Chief Justice Tun Tengku Maimun Tuan Mat who chaired a seven-member bench said there was no positive provision of law which set out clearly and unequivocally that the Immigration Director-General and the Home Minister had the right to impose the travel ban on Maria. “The right to travel abroad is a fundamental right guaranteed to all persons under Article 5 (1) of the Federal Constitution. It is obvious from the facts that the appellant’s (Maria) right had been breached,” she said in her judgement.

Ku Nan can still serve as Putrajaya MP while appealing court decision

KUALA LUMPUR: Despite his corruption conviction, Datuk Seri Tengku Adnan Tengku Mansor can still serve as Putrajaya MP while appealing the sentence, say lawyers. Tengku Adnan was sentenced yesterday to 12 months’ jail and an RM2mil fine for personally receiving RM2mil from a property developer. Article 48(4)(a) of the Federal Constitution stated that an MP will be disqualified from their seat within 14 days from the date he or she was sentenced to a fine exceeding RM2,000 or more than one years’ prison. Supplementary section, Article 48(4)(b) gives leeway that should the MP appeal their sentence within 14 days, they would only be disqualified 14 days from when the court decides on the appeal.

Malaysia PM holds on to power with budget win

KUALA LUMPUR: Malysian Prime Minister Muhyiddin Yassin secured his position in Parliament on Tuesday after securing 111 votes for his first federal budget, following weeks of uncertainty about whether he would survive the vote. Muhyiddin won by a wafer-thin margin by winning the support of three more MPs, compared to the 108 who had voted against him, to clear the final hurdle for the record 322.5 billion Malaysian ringgit ($79.61 billion) budget which will move to the Upper House and Senate to be ratified before taking effect. Experts said Tuesday’s results had “solidified” Muhyiddin’s hold on power. “This has solidified Muhyiddin’s position, and now he is holding a ‘more stable’ regime,” Prof. James Chin, Tasmania University’s Asia Institute Director, told Arab News.
