidence, Pc Monk said he was terrified and acted in self defence, feared that Dalian Atkinson would get up again but the jury clearly disagreed with him and have convicted him now of manslaughter. At some stage he will have to be sentenced for that but the jury is back out deliberating again because his colleague on the night, Pc Maryellen Beth Lynn Smith was also charged with assault, a charge she denies, and there are still deliberations on that. After we had verdicts on Pc Monk and we had a statement from Dalian Atkinsons family, read on the steps by their solicitor Kate Maynard. Dalian atkinson is much missed by all of his Family And Friends and the footballing communities of the clubs he played for in his long and successful Career As a professional footballer. Especially ipswich town, Sheffield Wednesday and Aston Villa. The past five years has been an incredible ordeal for dalians family. We knew years ago about the terrible injuries inflicted by Pc Monk On Dalian, but we had been unable to talk about them, due to the criminal process. We are hugely relieved that the whole world now knows the truth about How Dalian died. While it has been hard for us not to be able to talk about the details of dalians death, it has been even harder to sit through this trial, and to hear Pc Monk try to justify the force he used. The fact that this case has taken nearly five years to get to trial is completely unacceptable, especially when you consider that Pc Monk was known by the prosecuting authorities from day one. People working in the Travel Industry are taking part in a day of protests across the uk, calling for the list of countries deemed safe for tourists to be expanded, and for more support for the sector. So extending the Furlough Arrangement for the Travel Sector and looking at a really targeted financial support, a revenue replacement system. There are currently 11 countries on the uks Green List, but most are not open to Uk Tourists to visit. The government has always said that its international Travel Policy is guided by protecting Public Health, and there are concerns about letting in new variants that might be vaccine resistant. The next update to the Green List is expected to be announced tomorrow. So you can see aircraft parked up here, there is a jet2 aircraft. There is ryanair. This is the view of manchester airport. Industry heads are waiting anxiously for news, particularly if quarantine might be removed for fully vaccinated passengers from Amber List countries. So that is 89 children that have lost ten days of education this half term already. The high transmissibility of the Delta Variant is causing real challenges in schools. The number of children at home isolating has increased to its highest rate since all pupils returned to class in march. The Department For Education estimates that 3. 3 of State School pupils, approximately 239,000 children in england, did not attend class for Covid Related Reasons last week almost three times the number from the previous week. For many parents and pupils, it is back to remote learning, and increasing anxiety about how much more time will be missed in school. I believe the impact is absolutely huge. Shes now had three national lockdowns and five periods of enforced self isolation. Shes in year 10, so shes at a crucial stage in her education. Remote Learning And Home learning packs for children are an incredibly poor substitute for being in a classroom with a teacher and your peers. Teaching unions say the situation is schools could rapidly return to peaks seen eearlier in the pandemic, and the government needs to come up with a plan for september. The people who are leading our schools and colleges need some clarity about what the possibilities might be. Are we going to have to reintroduce testing at the beginning of term, i would that be reassuring for people . Are facemasks going to be in . There needs to be an urgent sense of education being an absolute priority here. Now the issue with herd immunity is you need to do with most of the population and so far we have heard from the children that they might not vaccinate children, which is very concerning, but thats 20 of the population, under 18 year olds. So really this government are going to have to address issues around low Vaccine Uptake across the regions, among particular groups, as well as increasing, doing a lot more around Vaccine Hesitancy. find increasing, doing a lot more around Vaccine Hesitancy. And so, you know, bands and all kinds of musicians, whether it is classical, jazz, pop, will need support, and especially bands who are coming through. Musicians who have been waiting for the last 18 months while weve been in the pandemic to try and go out on tour and start things for themselves and start a career and bring some money back to our economy, they are going to be really struggling to deal with a lot of these costs. Its going to be prohibitive, in terms of touring. Bands like ourselves will have to cut as many corners as we possibly can, which is not what we want to do. We are taking money out of our economy, in terms of the buses that we travel on can only stop three times now in europe. So we are asking the government to look at some kind of bilateral agreement in order to allow other musicians to come to our country and for us to go there and talk as we have done, because it is a big part of our income, and there is honestly a soft power, in terms of culture, you know, whether it is the beatles or stormzy. We give our culture to other people, and we take it in as well, you know, we absorb other cultures. And if the process is as streamlined as it was, this is not just a cultural thing but an economic thing, because the Music Industry is worth 5. 