An independent report has severely criticised oxfam for the way it dealt with allegations of serious Sexual Misconduct by its staff, saying it ignored warnings and had a culture of tolerating poor behaviour. The Charity Commission has issued an official warning to oxfam after investigating reports that aid workers sent to help after the earthquake in haiti had used prostitutes. The revelations led to thousands of people cancelling their donations to the charity and the resignation of its chief executive. Oxfam gb has responded to the report saying it is deeply sorry for its failure to prevent sexual abuse by its former staff in haiti. The charity said the report would be a spur to greater improvement. Naomi grimley is in central london. How damaging is this report to the charity . It pulls no punches. It pulls no punches. It certainly doesnt. This is the report, and it is incredibly damning. It makes terrible reading for oxfam. It talks about how the charity lost sight of its values. It says there were early warnings and tip offs that things were not right in haiti, that sexual abuse was happening and yet those warnings we re happening and yet those warnings were ignored by Senior Management. It also says that when the charity discovered what went on, it was not frank and did not give a full account to the Charity Commission, to the uk authorities or to the haitian authorities. In a minute, we will hear more about what oxfam are saying. But first lets look back on the scandal that tainted a much loved national brand. The charity dismissed four member is of staff and let three quietly resign without properly flagging up what had happened to either the haitian authorities or to regulators in the uk. More broadly, because what we have done is looking to 0xfa m what we have done is looking to oxfam broadly, is that everyone feels very let down by oxfam. It is one of our best known charities in the united kingdom, it is there to put people first, and it failed to live up to peoples expectations. This was the man who caused the charity the most embarrassment, the director for haiti at the time. He resigned before an internal investigation was completed and then went on to work for other charities without them knowing about his background. The report says early warnings were missed. Even after the haiti incident, the charity repeatedly failed to do proper safeguarding checks, including on its uk staff. Whistle blowers like helen evans, a former head of safeguarding, was simply ignored. Aid agencies, a fundamental principle is do no harm. What good are they if they deliver sexual expectation . We hope this is the wake up call that expectation . We hope this is the wa ke up call that sector expectation . We hope this is the wake up call that sector needs. There are a lot of promises, but we need to see action and change. That ta ke need to see action and change. That take many years. 0xfa m take many years. Oxfam has paid a heavy price for this scandal. It lost 7000 donors who cancelled their subgroups and is in disgust, and it still cant bid for government contracts was up the charity is expected to give their response later. So what is the charity trying to do now . It has appointed a new director of safeguarding, has a new chief executive, and it says it has dismissed 79 individuals in the last year, so it is trying to rehabilitate its reputation. Thank you. With us now is helen evans, who was oxfams global head of safeguarding until she resigned in 2015. Good to see you here. I think we need to pick up on what naomi was talking about there. In terms of the things that were going on, when we you first aware that all was not right, and what were you aware of . was appointed to head of safeguarding in 2012 and early on i was aware that this was not one of insta nces, was aware that this was not one of instances, that this issue was more pervasive across the organisation. I took to the Senior Management and trustees into thousand 1a, i had been raising concerns before that, but went to bed with an internal report which surveyed 120 people and 10 said they witnessed or experienced Sexual Assault perpetrated by oxfam workers. At that point, i said, we desperately need more resources to tackle this issue. That was not forthcoming and in 2015i issue. That was not forthcoming and in 20151 resigned. The word prostitution has been used was that her to save that that was going on . No, this was coercing survivors of that earthquake into sex for money asa that earthquake into sex for money as a matter of survival. That is not consent, when you are having sex just to survive. I think we have to be clear about the position of power that these workers were in, and the extent to which they exploited these vulnerable women, children and men. 0ne vulnerable women, children and men. One of the main issues is the way they were allowed pretty much to get on with their lives. With the minimum of censure. Absolutely, that has come out of this report. Some of these individuals were able to go onto the next aid agency and therefore were at risk of committing more abuses, which should not have been the case was top it also raises the prospect that this is not something confined to one particular charity, oxfam, it is an indication that it charity, oxfam, it is an indication thatitis charity, oxfam, it is an indication that it is endemic throughout the charity sector. Do you have any evidence to support those claims . That was the conclusion of a report. That was the conclusion of a report. That was the conclusion of a report. That was my experience as well, it was part of a Global Task Force working with un agencies and aid sector agencies, and we shared those same concerns. As i have had said publicly before, disappointingly i had a meeting planned with the Leadership Team and are now before the meeting i was told i was no needed. I wrote to him and said, why has my opportunity to present on this report been pulled . They said, we didnt feel you could add anything further