MDARD suspended the food license of Marlena s on Thursday, Jan. 21. According to ACHD Environmental Health Supervisor Randy Rapp, he and another county representative attempted to deliver the suspension order to Pavlos-Hackney, who refused it.
ACHD sent Marlena’s a warning letter in early December, ordering the restaurant to comply with Michigan Department of Health and Human Services regulations. Later that month, a cease-and-desist letter was issued. A second cease-and-desist letter was sent by MDARD on Dec. 31.
Pavlos-Hackney, who represented herself, issued a myriad of overruled objections during the hearing, including accusing the judge of assisting the prosecution. She also called the CDC a “for-profit organization.”
Judge upholds license suspension in Marlena s case
HOLLAND The food license of a local bistro will remain suspended following a decision from an administrative judge.
The decision, released Thursday, Feb. 11, noted a preponderance of evidence shows that (Marlena s) has continued to engage in conduct that constitutes an ongoing imminent threat to the public health, safety and welfare.
Marlena s Bistro and Pizzeria, 909 Lincoln Ave. in Holland, remained open during a statewide dine-in ban that lasted for two and a half months and ended Monday, Feb. 1. The restaurant has also ignored mask-wearing and social-distancing guidelines.
During a virtual court hearing Monday, Feb. 1, through the Michigan Office of Administrative Hearings and Rules, Judge Laura Van Steel heard arguments from business owner Marlena Pavlos-Hackney and witness testimony from representatives at the Allegan County Health Department and the Michigan Department of Agricultural and Rural Development (MDARD).

But Marlena Pavlos shared a note on her restaurant’s Facebook page saying she’d reopen for business on Feb. 2, 2021. And she was, despite state health officials suspending her license to operate and threatening to revoke it pemanently.
Pavlos faces fines and possible jail time over her on-going refusal to comply with state rules that barred dine-in service for several weeks. Allegan County Health Department officials, as well as police documented that she was not enforcing masks or social-distancing as required by state rules.
