Next this morning, were speaking to a mum of two who was wrongly diagnosed with Breast Cancer. 28 year old sarah boyle was put through chemotherapy, which saw her lose most of her hair, and then underwent a bilateral mastectomy the surgical removal of both breasts. Doctors only realised their error, and that she didnt have cancer, several months later injuly 2017, by which point the damage was already done. We can speak now to sarah boyle shes here with her eight month old son louis, and sarah sharples, her lawyer, with irwin mitchell. Thank you both very much forjoining us. Sarah, it is unimaginable what you have been through, to have gone through the trauma of the diagnosis, the surgery and then to discover you never had Breast Cancer. How have you been coping with that . never had Breast Cancer. How have you been coping with that . I am very much still in the whole process of grief, anger, fear, sadness. At the moment there is not a way of coping, it is just taking each day and battling whichever emotion has been thrown at me. Of course. Was there a sense when you find out that you don this rather never have known . actually said that, i would have much preferred them to say you have done it, well done, all those months of treatment, it would have been worth it. Because now you are faced with dealing with the frustration and the anger. Take us back to how the diagnosis came about. What happened . I was feeding tettey, he was six months old and he was great, he naturally just was six months old and he was great, he naturallyjust latched on. I was feeding fares. It was fantastic. When he was about six months old he just stopped feeding on one side and became really distressed, i had known about the slump and i thought i would get it checked. For some time you had had a lump but you had been told again and again it has nothing to worry about. And it would fluctuate with hormones and sides, andi fluctuate with hormones and sides, and i got it checked out. He is going to fall asleep i was fast tracked and it all happened really quickly. It went from there, really. I had eight cycles, one every three weeks, and the month following, when my blood had recovered again, i had my bilateral mistake to me. I was diagnosed in november 2016 and i had my treatment finished on the 23rd of may to thousand 17. When did you then discover you havent had the cancer . It was a follow up check. It all led up to today, really. Its and bits and bits. Moore has been emerging. So with the initial checkup you were told, great news. You have beaten cancer, you are told, great news. You have beaten cancer, you are in told, great news. You have beaten cancer, you are in the clear. No, i was called in. We found no cancer. Theres been a terrible mistake. Was called in. Yeah, so, its like, since then, ive been told im dealing with post Traumatic Stress disorder s0 with post Traumatic Stress disorder so one with post Traumatic Stress disorder so one of the main things is brain just doesnt understand that situation. Hits ok. Its ok, thats fine, thank you very much. So where you are now then. Nothing can put right what youve been through and youre continuing to go through. Mentally, i still cant get my head around it. I lie there at night time and all ofa around it. I lie there at night time and all of a sudden, i get that wave of fear, thinking, is it going to come back . But then im reminded that nothing is going to come back because you dont have it but for all that time, when you are told you have cancer, and you are having your treatment and you are feeling ill and youre not with your children, your hair is falling out in the bath, all those traumatic things. You cant raise that. Thats something that will be for the rest of my life, especially when i look in the mirrorand of my life, especially when i look in the mirror and i see my scars. Do you have plenty of support through this . What is getting you through . Im in no mans land. One of the main things that actually i was saying to your researchers, there is no support after cancer. Ive been referred to a cancer site quality tea m referred to a cancer Site Quality Team but its not cancer psychology that i need. You are in may be not a com pletely that i need. You are in may be not a completely unique situation but i imagine ina completely unique situation but i imagine in a tiny group of people. Really, this is what im hoping, that someone comes to me, contact me and says i can help you. Because theyve been through it . Because at theyve been through it . Because at the minute i dont have anybody, theres nobody i can talk to and i dont want to talk to a Breast Cancer psychologist because i dont have Breast Cancer, i dont need to accept anything. But she is great. Of course and what youre saying is, you are with something that is beyond the realm of what most people have experienced and you want to find someone that can understand that. And i think a lot of people find that husbands and partners, so lonely, my husband has contacted several people and said, i need help and support and they said, our duty is not to care for you. Our duty of ca re is not to care for you. Our duty of care is not to you, stephen, its to your wife and so his thinking, who is there for me, what do i do . So he gets the generic, we will refer you to this, and its like, i need support. And nobody can be there for him, its no mans land. Support. And nobody can be there for him, its no mans land. I really hope you find that support that you need and thank you for coming in, thank you very much, your boy is gorgeous. If youre a victim of a crime the police can ask you to hand in your phone so they can examine it for evidence. Now campaigners are calling on the police to urgently revise the policy saying what they call digital strip searches can infringe victims right to privacy and are causing major delays to investigations. The report