stop they already knew, you think . They had the report and i didnt get an opportunity to speak to that. At that point, i wrote to the chief executive, why have you pulled me from that meeting . That was really the Tipping Point at which i thought, how can i continue working with this organisation when they are not taking this seriously . How did they respond when they when you said you were going mug they committed to having a review. The thing that surprised me when i was briefed on the Charity Commission report, that Strategic Review didnt ta ke report, that Strategic Review didnt take place in 2015. The minimum they promised, to conduct that review, and they didnt. If they had, they might be further along that they are 110w. Might be further along that they are now. It is inevitable that we are looking at the report pot conclusion, looking at the wider impact on the charity and wider charities. But the risk of that is you lose sight of the real harm that has been done here. Absolutely. At the heart of this, there are children, women and men who have been abused who we didnt do enough to protect. That is absolutely the fundamental human principle is, do no harm and home is been done. We have to make sure we are not here again for stopping 2002 we had the same issue in the west african food with sex scandal. Here we are again in 2019. We have to make sure we are not here again in ten or 15 years was it is a global issue with foreign aid workers was up other regulators in existence that can deal with this, or do we need something international, with teeth . You have hit the nail on the head. We need a global aid ombudsman. It is an international issue. These organisations work across many countries will stop the Charity Commission work with uk focus to charities was to pack. How can you compare that to a Global Charity . I believe the Charity Commission needs more resources. They have seen their resources cut and cut and cut and to hold charities to account and to give the Public Confidence that their money is being well spent, the Charity Commission needs more resources. 0xfa m commission needs more resources. Oxfam have put out a lengthy response, once again apologising for what happened. It is a long list of measures they say they have taken, tripled money for safeguarding, created a director of safeguarding, trained staff to investigate allegations. They have asked for more survivors to come forward. That is just more survivors to come forward. That isjust a more survivors to come forward. That is just a handful of many proposals was is that anything they can say that goes far enough to perhaps suggest they can go forward with not a clean bill of health, because they havent got that, but they intend to tackle this question mug it is deeds, not words will stop we can have fine words, set up a hotline, but proof of the change will be in the actions taken. That is what we have got to wait and see, whether that culture will change. This is a sector wide issue and i think if you ask that question you have to ask that question of all the aid agencies will stop if im watching you now and i think i would like to give money to charity, here is a lady who knows about this sector and im thinking about parting with my money, what youre saying is, at the moment, you wouldnt . The Charity Watchdog described a culture of poor behaviour among oxfam workers sent to help victims of the 2010 haiti earthquake. In response, the charity has said it is deeply sorry for its failure to prevent sexual abuse by its staff in haiti. Baroness stowell chairs the Charity Commission. She said the charity fell below standards expected. The incidents in haiti were very dismaying, i think more broadly because what we have done is looked into oxfam more broadly. I mean, what i feel and i think everyone feels is very let down by oxfam. This is one of our best known charities in the united kingdom. It is there to put people first and it failed to live up to peoples expectations. No charity is more important than the reason why it exists, the people it exists to serve and no charity must believe that their mission is more important than the people they exist to serve, and on this occasion, they failed everybody, they have let everybody down. The Security Services watchdog says m15 failed to properly manage the destruction and storage of data gathered during targeted investigations. A highly critical report from the investigatory powers commissioner was made public during a hearing at the high court this morning, in a case brought by the campaign group, liberty. Lets cross to our Legal CorrespondentClive Coleman who is at the high court. This is damning and must have raised a few eyebrows. It really did, rarely do you hear a seniorjudge, lord justice belford, a judge from the court of appeal, speaking in these terms. This is about the Investigatory Powers Act which was famously dubbed the snoopers charter. That gives considerable powers to the Security Services to access our data. We are talking about where and when you make telephone calls, who we make them too, in addition to looking at our browsing history, in addition to being able to hack our mobile devices, and the Security Services dont need us to be a suspect in order to do that. They do need to make a series of applications through warrants to the court and seniorjudges sign off on these things, but the Key Protection that we as citizens have, which is built into the act, is that the data that is obtained is then held for the shortest possible time and deleted as quickly as possible, but what we have learned today from this decision from lord justice bulford is that for the last three years this system simply hasnt been operating. He found that effectively, this has been obtained, kept, not deleted in a way that is unlawful. It is absolutely damning for m15. As you said you could liken it almost to a failing school. He says that the whole system for obtaining this information on the warrant is currently in special