SD Supreme Court Upholds Life Sentence In Murder For Hire

SD Department of Corrections A South Dakota inmate serving life without parole is asking the South Dakota Supreme Court to overturn his sentence. Jonathon Klinetobe was charged with masterminding the plot that resulted in the 2015 murder of his former girlfriend in Rapid City. He agreed to plead guilty to first-degree manslaughter and left it up to the judge to determine his sentence. At oral arguments on Tuesday, Jan. 12, his attorney said the life sentence violates Klinetobe s Eighth Amendment right against cruel and unusual punishment. Victoria Wicks has more of this story. DAPL: Army Corps Won t Appeal But Dakota Access Will

Credit U.S. District Court for the District of Columbia Opponents to the Dakota Access Pipeline are disappointed that the Biden administration has not shut the pipeline down. Opponents have sued the U.S. Army Corps of Engineers, claiming the government permit violated the National Environmental Policy Act. Last summer plaintiffs claimed victory when a District of Columbia federal judge vacated the permit and ordered the pipeline shut down. The D.C. Court of Appeals quickly reversed the shutdown. But it upheld the finding that the pipeline is operating illegally and sent that issue back to the lower court. On Friday, April 9, the Corps of Engineers was called to the lower court to explain why, months later, it still allows oil to flow. Reporters were allowed to listen in but could not record.

5th Circuit Deems Indian Child Welfare Act Unconstitutional In Part

• Jan 22, 2020 A full panel of judges in the Fifth Circuit Court of Appeals will decide if the Indian Child Welfare Act is based on race or politics. The court heard oral arguments on Wednesday, Jan. 22, in New Orleans. In 2018 a Texas lower court found the act known as ICWA to be unconstitutionally race-based. A three-judge panel overturned that finding, but not unanimously. Now all of the appeals judges in the Fifth Circuit will consider the issue. SDPB s Victoria Wicks has this report.
