EAST PALESTINE An East Palestine woman charged with obstructing official justice and resisting arrest is suing two East Palestine officers, the chief and the police department for an incident in February 2020.
Betsy L. Theodore, 452 Alice St., East Palestine, is suing officers Matthew Elser and William Milliken III, as well as Chief James Brown III and the East Palestine Police Department for assault, false arrest and malicious prosecution.
Theodore was charged with obstruction of justice and resisting arrest Feb. 9, 2020 after allegedly lying to officers about the identity of Travis Mosti, 38, who had a warrant out of Jefferson County. Both charges are second-degree misdemeanors and Theodore pleaded innocent at her arraignment Feb. 10, 2020. A jury trial is scheduled for Feb. 18, 2021 on the charges.

It will be a few more days before a task force set up to study Michigan’s dam safety regulations will finish its final report.
The delay is because of concerns about the “tone” of the document.
The Dam Safety Task Force was created after last May’s failures of the Edenville and Sanford dams. The twin dam failures contributed to a 500-year flood event which caused tens of millions of dollars in damage. Rising floodwaters forced thousands in Midland and Gladwin counties to evacuate their homes.
The task force has come up with a wide spectrum of recommendations for modifying and updating Michigan’s regulations for publicly and privately owned dams. The recommendations would expand the number of dams regulated by the state.

Last year, the global COVID-19 pandemic created unprecedented challenges for American courts. By making several changes, however, the U.S. Court of Appeals for the Federal Circuit was able to largely continue its operations. The most visible of these changes was that the Court began to hear all arguments telephonically, with some early denials of at least some parties’ requests for an oral hearing. Another less visible shift was that the Court issued summary affirmances in cases in which there was no oral argument.
At the same time, the number of appeals to the Court dipped this year, perhaps as a result of broader economic uncertainty. The largest drop was in post-grant review cases from the U.S. Patent and Trademark Office. The number of appeals from the PTO reached an all-time high in 2019 at more than 650 appeals.
