There were no survivors when mh 17 was wrought down over the skies of Eastern Ukraine last year. Now plans to try to bring justice to those responsible have been halted. Russia has used its veto at the United Nations to prevent an International Tribunal from being established. In all 298 people were killed when a plane crashed a little over a year ago. Governments were quick to accuse the prorussian splittists using a missile to bring the plane down. Something that kiev denies. Russia would use its veto quashing the resolution just minutes after the ask to find someone accountable for the killing of those on board flight mh 17. Kristen, we heard arguments from the the malaysian transport minister. He was representing the Investigative Team into looking who is responsible for the downing of this airliner. He said it was essential to have in place to prosecute whoever was responsible to insure that justice was served on behalf of the victims and that the team, which is consists of countries most effected by the downing of this airline like belgium australia, malaysia and netherlands. Most of the victims came from netherlands they requested this from the Security Council but russia had a whole list of concerns quote serious concerns of how the investigation was taking place. They said that it lacked transparency. It was not in compliance with international norms. These are all points, of course, that the Investigative Team and other members of the council took sharp opposition to. They denied that and saidpointed to lack of evidence to the contrary. But russia went on to say that this was not in keeping with earlier resolutions that the Security Council had passed on mh 17, and they did not believe that the downing of this airliner while a tragedy that it jeopardizes International Peace and security. Here is more what they had to say. We do not back the idea of the creation of a tribunal under chapter 7 of the u. N. There are no grounds of this mindful of the fact that the Security Council did not classify the boeing tragedy as a threat to International Peace and security. Its difficult to explain how the events that took place a year ago were not deemed to be a threat to International Peace and security now it becomes just that. Well, kristen lots of Foreign Ministers ready for the vote but theyll have to settle for the investigation that is already ongoing. Thats right. As you might imagine the four ministers of these countries that suffered losses in this crash were very upset by the outcome and by the veto, and that was expressed in their speeches. They said that russia made a mockery of justice. Ukraine ambassador said that the truth would eventually set russia free and set people free. They were very heated, angry comments coming from these countries. And julie bishop vowed that they would seek another form of justice. They would find another venue to prosecute the perpetrators once the tribunal does come up with suspects that they would search for another way but obviously thats going to be very difficult without the backing of International Law and the Security Council. Kristen the malaysian government said that we dont give up our fight for justice but account u. N. Do any more to support them . Well, the u. N. And the Security Council continues to back the investigation but when it comes for finding another venue i think it will there arent a lot of other options at the United Nations unless the Security Council is united they cant refer something to the International Court or establish an tribunal unless the Security Council is on board. Then it comes down to individual nations and their justice systems and their reach and again that is more difficult when you dont have the backing of the Security Council to demand that suspects be extradited to a country to face trial. Well, the reactions are there and its interesting because some people are really still doubting because this is actually the fifth time that there is news about taliban being leader being killed or being dead. There are people who are going to benefit a lot because were 48 hours away from one of the other round of negotiations or i would rather call it between facilitated by pakistan between afghanistan and the taliban. So that also at this point in time to break this news or to spread this news is also giving the news more importance. But then at the same time if you look into what has s happening if this is true or not in terms of the operations of the taliban, as they continue with bombings. There is no particular changes. But the reactions have been different within different groups. Mullah omar has been painted as the spiritual leader of this organization. But in reality does it make difference who the person is . Is it a flat structure. I often challenge this whole notion the spiritual leaders who have the followers based on religious justification. I see taliban as a proxy force or group that are actually operating in financial and military and geographical support of countries who have geopolitical interest in keeping the fight in the fire in the country. Looking into the phenomenon of taliban the taliban when they came to power they have motivation fighting for mujahideen fighting russians. They were known for harsh towards women. In 2001 theyre more known for killing civilians and being ruthless and not having a clear line of what is their justification. Of course, their general justification is the u. S. This was a preferred option because it would have generated and Brought International support for the prosecution process. It was also the best way for assuring the cooperation of all states. The resolution included a special Provision Requiring states to cooperate fully with the tribunal by surrendering suspects. Of course, it does not come as a complete surprise. Russia has expressed opposition to United Nations tribunal. Despite this we engage with russia until the very last minute but in the end it was not possible to find a common ground. What has happened today is regrettable but it will not bring to an end our near for bringing punjabty. So now we will start focusing on those options. Carefully and tirelessly. The countryies participating in this Investigation Team will continue working together with the support of a broad initial coalition, resolved to insure that resolution 2166 demand for accountability and fully implemented. Russia has proved noting are to jump over its own shadow, but emeries lawsuits that we will continue in our efforts. We wont let this veto weaken our resolve. We will immediately continue to Work Together on these options carefully and tirelessly and it is our duty to continue to draw attention to the events surrounding mh 17.
