Counsel split on IPAB
closure
While in-house and private practice counsel see the closure
of India’s Intellectual Property Appellate Board as an opportunity for wider
reform of the country’s overburdened judicial system, they have different views
on how that reform should be achieved, several revealed to Managing IP this
week.
While some say that the technical expertise of IPAB members has
been useful for IP owners, others argue that the huge delays in appointing
experts and members to the board have made the hearing process too arduous.

Group in Mumbai, says that because the courts are already overburdened, the
EPA Act
Before looking at the Bandelle decision, s 6.20 of the EPA Act
provides a long-stop limitation period of 10 years for
any loss arising from defective building works, irrespective of
when defects become apparent. Essentially, s 6.20 prevents any
person from bringing civil proceedings for loss or damage arising
from defective work if the works were completed more than 10 years
prior.
The intent of this provision is stop parties bringing actions
for allegedly defective works well after those works were
completed.

Former doctor Robert Xie has lost an appeal against his convictions for violently murdering five members of his family in their Sydney home.
Key points:
Three of his grounds of appeal involved DNA evidence found in his garage
Xie, who appeared via video from jail, put his head in his hands when the decision was handed down
After four trials, a jury found Xie guilty of bashing his newsagent brother-in-law Norman Lin, Mr Lin s wife Lily, their sons Henry, 12, and Terry 9, and Lily s sister Irene, to death while they slept in their beds at North Epping in 2009.
