Professor, you have been watching these hearings, you are an expert in law. What did you make of the unanimity of the judges, which are not a lot of people were expecting, and also the strength, the power of their judgment expecting, and also the strength, the power of theirjudgment and their words . Unanimity is quite unusual and is generally used when it is decided that it is very important to set a clear message that this is what the law requires, it isa that this is what the law requires, it is a matter of it being a close case or a political disagreement. The fact it was so clear was also incredibly important because sometimes when there is drafting by committee you end up watering the judgment down and focusing on some comment to nominate a position. That wasnt the case here, it was clear, unequivocal and extreme harsh for the government. It was stunning, people were. Jaws were dropping when they heard thatjudgment. Somebody called it a legal earthquake. Let me read again, because it is the most devastating paragraph in the entirejudgment. If there is anything more weathering that has been written by a judge in recent yea rs, that has been written by a judge in recent years, i would like to read it. Paragraph 61 rates, it is impossible for us to conclude on the evidence put before us that there was any reason, let alone a good reason, to advise her majesty to Prorogue Parliament for five weeks. What they are saying is that this was government advice given by the Prime Minister of the United Kingdom to the moniker of the United Kingdom, done without any discernible reason whatsoever. All of this is painfulfor Boris Johnson, but that is particularly stinging. We know there will be political consequences for the government. What does this do in broader terms for our unwritten constitution and our balance of powers between parliament and the government and the courts . powers between parliament and the government and the courts . I think it is part of a series of cases in the last ten years which show the court emerging asa the last ten years which show the court emerging as a real constitutional player, is one that is not afraid to say what it thinks the law is that apply in many of the great areas of the constitution. They were often filled in by executive action, by government, which tends to dominate parliament in the westminster tradition, the courts have traditionally shown a lot of deference for that, but now theyre ta ken lot of deference for that, but now theyre taken the rule of law more seriously, they believe it is part of their role to uphold the law. That has dragged the courts into the area of political decision making. It goes quite far in that direction, and many people feel if that is what they are going to do, they should be elected and accountable, we should know what their opinions are. What do you thing about that . We have had tabloid papers accusing judges of being enemies of the people. Was this a Bold Decision for these 11 Supreme Court justices . this a Bold Decision for these 11 Supreme Courtjustices . I think it was bold in some ways, but the fact there was unanimity and the fact the decision was so clear is evidence that they were absolutely convinced on merit that the law requires the prime and a step decision to be regarded as unlawful. That is a view shared by many scholars and in particular many barristers at the bar. Well this means that the judiciary will come under greater scrutiny . I think a leg will become an unmitigated disaster, as it is in other countries was up there is some pressure to have confirmation style hearings in parliament. That will be resisted. The executive has its rights, some of which are in the crown prerogative, and the courts are there to ensure we have the rule of law. Not the role ofjudges, but the rule of law. That is to ensure that laws are applied. I am all for parliamentary sovereignty, but it must be properly understood as parliament upholding the law, or making the law. Parliament making the law. We are in a position where unconstitutional acts of parliament have been passed by unconstitutional means, and that was possible because the government has lost control of the government has lost control of the house of commons. It is really unprecedented that they should have happened without a general election, thatis happened without a general election, that is why we need a general election. We are an unconstitutional, in uncharted territory. They are not rolling over, they are pushing back on this to say they will attempt find ways of getting around it. What is not clear is how people engineer that queens speech because normally it comes shortly after parliament has been prorogued and a new session has begun. There is still uncertainty about that. On the whole, they are keeping a diplomatic distance was top this is a domestic issue but in the last few minutes we have seen a tweet from the European Parliament president , saying this is an important decision from the uk Supreme Court to rule on the ten won of parliament as unlawful. Any Brexit Agreement needs to be approved by both the uk and eu parliaments, so proper democratic scrutiny on both sides of the channel is essential, he said. Should he hang on in there . I think yes, because there we have to go through the rigmarole of getting somebody else to do a job that nobody seems to want to do. He has to get on with it. I want to talk to debbie first. There is a collective frustration for a significant majority in this area. Are you beginning to despair from your side of things that what you wa nted your side of things that what you wanted to happen is actually going to happen . I dont think it will happen. It is all smoke and mirrors. I think they asked us a question they did not want the answer to, they did not want the answer to, they got the answer they did not wa nt they got the answer they did not want and now they are playing the long game and hoping that people get fed up and call an end to it. When i talk to people about the latest experiences of brexit, they say, want to leave, we need to leave now, even those who voted to remain, they say, we just need it done, we need to move forward. A lot of them are saying, look how we look to the outside world. Stoke on trent voted to leave, and they say that was the view around here, so that is what they want to happen. So that is exacting what i am hearing. I think this is what we will expect to hear for the next few weeks at least until something is done. So that collective sigh is pretty accurate . Absolutely. I spoke to someone in the shopping centre, a remain supporter, who said