A technical error in the Steuben County grand jury proceedings that resulted in a sweeping indictment against five men, including a legislator, in a sex trafficking enterprise has been dismissed by a judge. But prosecutors plan to file the charges again.
The indictment charging Larry Comfort Sr. he s one of two brothers linked to the 1980 shooting death of a state police investigator along with Steuben County Legislator Steven Maio and three other men was dismissed Tuesday by State Supreme Court Justice Thomas E. Moran. The men faced charges including enterprise corruption, sex trafficking, and promoting prostitution.
The technicality that resulted in the dismissal, Steuben County District Attorney Brooks Baker said, came down to a New York state trooper who testified before the grand jury about his own role in the investigation but was also in the room to play an audio clip during testimony by other witnesses.