by big brother watch says cases are even being dropped because victims dont want to share their phones with the police. But the National Police Chiefs Council says officers have a duty to pursue all reasonable lines of enquiry. At the end of 2017, we brought you an interview with liam allan. He was falsely accused of rape and only cleared when messages downloaded from his alleged victims phone revealed how she had pestered him for casual sex. You cant really stop false accusations, people have a spiteful side and when people are hurt they react in a way you dont really expect and so we rely on the procedure to find the right sort of things and as far as im aware, if ive been through it, not the only one, just because im the one in the media right now it doesnt mean im the only one hes been through it. Said it so many times can what university supposed be the best time of your life, the last two years ive spent worrying are not concentrating on anything, has com pletely concentrating on anything, has completely ripped apart my normal, personal life and now its come to light, its still going on and the longer we have to wait in terms of going through things like that, the more stress it still is because im still away from university and my normal life so my life is upside down, and not a standing trial anymore but theres still the emotional stress of that. We can speak now to courtney not her real name. She says she was a victim of a serious and violent Sexual Assault but after a two year investigation, she says the Police Investigation was dropped after she refused to hand over her phone. Joy merriam is a solicitor advocate from gwbharthills and member of the law society and silkie carlo director of Campaign Group big brother watch. Welcome all of you and thank you for joining us. Courtney, in october 2016 you were subjected to what you say is a serious, very violent Sexual Assault. No, this happened a few years previously, like many victims i chose to period because it was just too hard at that time. I chose to bury it. But the feelings started to fester and i thought the best way to take power back was to go to police and report the crime and stop him from hurting anyone again. I wanted to look him in the face ina again. I wanted to look him in the face in a courtroom and i wanted to humiliate him the way he humiliated me and took away his freedom the way he took away mine. But i look back at that now and think thats very naive and i consider it to be one of the biggest mistakes of my life because of how the investigation affected me psychologically. From the assaults, imean, it psychologically. From the assaults, i mean, it was certainly bad and my attacker was sadistic. I was dealing with that ok. I was functioning. I really fell a pa rt with that ok. I was functioning. I really fell apart as the investigation progressed. A therapist has said or blames the way therapist has said or blames the way the investigation was handled, particularly with these requests for a very personal information including things like counselling notes and mobile phone data. And also just how long the investigation took and the stresses of it for what put me into a very deep depression. Soi put me into a very deep depression. So ijust put me into a very deep depression. So i just want to come put me into a very deep depression. So ijust want to come in there. You said about the counselling notes. Counselling is supposed to be concept confidential and i gather you were told it would be at the start but then you are told police wa nted start but then you are told Police Wanted the notes so took take us through what police are asking for, but the lawyers were asking for and how that impacted you. At the very beginning when i reported the assault in 2016 the police suggested i should go to counselling. I thought that wasnt a bad idea even thought that wasnt a bad idea even though i felt generally ok. They sent me to a charity in london. We initially had a phone consultation, she assured me it would be totally confidential, then we had a meeting where she said it would be confidential and at the end of the meeting she puts on forms in front of me saying i agree my counselling notes can be given to the police. I absolutely did not want to sign that because i failed to get the true benefit of counselling things need to be private between you and your therapist and of course, understanding the law, some of these things could be given to my attacker as part of disclosure. One of the things i talked about with my counsellor was the thing that id had an eating disorder 15 years previously which was totally result, ive seen cases where that is used, an eating disorder is used to discredit a claimant because they say she is unreliable. And there are certainly other things i needed to discuss and counselling that definitely could be given to my attacker as part of disclosure and thatis attacker as part of disclosure and that is an incredibly disturbing prospect for me because he did what he did to me because of power. And if he gets to see how he hurt me he will get off on that power. And that is. Will get off on that power. And that is. Absolutely will get off on that power. And that is absolutely impossible position to be put in. Several months later the police did in fact request my counselling notes. That basically gave me almost a mental breakdown. And later, access to facebook was requested. And your phone, that was the point at which the investigation was dropped. And i just want to pick up, sorry, on what you said, saying you feel now that you said, saying you feel now that you are very naive when you had the view that you had of what would happen once he pursued a prosecution which was coming sometime after the attack itself. Does that mean you wish youd never pursued a prosecution . Its really hard because right now im campaigning on behalf of victims, im