lets have another vote. I dont hear that view that often. That is another view that often. That is another view that comes from this area of staffordshire. A whole other stone i will not turnover. Thank you all very much indeed. That is the collective view at the moment from stoke. What difference do you think this turmoil, this constitutional turmoil we are seeing, what difference will that make to the electorate . They will not wish to lose an advantage. What is also true, as far as the public is also true, as far as the public is concerned, attitudes towards this prorogation was all ready controversial, it was controversial in the sense that remain supporters opposed it. Leave the supporters tended to support it. How do those voters react . They may well say, this is the establishment ganging up on borisjohnson. This is the establishment ganging up on Boris Johnson. The nagging doubt perhaps in the Prime Ministers mind is, well some of those voters who we re is, well some of those voters who were supporting the brexit party two or three months ago, now they are saying they would vote conservative, do they say, i am not quite sure this Prime Minister is capable of delivering brexit . It clearly will mean that the government will be held to account. We can anticipate that parliament will be pressing for further detail about exactly how well the talks are going, what the government is proposing and so on. The crucial question is whether or not the circle remained alliance can cohere in order to pass further legislation or to adopt other moves. There of various possibilities. One is that it could try to legislate, to take october 31 out as the default date for leaving the European Union stop that would certainly change the position. They could perhaps think about trying to legislate for holding a referendum before any deal is passed, and they could in theory at least try to see whether or not amongst them they can come up to an alternative government which would mean they would be in a position to bring the government down without precipitating an election. The trouble is, we know that while this remain alliance was clear on what it was opposed to, no deal brexit, it is not clear that they can cohere around any of these alternatives and therefore whether or not this will make things much more difficult for the Prime Minister. That is uncertain. It will depend on whether this alliance can agree on other things that it wants to do to ove rco m e things that it wants to do to overcome some of the internal divisions. Going back to the original decision by downing street to advise the queen to suspend parliament, was that a strategic mistake . Dominic cummings, people are saying, is responsible for that and it was a huge mistake . M are saying, is responsible for that and it was a huge mistake . It is perfectly clear that, in the end, this proved to be a politically and tactically a mistake. It helped provide the impetus whereby the house of commons thought it only had days to do anything about avoiding a no deal brexit, passed legislation it might otherwise not have passed until next month at least. Now it is left when a situation where the Prime Minister is, at minimum, seriously embarrassed by the decision of the court and i think we also have to ask ourselves to what extent also have to ask ourselves to what exte nt d oes also have to ask ourselves to what extent does this begin to mean that some tory mp5 say to themselves, is this Prime Minister actually someone whosejudgment i this Prime Minister actually someone whose judgment i can trust . And whether, if those seeds of doubt are sown, whether that might make it more difficult for the Prime Minister to sell whatever deal, if any, he brings to his party from the European Union. Well, the queen is still in residence at balmoral we just heard questions as to whether the Prime Minister had embarrassed the queen. We can cross there now and speak to our correspondent, rachel bell. It has been such a busy few weeks, a lot of political twist and turns and so it seems quite apt that were back here, at balmoral, where this saga all started. This, obviously being the queens holiday home. She has been here sincejuly over the summer. It has been nearly a month since members of the privy council made the journey from london here, to advise the queen on behalf of the Prime Minister, to Prorogue Parliament. That meeting only lasted 30 minutes or so and was rather short. But that meeting set off this Chain Reaction of events which we have been seeing unfold over the past few weeks and culminating in this decision by the Supreme Court today in which they said that advice given by the queen and the prorogation were unlawful. The judges said today, it is impossible for us to conclude on the evidence that there was any reason, let alone a good reason, to advise her majesty to Prorogue Parliament for five weeks. Now, the palace has yet to comment on the ruling but it is safe to say that the Summer Holiday for the queen has not been the easiest. Last week, we had a revelation from former Prime Minister, david cameron, that he had asked for the queens help before the Scottish Independence referendum. Kind of breaking that unwritten rule that discussions between the monarch and the Prime Minister are private and should remain private. And today we have this momentous decision by the Supreme Court that says the advice given to her by her own Prime Minister and privy council was unlawful. The queen, as you say, is in residence so the castle is a few hundred yards from the gate you can see behind me. We are hundreds of miles from parliament but yet, on the Summer Holiday, the queen has somehow managed, whether or not she likes it, to be embroiled in this constitutional row. The likes of which, she really hasnt seen in her 67 year reign. You very much indeed. Iamjoined i am joined here outside parliament where the heavens are have opened. Were just hearing about the queen. How difficult do you think this has been for the palace . This whole question of the advice to the queen and then her ultimately making the decision to prorogue, well, not making the decision, but she has to follow the advice she is given by independent Prime Minister. The court has found that the effect of her order is effectively the same as a blank piece of paper. It was not an void 50 i cant imagine that, deep down, the queen or the palace will be impressed by the way they have been advised and embroiled in all of this. But of course, as a strict legal matter, it doesnt really impugn the queen in anyway. So really impugn the queen in anyway. 