Hello and welcome. The epic v apple lawsuit begins today, finally giving the fortnite publisher epic games its day in court. Apple and epic games have been in a legal battle since last year over a 30 levy apple collects on purchases made through its app store. Fortnite was kicked off the app store for dodging that charge by installing its own payment system, which is forbidden under app store rules. From san francisco, James Clayton has more. In august last year epic games did something totally against apples app store rules. It decided that its Hit Game Fortnite should have a new payment option, to try to get around apples 30 charge. Apple probably kicked one of the app store but epic games is ready for the promptly. It stabbed apple with a lawsuit and was even prepared the high production video, a spoof of apples iconic 1984 advert for the apple mac. Apple has reportedly made hundreds of millions of dollars from the fortnite game alone, just in charges, and migratory s argument is if they dont want to pay then where else can they go . s app store and google s google play other dominant global app stores outside of china. If you want to make games for smartphones, pretty much have to play by apple and google s rules. Epic calls that a duopoly and if there was more competition, those fees might be lower. Their argument is a Pretty Simple anti trust one, that no one company should have so much Market Dominance in one centre. And they are not the only ones who think this, a string of high profile politicians from the democrats and republicans in the us have criticised apple for minimalistic behaviour. The eu recently announced anti trust charges against apple for his behaviour on the app store. Apples argument is Pretty Simple. It invented the app store so it should get to charge what it likes. It also says a majority of apps dont pay anything at all to apple. Its reason for charging 30 to some developers, it says it needs to vet and check ups that come onto the app store to protect the apple ecosystem. Apple is taking his court case incredibly seriously. Thats because although it is only one company suing them, if they were to lose it would threaten a Massive Moneyspinnerfor the company. Apple has confirmed that tim cook, its keep executive, will give evidence does make the first time he has ever testified at a trial. It is a clear sign that apple is worried although they say they are confident of winning. The stakes though are incredibly high and apple knows it. James clayton, bbc news. Joining me now is russ frushtick, cofounder of the gaming website polygon. Welcome and thank you for being with us. An Epic Battle Ahead and we heard that word a lot, who could actually win here . I would say, based on the initial court response, thejudgess response, the judgess Statement Last august response, thejudgess Statement Last august when they decided they were going to hear this, it is not looking very good for migratory s case, keeping in mind that epic agreed to apples case, its terms of service, before it decided to hop on their app store several years ago and then decided this was not properfor epic, not then decided this was not proper for epic, not something we want to do, and started kind of pushing the boundaries a little bit. 50 of pushing the boundaries a little bit. The eus Trade Commissioner has told the bbc that waiving the patents on coronavirus vaccines isnt the answer to boosting availability in poorer countries. Countries, including india and south africa, have been pushing for this in wto discussions, but Valdis Dombrovskis told our global trade correspondent Dharshini David why the eu doesnt agree. We welcome the initiative of the new Director General on ensuring availability of vaccines, also for developing countries and for the entire world, and for this, what is really important is that vaccine Production Capacity is being wrapped up as quickly as possible and this is done through Licensing Arrangements between companies which have necessary know how ramping up. And companies also in developing countries which can help speed up Production Capacity. Help speed up Production Capacity help speed up production caaci. . , capacity. At the end of the day, no one is safe against the pandemic unless everyone is safe because otherwise, a virus will continue to spread, the virus will continue to mutate and we will continue to mutate and we will be continuing to deal with these problems. Lets talk about the impact of the pandemic on the cosmetics industry, because beauty brand estee lauder reports its results today. Mariko oi has been looking at this. Welcome. Mariko, i guess the question is not many of us bothered to put on make up during lockdowns . U nless unless you actually on tv i did not, certainly not surprisingly, Lipstick Sales have been down because of the pandemic because as you say why put on lipstick when you are staying at home and even if you are going out, if you are wearing masks, but as you can imagine i make up, especially in this part of the world, has been doing quite well because they are of course the feature most people see these days and the biggest winner has been moisturisers and other Skin Care Products eye make up. As lockdowns are eased in some parts of the world, cosmetic sales this year starting to recover and actually they are expected to outpace the pre pandemic levels this year and china interestingly has been and still is the gross driver for the Global Beauty industry right now, the only difference i guess is that they used to go overseas to buy them whereas now, they buy them at home. It also means a lot of people have more Disposable Income because they have not been travelling. The chinese consumers were also very online savvy if you like, buying products via live streams so that is why there was no major disruption to the trend but we are starting to see a lot of sales coming back in other parts of the world as well. I will be back in Bbc World News shortly. For the rest of you, have a great day. Good morning. Weather across the uk is on the change. Yes, its turning increasingly wet and windy this bank holiday monday, and then thats going to be replaced by a case of sunny spells and blustery showers. And all the time, the temperatures disappointing cold for early may. So the culprit arrives through the night. Its going to bring wet and windy weather in from the west, and that rain is going to continue to track its way steadily eastwards. Now, ahead of it, quite a lot of cloud around so it will be a frost free start to monday something weve not seen for quite some time but the cloud, the wind and the rains on its way, moving out of Northern Ireland into southern scotland, Northern England and parts of wales during the morning, probably not arriving into london and east anglia until the end of the afternoon and maybe not arriving at all in the far north of scotland. Its going to be windy for all gusts widely in excess of 40mph, maybe in excess of 60mph on exposed south west coasts, and thats going to make it feel pretty cool. It may well be one of the coldest Early May Bank holidays on record. Now, that low pressure will drift its way steadily eastwards, still plenty of isobars tucking in behind. The wind directions still coming from a north easterly. Gales on exposed east coasts driving in some showers and the showers turning increasingly wintry to Higher Ground in scotland, Northern England and north wales. Top temperatures by the middle of tuesday afternoon between 6 move out of tuesday into wednesday, weve still got that cold air in place. The isobars are likely to open up, so that could mean we could start off early wednesday with a light frost around something very unusual for the first week of may. So potentially a frosty start, a dry one with some sunshine around for many. Wont be long before we see further showers, particularly across North East Scotland and north east england. West is best for sunshine but not necessarily for warmth we should be seeing temperatures across Southern England of around 16 degrees, at least, at this time of year. Thursday, we keep the risk of some showers going, but friday will be a quieter day, drier and perhaps a little warmer. However, as we head into next weekend, there is another significant low pressure thats likely to push its way in from the south west, bringing yet more wet and windy weather, but it may well turn things a touch milder by the end of the weekend. Good morning, welcome to Breakfast Withjon Kay and louise minchin. Our headlines today. Two Police Officers are injured during a protest by hundreds of Manchester United fans at old trafford. The scenes have been described as completely unacceptable. And with the players eventually able to leave their hotel, were waiting to hear when the match against liverpool will be played.