measures, and what he and short is saying is the Security Services have lost the trust of the seniorjudges who sign off on these things and they are going to have to give them very considerable assurances that the system they have applied is fit for purpose. In addition to that, it has come out that m15 knew about these breaches for some three years, documents from 2016 acknowledge that these breaches were taking place, and in addition to that, the judge was concerned that false assurances we re was concerned that false assurances were given to the judges, even when the matter was eventually reported brought to the attention of lord justice bulford earlier this year, he said that even then, there Security Services were using what he describes as misleading euphemisms given to the court, so make no mistake, this is a coruscating analysis of the way in which the Security Services have been applying the protections that we, as citizens, are entitled to. And just one further example for you, the Deputy Director general of m15 is quoted in some of these documents saying, our data is being kept in an ungoverned zone, ungoverned areas within the Data Collection arrangements that m15 have. That is language you rarely hear from a judge. This has all come about as a result of a legal challenge brought by the Civil Liberties group, liberty and within m15 this evening there will be a lot of head scratching and it will be much more challenging for m15 to get this information through warrants because the judiciary have been effectively told, be on your guard, we have to be absolutely certain that they are applying these protections before we give them access to our data. The bbc has come under criticism after announcing yesterday that people over 75 will have to start paying for their licence fee, unless theyre getting pension credit. Labours deputy leader tom watson asked culture secretary Jeremy Wright an urgent questions in the house of commons earlier today, who told mps about the deal the government had struck with the bbc. The government recognise the importance of the licence fee when we agreed a funding settlement with the bbc in 2015. To provide the bbc with financial certainty to plan over the long term. We agreed to take action to further boost the bbcs income by requiring iplayer users to have a tv licence. And we unfroze the licence fee for the First Time Since 2010 by guaranteeing it will rise each year in line with inflation. In return, we agreed that responsibility for the over 75s licence fee concession would transfer to the bbc injune 2020. Mr speaker, the bbc is operationally independent. So the announcement yesterday is very much their decision. But, but, taxpayers want to see the bbc using its substantial licence fee income in an appropriate way to ensure it delivers for audiences, which includes showing restraint on salaries for senior staff. In 2017 18, the bbc received over £3. 8 billion in licence fee income, more than ever before. And the bbc is also making over £1 billion a yearfrom commercial work like selling content abroad, which can be reinvested. So we are very disappointed that the bbc will not protect Free Television licences for all viewers aged 75 and over. It is also difficult for them to argue that you want to have equal rights for both men and women when there is this kind of disparity when it comes to reproductive rights for women, and the kind of difficulties that are put on women and terms of also attracting a diverse pool of people. So that is the argument, and you have more than 200 businesses, the ceos have more than 200 businesses, the ceos of some very well known Companies Including jack dorsey of twitter, and square have signed onto this. There seems to be some momentum building because Big Media Companies in the last couple of weeks have led the way on this. Certainly, we already heard from disney and netflix who have suggested that you might not be able to operate in states that have these restrictive abortion laws, for the same reason that they will not be able to have the people that they wa nt able to have the people that they want to work on these particular, in these particular businesses. What makes it more difficult for the Entertainment Industry is that it is coming more towards the left end, people in the Entertainment Industry have ta ken steps people in the Entertainment Industry have taken steps before, so we see that there are some actors who have stepped away from doing business in states that have any of these kinds of restrictive rules, so when it comes to entertainment agencies and businesses like disney and netflix they have the right to reflect, they, where they want to work. An independent report has severely criticised oxfam for the way it dealt with allegations of serious Sexual Misconduct by its staff, saying it ignored warnings and had a culture of tolerating poor behaviour. The Charity Commission has issued an official warning to oxfam after investigating reports that aid workers sent to help after the earthquake in haiti had used prostitutes. The revelations led to thousands of people cancelling their donations to the charity and the resignation of its chief executive. Oxfam gb has responded to the report saying it is deeply sorry for its failure to prevent sexual abuse by its former staff in haiti. The charity said the report would be a spur to greater improvement. Naomi grimley sent us this update from central london. This is the report and it is incredibly damning. It talks about how the charity lost sight of its values. It says there were early warnings and tip offs that things werent right in haiti, that sexual abuse was happening, and yet those warnings were ignored by Senior Management. It also says when the charity did discover what was going on, it was not frank and did not give a full account to the Charity Commission, to the uk authorities or to the haitian authorities. In a minute, we will hear more about what 0xfa m minute, we will hear more about what oxfam is saying, but