8 billion to the Uk Economy each year, so its something that is a pertinent problem, i think. Hugely complex and lots of red tape and different systems in different countries and cause financial impact. The government says short term temporary visits are possible in at least 17 eu countries. A consultation on whether chAnnel 4 should be privatised has been launched by the government. The chAnnel is presently funded by advertising, but is publicly owned. We want to make sure that chAnnel 4 has a long term successful future, and for that reason we think it is appropriate to look at the ownership model, and see whether or not it wouldnt thrive better if it was able to access the kinds of investment capital, which the others are able to put into high quality tv content. ChAnnel 4 exists to create change through entertainment. The question is, what might change for viewers if it is sold off . ChAnnel 4 has a specific remit to provide tv that is distinctive, diverse and different not profits. If its going to be an attractive asset to buy, analysts think a lot will have to change. Is the first time that a Police Officer has been convicted of manslaughter during the course of their duty for more than 30 years and it all relates to this Incident Backin and it all relates to this incident back in August 2016, nearly years ago, when Dalian Atkinson, a former Premier League Footballer with ipswich town, Sheffield Wednesday and Aston Villa had been behaving in and Aston Villa had been behaving in a bizarre and erratic fashion. He was suffering from really bad health problems at the time. He was on dialysis, for instance, and on the eve of a hospital appointment, he had driven in the early hours of the morning to his Fathers House in telford, started banging and shouting to be let in, shouting that he was the messiah, and that prompted some neighbours who had woken up to dial 999. Pc monk was one of two officers who answered that call. They try to bring Mr Atkinson under control by tailoring him. Two taser charges were ineffective and then Pc Monk fired the taser for the third time, disabling Dalian Atkinson who fell to the floor. He had pressed the trigger for to the floor. He had pressed the triggerfor 33 to the floor. He had pressed the trigger for 33 seconds. The standard time is five seconds. That was part of the Prosecution Case against him. They said he had acted unlawfully, using unlawful force. They said he had acted unlawfully, using unlawfulforce. The other they said he had acted unlawfully, using unlawful force. The other part of the Prosecution Case is that once he was on the floor, he had kicked Dalian Atkinson with quite severe force of the head twice, so hard in fact that it left the imprint from both boot laces on Dalian Atkinsons head. The russian Defence Ministry said a Border Patrol Boat fired Warning Shots at Hms Defender and that a warplane dropped four high explosive bombs in its path in waters off crimea. In the past hour the Defence Secretary Ben Wallace has issued a statement. Our Defence Correspondentjonathan Beale is on board Hms Defender and sent this update. Loud noise of aircraft and there is, that is another russian aircraft buzzing the warship here in the Black Sea. There have been at times more than 20 aircraft above the warship, and there have been warnings from russian Coast Guard vessels, and indeed we have heard shots fired. We believe they were out of range. Hms defender continued its journey through crimeas Territorial Waters, in other words within 12 miles of crimea. We can see the coast. And it did not deviate from its course, it completed its transit, which took overjust over an hour, and now it is back in international waters, but we are still being, as you can hear, buzzed by russian jets. Throughout this transit, the crew on Hms Defender have been on high alert, on action stations, and at one stage they did put on wet flash to protect their faces, just in case there was going to be an exchange of fire, but they did not think that would happen, and it did not happen. They did hear gunfire, we think, from one of the russian coastguards that was shadowing us. Russian coastguards also tried to make a manoeuvre to make sure that Hms Defender altered course, but Hms Defender continued down that recognised Shipping Lane inside crimean Territorial Waters, within 12 miles of the coast. It is now out into international waters, but russian jets are still buzzing this royal Navy Warship, as we progress now on the next part of the journey towards georgia. People working in the Travel Industry are taking part in a day of protests across the uk, calling for the list of countries deemed safe for tourists to be expanded, and for more support for the sector. The group representing British Airlines has told the government it must act Now Or Never, to save whats left of the Summer Season, and to save jobs. Ministers are expected to update the so called Traffic Light List of destinations tomorrow, but there is concern that the number of countries which dont require quarantine on return will remain low. So extending the Furlough Arrangement for the Travel Sector and looking at a really targeted financial support, a revenue replacement system. There are currently 11 countries on the uks Green List, but most are not open to Uk Tourists to visit. The government has always said that its international Travel Policy is guided by protecting Public Health, and there are concerns about letting in new variants that might be vaccine resistant. The next update to the Green List is expected to be announced tomorrow. So you can see aircraft parked up here, there is a jet2 aircraft. There is ryanair. This is the view of manchester airport. Industry heads are waiting anxiously for news, particularly if quarantine might be removed for fully vaccinated passengers from Amber List countries. That would be a major step forward, and i think it would create the confidence people need to book travel, and travel over the summer. Other countries are doing that, germany, france, and at the moment that doesnt apply in the uk, but it could, and it would open up potential for travel for lots of people over the summer. So i think it is really important, but it needs to happen quickly. The government have said that decisions on Traffic Light allocations take into account a range of factors, including Genomic Sequencing and variants of concern, and that both tailored and wider economic support is still available to the sector, including the Furlough Scheme. Yeah, we have known for years exactly how many European Citizens are living and working here because until recently they had free movement and could come and go more or less as they pleased, we werent counting them, but obviously that has changed post brexit. But the group that was set up to represent the rights of Eu Citizens who was called the 3 Million, which gives you the some idea of the rough numbers people were talking about, but this is the number of applications we have had so far, 5. 