Federal court finds Lecoq legitimate winner of PBCN urban councillor by-election After more legal wrangling, Clarisse Lecoq remains the Prince Albert urban councillor for the Peter Ballantyne Cree Nation. A protracted battle over the position has been being waged since 2018. Warren McCallum was initially elected as urban councillor in a general election more than two years ago. Lecoq challenged these results and was successful in forcing an August 2019 by-election which she won. McCallum in turn challenged the latest results and was granted a new by-election by the appeals tribunal. However, the by-election was put on hold after a federal court granted a motion by Lecoq for an injunction to stay the election and retain her position until the matter could be reviewed.

Federal court rules in favor of elected PBCN Urban Councillor

Lecoq has also been awarded costs in the sum of $3,000 to be borne equally by PBCN and Warren McCallum. Favel said the costs are to be paid within ninety (90) days of the issuance of this judgment and reasons. The byelection last August represented the third time campaigning for all three candidates in 14 months. The initial results had been appealed by Clarice Lecoq and the week of the scheduled byelection in July, the candidates were informed there was an injunction in place and Warren McCallum was appealing the Election Tribunal’s ruling to the Federal court. A federal court judge would later reject the appeal and side with the decision made by the election tribunal.