first lets look back at the scandal that tainted a much loved national brand. The charity dismissed for mums of staff and let three quietly resigned without properly flagging up what happened to either the haitian authorities or to regulate is in the uk. Whistle blowers like helen evans, a former head of safeguarding, were simply ignored. A fundamental principle for aid agencies is do no harm. What good are they if they leave a legacy of exploitation and abuse . My hope is that this is the wake up call the abuse . My hope is that this is the wa ke up call the sector abuse . My hope is that this is the wake up call the sector needs. They have been a lot of promises but now we need to see action, we need to see change. That will take many yea rs. See change. That will take many years. Oxfam has paid a heavy price for this scandal. It lost 7000 donors who cancelled their sub script and is in disgust, and it still cant bid for government contracts. What is the charity trying to do now . It has appointed a new chief of safeguarding, a new chief executive and says it has dismissed a 79 individuals in the last year, so it is trying to rehabilitate its reputation. That impacts on the income that is received. In february last year, 0xfa m received. In february last year, oxfam agreed to withdraw from any bidding on government products. A statement from them at sewing that the priority remains the people in need. Rory stewart says that oxfam plays a closure role in saving lives, and they are an aborted british institution. But he also says this is a long term process in which there are no easy answers or room for complacency and says there will be working with oxfam and the Charity Commission in the coming weeks was not a decision yet to be made as to whether oxfam can rebid for uk government funding. We will keep an eye on that story and any develop months. Andrea leadsom and mark harper are the latest candidates to launch their campaigns to replace theresa may as Tory Party Leader, and become the countrys next Prime Minister. One of the lesser known faces in the leadership race, launching his campaign today, said that plan was for the birds. It is not credible to say you can re negotiate the Withdrawal Agreement and get it through both houses of parliament by the 31st of october. He also argues that europe will have to make changes to get the deal through. They are saying they want us to leave without a Withdrawal Agreement, i dont think that would be a reasonable position. As westminster awaits a new Prime Minister, conversations in brussels continue. Today it was scotlands first minister meeting europes chief brexit negotiator. She had this to say in the conservative race. Weve got delusion around brexit which is not new but continuing, the whole thing is a horror show and really is showing the tory party in their true colours. I think all of the candidates would be disastrous. The fight to be our next Prime Minister has weeks left to play, but with storm clouds gathering on brexit, urgent reconstruction work required on any deal, at the end of it awaits a job that will be complicated at best, almost impossible at worst. There is no chance for much negotiation with the commission, there will be a new negotiator over there, wont be in place for a while. None of that can really start happening before the summerand really start happening before the summer and even then it could drift and there would have to be an extension to article 50, another extension to article 50, another extension to article 50, another extension to brexit. What is interesting is that the other candidates are piled on, saying it will not be their priority, that they want to help those on lower incomes will stop all the other candidates framing their arguments against Boris Johnson. When they Start Talking about character and needing someone who is a sensible to lead the country, someone who is realistic and a grown up someone who is realistic and a grown up in the room, they are not naming borisjohnson but up in the room, they are not naming Boris Johnson but that is up in the room, they are not naming borisjohnson but that is who they are attacking. The revelations led to thousands of people cancelling their donations to the charity and the resignation of its chief executive. The charity said the report would be a spur to greater improvement. Naomi grimley sent us this update from central london. This is the report, and it is incredibly damning. It talks about how the charity lost sight of its values. It says there were early warnings and tip offs that things werent right in haiti, that sexual abuse was happening, and yet those warnings were ignored by Senior Management. It also says, when the charity did discover what was going on, it was not frank and did not give a full account to the Charity Commission, to the uk authorities or to the haitian authorities. In a minute, we will hear more about what oxfam is saying, but first lets look back at the scandal that tainted a much loved national brand. In the aftermath of the 2010 haiti ever quake, a group of oxfam workers used young prostitutes when they we re used young prostitutes when they were supposed to be helping the local population recover. If a request is made, what is going to be the answer . It might not be the one that people want, because remember the europeans themselves have got so much patience. They have made it clear that there needs to be a very good reason for an extension. They we re good reason for an extension. They were notjust give one for nothing. A man has told the inquiry into contaminated blood that he came from a family of haemophiliacs and six siblings were infected in the scandal. Four ofjohn cornes brothers have died. Thousands of people were given blood infected with hepatitis c or hiv in the 1970s and 80s. Mr cornes told the inquiry that he believed his mother died of a broken heart. Sophie hutchinson reports. John cornes, flanked by his son and lawyer arriving at the inquiry this morning. Here