6 million by the end of may this year. Now, that includes repeat applications, some which were invalid, some which have been rejected. But even then it is well over 5 Million. In the initial estimate from the government of the number of people who might be eligible for the scheme, which is Eu Nationals, nationals from the eea countries, places like Norway And Iceland and some of their Family Members, was between 3. 5 and 4. 1 million. They have only had more than 5 Million application so it is a far, far greater number. find than 5 Million application so it is a far, far greater number. We know how many people exactly have been approved so far, and i think we can show you a map of local authorities in england and wales. This shows the number of applications for the Settlement Scheme, compared to the estimates of the Eu Population in each local authority. And the darker the colour in those local authorities, the greater the number of applications they have been. So the darkest colour on that map means that 80 or more higher numbers have applied for the eu Settlement Scheme than was the estimate of the Eu Population. So places like leicester, lincoln, parts of west sussex, wolverhampton, and you consume a little break out map of london, several London Boroughs as well. We also know, by and large, which countries most of these applications have come from. This chart shows you probably no surprise at the top, the largest number from poland. We know huge numbers of polish people arrived here after poland joined the eu in 2004. More surprising in second place, romania, whichjoined a few surprising in second place, romania, which joined a few years later. There have been nearly A Million applications up to the end of march, more than 900,000, and yet the estimate of the Eu Population here was about 400,000 romanians. There is 900,000 may not all be here any more, but it is a substantial number. Of course the other thing we dont know is how many people still applied for the scheme. It runs out in about a weeks time but there will be a substantial number, despite all the best efforts of the Home Office and pr campaigns and so forth, who havent applied for a big Government Scheme because that is what always happens, so that is the question going forward. I think we have another chart we can show you, there it is, so the light blue number on that chart are the number of, the net migration of Eu Nationals to this country, using the calculation is with the new method. The old method is in dark blue and you can see just how many more people are estimated to have been here in those years than we used to assume. The irony of course of all of this is, look we are saying, they have been farm you far more people than previously thought, but at the moment the big challenges a lot of them have left. We know that is a trend that started after the Brexit Referendum and has accelerated during the Covid Pandemic, and we know almost every day there are news stories about shortages of hgv drivers, fruit pickers, restaurants having to close at lunchtime, because they dont have enough waiting staff, because these were all jobs have enough waiting staff, because these were alljobs that Eu Nationals were dominant in the many, many years and there are clear shortages. For many parents and pupils, it is back to remote learning, and increasing anxiety about how much more time will be missed in school. I believe the impact is absolutely huge. Now its time for a look at the weather with Darren Bett. Hello, there. It is a much better Day Today across southern and eastern parts. The sun is out and the winds are lighter as well. Towards the northwest, the weather has changed somewhat. We have seen all this cloud spilling in from the atlantic, moving very, very slowly southwards. The cloud is thick enough to bring some pockets of Rain And Drizzle. Mainly around more western areas. To the east of high ground, the skies are brighter, drier and a bit warmer. From the midlands this is where we have the sunnier skies and temperatures of 22 degrees. Through this evening and overnight, this cloud moves very slowly towards the south bringing with it some further light rains and drizzle. Some mistiness over the hills and coasts. It is quite clear across East Anglia. Here it will be quite chilly, i think, overnight. Elsewhere, a warm night underneath all of that cloud. Weve got a pocket of warmer and also more humid air coming down across the uk during tomorrow. That warmer air is in between these two Weather Fronts. This one to the north will bring some wetter weather to the North West. This Weather Front here is producing the light Rain And Drizzle. It will be affecting Northern England and wales in the morning. That will move its way through the midlands. Bringing more cloud. Cooler air is coming into the northwest of scotland, but across northern parts of england and wales, as It Brightens Up through the day, we will get some sunshine. Temperatures could reach 23 or 24c there. The warmest part of the country. Those Weather Fronts continue to run towards the south overnight into friday. It will lower the Pressure And Mess things up, really, towards the end of the week. Lots of cloud around on friday. Some showers, longer spells of rain. It should become drier in scotland. There is a northerly breeze in scotland and it will keep the temperatures pegged back. Highs of around 20 or 21 towards the midlands and eastern parts of england. Into the weekend, we have got higher pressure across the northern half of the uk, so it should be dry, increasing amounts of sunshine as the weekend goes on and temperatures will rise again a bit as well.