posing a legal challenge to the government to overturn these laws and so i feel i am ina overturn these laws and so i feel i am in a position that its just who iam right am in a position that its just who i am right now, im able to do this and makea i am right now, im able to do this and make a difference in our country. So in that sense i dont regret it but this took away two yea rs of regret it but this took away two years of my life, i was suffering from such extreme anxiety that i began displaying dangerous and addictive behaviour. I was having panic attacks for i had to go on medication. That is not safe to take. My boyfriend once called Emergency Services because he thought i was at risk for suicide, i wouldnt have committed suicide but imean, it wouldnt have committed suicide but i mean, it was that dark of a place. And i lost two years of my life and i regret that. I dont think it has to be like that in this country. Lets bring enjoy. You always act as defence for the accused in legal cases that you get involved with in this area. And we heard obviously from liam and how accessing the phone records were vital in that case. When you hearfrom courtney and the impact of disclosure on her and the impact of disclosure on her and presumably others like her and that meaning that ultimately cases havent ended up in court, how do you feel about that . I think its a question of checks and balances in every case. Youve got to balance the rights of the accused against the rights of the accused against the rights of the accused against the rights of the complainant and their right to privacy and there are various stages of the police have to go through. I mean i cant comment on the individual facts of her case but certainly they are not supposed to request such items as phone records or medical records unless they feel that they would be evidential in the case they are pursuing a reasonable line of inquiry. But to someone who is saying that something has happened, they are making allegations, it kind of doesnt matter what the justification is and obviously youre talking about your needs to be an evidentialjustification for requiring it, it would still have the same impact, wouldnt it, and anyone who is having to hand that over . It depends what they are being asked to hand over. If youre being asked to hand over. If youre being asked to hand over. If youre being asked to hand over your phone for your social media records to be looked at, if you are confident there is nothing on there thats going to weaken your case in any way i dont see what your problem is in handing it over. Ok, ill ask courtney to respond to that point. have a major problem with that because as a victim of rape, there is no other victim of any crime when you are raped over in such personal ways, the information that is on your phone is going to be, will be used can be used, could be prejudicial and irrelevant. Even in the case of liam, i was watching that case id prefer, i dont know if you are going, if we dont get into other cases, its properly simplest. There are cases, a victim of sexual history, her fantasies, her new relationships, videos of her having sex with new partners have been used. If my attacker gets to see that i would be so devastated i would be at severe risk of self harm. The police say the risk of disclosure is low, i would say even just the thought that it could be filled me with absolute fear, i have ptsd, my brain doesnt work the same way as yours and this policy, therefore, means that so many less victims are going to come forward and that rapists can operate with impunity. Joy, does that worry you, that victims may not come forward . It does when this information is publicly put out, because what has been described by courtney would not happen, there are strict rules about previous and subsequent Sexual Conduct and we have to have confidence injudiciary conduct and we have to have confidence in judiciary to conduct and we have to have confidence injudiciary to robustly e nforce confidence injudiciary to robustly enforce those rules. If something is irrelevant as she is referred to it then of course it will be disclosed. But things are relevant, are a matter of fact. I was with a taxi driver and the guy said if you are wearing a short skirt that could be, you know, you could be asking for rape, there a perception about what is relevant when it comes to being a victim, theres perceptions about how a victim should behave, during after the assault that arent releva nt to after the assault that arent relevant to the crime committed and that will be used in many cases to discredit a victim stop im sorry. We havent heard from silky yet, big brother watch, you want change, tell us. I wouldnt be here if there wasnt a massive failure in our Justice System thats affecting lots of people, even this morning we are getting more e mails from people whod been directly affected byjust this issue. The problem is at the moment victims arent able to give specific pieces of evidence to the police without feeling as though theirentire police without feeling as though their entire private lives are going to be put on trial. When you think about the sheer amount of information thats on all of our phones, messages, e mails, social media accounts, photos, videos, more information is being taken in police downloads than would even be taken ina downloads than would even be taken in a Police Property rate and we are seeing, as in this case, people are being forced to choose between privacy and justice and its really shocking and despicable that this policy hasnt been changed only because the longer this continues the more people arent able to get justice and there are dangerous people that could reoffend. We recognise the concerns of some privacy and victims groups and had been seeking advice from a wide range of groups to help us improve the process. At least 1,000 