So what is an nda . Its a contract to stop the disclosure of confidential information, for example, not revealing details to a competitor. But its also used if youve had an employment dispute. You may end up signing one in return for a pay off. Originally, the High Court Ruled the businessmans name and the allegations could be published. That it was in the Public Interest and the information was reasonably credible. He then appealed and judges decided nondisclosure agreements played an important role, and the staff who had signed them werent bullied or pressurised to do so. They have always been used to settle disputes. They are not necessarily a lwa ys disputes. They are not necessarily always used by the rich and powerful. These are the hike profile ones of the moment, but they are used every day to settle disputes. And if the employee has quite a lot of safeguards built in, or at least they should, because the nda or settle m e nt they should, because the nda or Settlement Agreement as they are commonly known, has to be, the employee has to take advice from a legally qualified adviser. And the employer generally contributes to risk their legal fees and also the point at the so called tagging losses, they are not actually allowed. So in a proper Settlement Agreement, it will say that the employee is not prohibited from whistle blowing and that should a lwa ys whistle blowing and that should always be in the Settlement Agreement. And because the employee should have a lawyer give them advice are authorised trade union adviser, there are certain safeguards there for them. So that is what she said today. But they should not silence whistle blowers, but clearly, they are to some extent though there are employees that feel like theyre being gagged and cannot speak out, so why would they be thinking that . Because when they are offered in agreement, the pressure will come from the employer. It may be that you are going to be dismissed on performance grounds of misconduct, the status of things, that should not happen. There are guidelines to prevent that type of behaviour from the employer. When you think about it, look at the commentary in the media it is quite right that the employee is generally ina right that the employee is generally in a less powerful position because they generally do not have the resources to fight a case all the way to court because Legal Expenses are high and there is no legal aid any more for those vulnerable members of society that had been sexually or racially harassed or bullied in other ways to pursue theirclaim, so it bullied in other ways to pursue their claim, so it is right that the commentators are saying that there is an imbalance of power. The former boxer lived most of his life in the same terraced house in warrington, and when he died this year his family were amazed to discover around 400 paintings. Eric tucker was a former boxer, later a labourer. But painting was his life. His family knew he was an accomplished artist, but had no idea of the sheer volume he produced. In the bedroom, they were stacked up in cubbyholes. Up in the loft. Itjust group, the whole collection. And i was completely amazed, all the wonderful work that i found. And i knew he had painted lovely paintings, but i didnt know really how hard he had worked at his art. Eric was self taught with no formal training. His paintings depict a lost world pub and club life, street life, working class life in the industrial north. His studio has been left untouched complete with easel, paints and brushes. Somebody asked me and said, well he was, it was his hobby. I said, no, it wasnt his hobby, it was his life. It was the one thing really that kept them going. As a small boy i can remember him drawing, you know, he was an artist. And he carried on till the end. As well as paintings, erics family also found thousands of sketches when he died aged 86 injuly. Despite his huge talent, eric always resisted exhibiting his paintings, but he changed his mind shortly before he died. Now his family have turned his house into a gallery space, open to the public this weekend, so they can finally be seen. Its so good, its so interesting.
