Law360, New York (May 5, 2021, 4:52 PM EDT) The Second Circuit looked set Wednesday to end copyright claims against Amazon, Netflix and Apple brought by writers of a children s song about fish sticks that was used in a film about burlesque dancers, with judges saying the movie is a documentary afforded leeway in fair-use commentary.
Circuit Judges Susan L. Carney and Reena Raggi, who sat on a virtual three-judge appellate panel, indicated that the source of the alleged infringement a film called Burlesque: Heart of the Glitter Tribe about strippers in Oregon clearly is a documentary.
The Second Circuit appeared divided Monday over the fate of a lawsuit that says New York City trampled the rights of landlords in a global emergency.

MANHATTAN (CN) Over a year into a deadly pandemic that made New York City an early hotspot, a group of landlords made to hold off rent collection indefinitely urged the Second Circuit on Monday to revive their case.
“You don’t get to throw out constitutional protections just because there’s an emergency,” said Claude Szyfer, representing Brooklyn landlord Marcia Melendez and others.

In a major blow to leftist-run cities, states, and localities, a three-judge panel of the Second U.S. Circuit Court of Appeals in Manhattan ruled unanimously that President Donald Trump can withhold funds to so-called sanctuary locales. This applies to any state, city, or local government that refuses to cooperate with federal law enforcement when it comes to immigration laws.
The unanimous decision overturned a lower court ruling that ordered the release of federal funds to New York City as well as the states of New York, Connecticut, Massachusetts, New Jersey, Rhode Island, Virginia, and Washington, which amounted to nearly $26 million of annual grants to the seven states and $4 million to New York City.