50 her silent role in the constitution will carry on as normal. Allison, talk to us about judgment, because although there we re judgment, because although there were lots of permutations about what you and other experts thought, no one expected it to be as strongly worded or unanimous as it was. 11 0 . That is absolutely clear, no one thought all 11 wood group around this. A lot of us were not sure what the remedy would be. This is beyond the remedy would be. This is beyond the scope of the prerogative powers. Not only is that void, but it means parliament was never prorogue. None of us expected it to be quite as strong. Jeremy, do you go along with that . No one saw this coming . strong. Jeremy, do you go along with that . No one saw this coming . I do. The Divisional Court where we had a master of the laws, and the president of the queens bench decision, three really senior justices seeing this was not a matter for the courts, notjust a civil, the Supreme Court has overturned that. We saw the government might have been in trouble because the justices were keen to get into the facts of what was going on and to look at the effects on parliamentary sovereignty. I dont think anyone thought this would be unanimous and no one quite expected the extent of this new constitutional principle. That the court would move towards, which is that the court will now step in where parliamentary sovereignty has been undermined, the court sees it as its role to curve the prerogative power. Extraordinary stuff. The Supreme Court is quite young and here it is asserting itself, would you say . It is, but it is also important to recognise that it is trying to assert itself in a justifiable way. Drawing on legal principles. Saying we have these fundamental constitutional principles, protecting representative democracy, and the role of parliament. It is stepping into say these are the legal limits, this is a job, if you had a reasonable justification, we would have looked at the facts and evaluated it, but you had no reasonable justification here for breaching these constitutional principles. That reasonable justification is so important because it comes back to the absence of the witness statement signed by a statement of truth from a member of the government, saying why they were doing this. The justices the government, saying why they were doing this. Thejustices were very keen to emphasise that. Thank you both as ever for being with us. More political reaction now,. So, what happens next . Tomorrow will be a huge day in parliament when mp5 gather at 11 30am. Will Boris Johnson be there . Not if what he says at the moment still holds, which seems to be able carry on business as usual. But what might his opponents to . I am joined by ian blackford. This is a Prime Minister with no authority. Let us reflect on what has happened since he came to power. He has lost every vote he has put forward, parliament has barely sat, he has lost his majority in the house of commons and he has been absolutely humiliated in the courts today, this was a stunning decision, telling the Prime Minister in no uncertain terms, he has acted out with his power. He has acted in a way which is unlawful, frankly when you look at the behaviour and the performance of this Prime Minister, he ought to do the right thing. We know, in new york there was no hint of resignation, so my question is what do the opposition parties do . am the no very clear to all the other opposition parties i am making it very clear, that if boris doesnt do the right thing, this is a man who has shown he will stop at nothing, and is threatening to ignore an act of parliament that states we will not leave on a no deal basis from the eu. The opposition will have to come together and were going to have to force a vote of no confidence. We cannot tolerate that this man who is behaving in an undemocratic manner, behaving in an undemocratic manner, behaving a dictator, has to be removed from office and the opposition has to come together, the opposition has to come together, the opposition has to do itsjob. We need to remove him and we need to do that through a motion of no confidence, leading to a general election. To be clear, when would you table that . Because, obviously, from labours point of they would regard it as advantageous to them to delay that until after october 31 when mrjohnson will have failed to meet his do or die pledge. You are suggesting you cannot wait until then . Parliament has come together, and we need to be careful that that can be enacted so we need to take the necessary steps to do that. Once we are satisfied that is the case, then we need to have that motion of no confidence. But it has to come quickly, we have to seize the moment, we cannot leave him in office, he has to be removed. The opposition parties have to accept responsibility. Let me say to the other is that in scotland, we are ready for this. I want the opportunity to put ourselves in front of the electorate. We will ta ke front of the electorate. We will take the fight to our opponents in scotland. And i am confident the snp will increase representation. We will increase representation. We will do everjobs to bring this government to the end. The other parties have to do the same in the opposition. So from where you are sitting, you would like a motion of no confidence within days . As soon as is practically possible. Went back so what do you cite a Jeremy Corbyn who says that is all fine, but it is more advantageous, electorally to us, to wait until after october 31 . You have a situation where a Prime Minister has acted in a manner which is unlawful. It does not command a majority of the house, has lost every vote, we have got to accept our responsibility as waiting is not the answer. We have to seize the moment. And in the meantime, tomorrow, wednesday, parliament is back, no Prime Minister is questioned, no borisjohnson, maydaywhat do what do you do . What are you going to do . There is plenty we can do. We need to make sure that the legislation we have enacted is robust, so there may be things we can do around that. There are questions we can bring tomorrow. We have to hold this government to account as you thought it reasonable to act in an unlawful manner and shut parliament down. There is many things we can do. We need to discuss the situation regarding thomas cook, the fact that 90,000 people are losing jobs, people may need to be brought home from the 9000 people. People may need to be brought home from the 9000 people. What do you make of borisjohnsons suggestion that he needs a queens speech . Is that he needs a queens speech . Is that possible .
