Lawsuit Alleging Fatal Restraint By Hospital Staff May Proceed, Texas Supreme Court Rules
A lawsuit that charges staffers at a Texas psychiatric hospital with violating a patient’s civil rights must comply with a state law that requires plaintiffs to submit expert reports after filing health care liability claims, even though no medical malpractice is alleged, the Texas Supreme Court ruled Friday.
Ordinarily, the lawsuit would be dismissed because no report was served by the statutory deadline, but the high court allowed the case to proceed “in the interest of justice.” Plaintiff’s attorney Katie P. Klein said she considers that a victory.

The state is keeping count of how many doses of the COVID-19 vaccine are being wasted, including numbers for the Rio Grande Valley.
Texas Department of State Health Services data shows that Texas has distributed more than 3 million doses of the COVID-19 vaccine and that Texas providers have wasted 1,751 doses.
In the Rio Grande Valley, the state count says just 21 doses of vaccine have been wasted, including:
9 at Rio Grande State Center in Harlingen; 2 were spoiled and 7 for other reasons