to tell his story about the devastation infected blood products wrought on his family, and the stigma they faced. It was a large family, john was one of six brothers with haemophilia. In the 70s and 805 they were treated with infected blood products. Three of his brothers got hiv and died of aids. It devastated his mother. She became frail and fraught and i think shed still be alive shed be about 85 or Something Like that now i think shed be alive if it wasnt for what happened. Because she was a strong woman, and the tragedy has brought. Ripped her heart out. John described how the local press hounded them, calling them the aids family. He said it was very bad at his brother garys funeral. We had them hiding in the bushes, there was lots, at least 50 reporters in the bushes. And it made us really infuriated, knowing they were taking pictures, they didnt ask permission or anything. All they wanted was to get the grieving aids family. Two more funerals would follow shortly afterwards, and john told the inquiry about his concern each time for the other sick brothers. Watching gary die, i can remember watching him, watching. Looking at gordon and roy at garys funeral and looking at gordon at roys funeral. Whats he going through . What state is his mind in . He was bad. I felt sorry for him. I dont know if the word sorry is sufficient enough. But, you know, devastated. We all did, especially my mother. John regularly visits the graves of his four dead brothers. He didnt want to give evidence to the inquiry but said he needed to do it for the wider family, and is looking for an apology for the harm caused to them. Sophie hutchinson, bbc news. Its emerged that the Security Service m15 has been put into special measures because of whats been described as a historical lack of compliance with the law on managing data gathered during investigations. A highly critical report from the Security Services watchdog was made public during a hearing at the high court this morning, in a case brought by the campaign group, liberty. Our Legal Correspondent, Clive Coleman was there. A month ago the home secretary revealed that there had been breaches of the safeguards were then the investigator powers act. That was famously dubbed the snoopers charter, that is the act that was supposed to put in place serious safeguards to safeguard the privity of citizens while also giving to the Security Services pretty comprehensive powers in terms of obtaining and retaining that data. What we have heard today in the high court is truly extraordinary, that in effect m15 had been running an operation for the last three years that has been unlawful. So lawful that has been unlawful. So lawful that the information that it has obtained my information obtained by way of warrants, that the investigator powers commissioner, who is a very seniorjudge, has effectively put m15, if you like, like a failing school, into special measures in relation to the processing of those warrantys. This all arises as a result of a legal challenge brought by the Civil Liberties group have liberty. I am joined by the legal officer for that he liberty. The words he have used, this is the first time we have seen the contents of the report. Run me through some of the key issues. It is really shocking what we have heard in court this morning. M15 had been holding onto peoples data, ordinary people, illegally for many yea rs. Ordinary people, illegally for many years. Not only that, they had been trying to keep their really serious errors secret, secret from the surveillance watchdog, who are supposed to know about them, secret from the home office, the Prime Minister and secret from the public. We only know now because of this case. The language used by the judge, he talks about the gravity of what has gone on, and he talks about mi5 in what has gone on, and he talks about m15 in effect being in special measures. That is language we have never heard before. Its true, and none of us have trust in the way that our data is being handled. Liberty has been saying for a long time, been warning about the sweeping and rights encroaching powers given to the government under this act, that allows them to spy on anyone and collect anyones data, and now were learning that the data they collect is also being mishandled and are kept when theres no lawful basis to keep it. We say that underscores our concerns, and it shows that we are not protected, our rights are not protected by this legislation. 0ur liberties and freedoms are not defended by the safeguards. Lets go to the sum of the detail about the specific things. One that people might find especially concerning is the way ed handled what is known as legally professionally privileged material, that arises when a person talks to their lawyer. Run through what the judges concerns are about the way in which that material is retained. The concerns are, like with other data, this data is being retained when there is no lawful basis to retain it. It is being kept forfar longer than it should be. Not only that, there are other concerns about the way it is being handled. This material should not be looked at by people if it is legally privileged, but the systems are failing and this data is being seen by people at m15 when it should not be. One final detail, the deputy of the director general of m15 referred to data being held and what was he described as ungoverned spaces, so it truly is a shocking report or decision by thejudge it truly is a shocking report or decision by the judge and one that mi5 decision by the judge and one that m15 are going to have to consider very carefully in future add in the way in which they apply warrants to obtain the data that they need to keep us all safe. Cardinal Vincent Nichols made his views known during a visit to nottingham, after the vatican released a new document on how it sees gender issues. Two drugs gang bosses have been jailed after a Police Operation which led to the seizure of £20 million worth of cocaine from a van on the m6.
