The young people behind the case are the organisers of Australias School Strike 4 climate campaign, which marched in sydney last week. The case in melbourne targeted the planned expansion of a Coal Mine in New South Wales. Butjustice bromberg dismissed an injunction, on the grounds there was not enough evidence. Lets get more from our correspondent shaimaa khalil. Tell us what has happened. The judge essentially said there wasnt enough evidence that the Environment Minister was in breach of Duty Of Care. The eight students and the none, they argued that the Environment Minister had a Duty Of Care towards young people to protect them from the harmful and devastating effects of Climate Change, and allowing the extension of that Coal Mine in New South Wales would be in breach of that Duty Of Care. We had the ruling a few minutes ago and thejudge had the ruling a few minutes ago and the judge said the court was not satisfied that the minister was in breach of the minister was in breach of the care, and that there wasnt enough evidence of that, so he dismissed that injunction. But as you said, this would have been a Landmark Ruling because that would have set a precedent and made it more difficult for more expansions of Coal Mining projects. Of course, coal is a huge resource in australia, the second most valuable export, government estimates of around 30 billion, so that definitely would have got some attention from the government. But as it stands, the Environment Minister is now within her right to grant that expansion. An interesting legal argument, not successful, but where do you think public opinion is in australia . There are Climate Change campaigners that we saw a moment ago, but as you pointed out, coal is such a huge part of the economy. It is a very divisive huge part of the economy. This country is heavily dependent on Fossil Fuels when it comes to its wealth and export, i and all, the conservative government in australia has won successive elections on a platform of supporting the fossil fuel industry. And the climate activists, young people saying whatever investments are put into day, it is putting their Future at risk because of their Future at risk because of the Climate Change effects. A real showdown between a country whose wealth depends on Fossil Fuels and young people saying that that just does fuels and young people saying that thatjust does not bode well for their Future. A Violation Of Human Rights was how the Climate Campaigners described shells ongoing investment in Fossil Fuels. Cheering. The dutch branch of friends of the earth, along with six other groups and more than 17,000 dutch citizens, brought the case to court, arguing that the Oil Giants transition to clean Energy Wasnt going far orfast enough. Thejudge agreed the corporation had to be more ambitious in reducing its Carbon Footprint and delivered a precedent setting verdict. Translation the Court Orders royal dutch shell| to reduce its Co2 Output and those of its suppliers and buyers by The End of 2030 by a net of 45 based on 2019 levels. This is the first time that judges have compelled a company to emit less Carbon Dioxide by changing its policy. This is an historical day. Its for the first time in history that the judge has decided that the large Polluter Royal Dutch shell should stop causing dangerous Climate Change. This will have an enormous impact, not only on shell itself, but on major polluters throughout the netherlands and globally. In response to the judgement, shell acknowledged that urgent action is needed on Climate Change. Translation we are working hard to become a Netzero Energy Company by 2050. Thousands of people in shell. Are working on that every day. Were investing billions in that, and although were moving in the right direction, were being asked to speed this up. Ive been speaking to shell over the last few days, and theyve been telling me they are making efforts.