babies in the uk are being put at risk each year because the uks newborn Screening Programme lags behind other countries thats according to the charity Genetic Alliance uk. The nhs carries out nine tests on newborn babies that compares to 43 in italy and 57 in the united states. The charity says this means a whole range of conditions are not picked up in the uk leading to babies developing life changing conditions or even dying unnecessarily. We can speak now to sara hunt, whose son died from a rare genetic disease called ald. Its an illness that affects the brain, destroying the protective sheath that surrounds the brains neurons the nerve cells that allow us to think and to control our muscles. Early diagnosis means that it can be com pletely early diagnosis means that it can be completely treated. Jayne spink is ceo of Genetic Alliance, calling for more comprehensive genetic testing of newborn babies and paediatrician dr liz bragg. Welcome all of you and thank you for joining us. Ald, is something that most of us wouldnt know about, its extremely rare, sadly your first son had it and sadly died at the age of 19. Tell us what happened. You didnt have a clue that it was a genetic issue until it was too late. Absolutely, he was born in 1993. Very unremarkable childhood, achieved all his key milestones, very happy, loving little boy. Just after his little brother was born his behaviour started to change which we put down to attention seeking. And then at school they started to notice that he wasnt hearing properly, he wasnt looking at the board properly and squinting. And we had some tests and they all came back as negative. It soon became very clear that there was something going wrong with his brain, his cognitive skills were lacking, he was walking into walls, dropping things, being very clumsy, not understanding what he was being told. And after about a nine month diagnostic odyssey i suppose, we finally got a diagnosis of ald. We we re finally got a diagnosis of ald. We were told there was nothing that could be done. Just to go home, he probably had a couple of years to live, within a few months of that hed lost all his abilities, he was ina hed lost all his abilities, he was in a wheelchair, tube fed, blind, unable to speak to us, couldnt even smile in the end. And he lived like that for 12 long years and eventually died when he was 19. That for 12 long years and eventually died when he was 19m must have been just awful for you as afamily to must have been just awful for you as a family to go through it. Then come up a family to go through it. Then come up with your second son, aidan, you discovered because you knew about the disease, that he had it but it was very the disease, that he had it but it was very different because it was diagnosed early and he was treated. And thats the important factor, isnt it . For you. You want Genetic Screening so there can be early diagnosis because aidan is 19 and absolutely fine. Absolutely, absolutely. Once alex was diagnosed they immediately tested aidan who was only a year old at the time, fortu nately. Was only a year old at the time, fortunately. And he was put on a Monitoring Programme and it was discovered he had ald as well and then when he was seven, it showed up ona then when he was seven, it showed up on a routine brain scan that he was getting signs of ald and he had a bone Marrow Transplant and he is now at university. You are from the Genetic Alliance. You think this sort of testing should be routine, at the moment we are actually pretty much bottom of the table in comparison with other countries in terms of what is screened for in the days after a baby is born. Sarahs experience is heartbreaking. And to know that had ald been included in a national Screening Programme it would have been possible for both sara s boys to receive treatment and it underlines why we are so keen to see this issue properly examined. In the uk we screen for only nine conditions for as you said, in the re st of conditions for as you said, in the rest of europe, the average number screen rest of europe, the average number screen for its 22. And that means there are children born with conditions that could be treated, very effectively, if picked up early enough. Who become ill before investigations begin. And that means their outcomes are very much worse and it also means that families dont have access to information, support, Supportive Care for their child and choices which they should. Doctor liz, any new parent, anyone who has had children knows about the heel prick test and why its done and mercifully for most people it happens and they forget all about but is it a no brainer to extend the number of illnesses that heel prick testis number of illnesses that heel prick test is used for screening for . Can ijust say, im very sorry for your loss, sara. In the first place. And yes, it would be a no brainer to increase the number of tests that we do, however, in recent years, there has been quite a rapid advance in the Technology Used and the genome mapping and that seems to have got ahead of the rest of the process of looking at different kinds of screening and i know some countries in europe for example, italy, only tested for three conditions up until 2016. When they extended the number of conditions that they looked for. Sol of conditions that they looked for. So i think we all would like to extend the number of conditions we look at but there are difficulties with making sure that all of the processes are in place because its notjust processes are in place because its not just about having the test. Youve also got to make sure that youve got people there to council for a positive result. Youve also got to make sure that weve got some way of treating or making it better, you know, even if we cant, some of these conditions we cant heal them but we cant make lives better. understand what youre saying.
