ACLU Says Settlement Approved Following Portsmouth Sign Dispute | News Radio 920 AM & 104.7 FM

Apr 21, 2021 (Portsmouth, RI)   The American Civil Liberties Union says a federal judge has approved a settlement which stops a Rhode Island town from enforcing an ordinance banning political signs on residential property. A Portsmouth resident, Michael DiPaola, had been in a feud with the town about zoning issues and placed a number of signs on his property that were critical of the town earlier this year. The suit was filed after DiPaola said he was threatened with daily fines if he did not take down the signs. The ACLU says this was an important victory for free speech.

ACLU settles lawsuit against Portsmouth over political sign ban

The settlement permanently bars enforcement of that ordinance. Michael DiPaola brought the case to court when the town banned him from posting signs on his front lawn that criticized town zoning laws. He was fined each day his signs were up after he was told to remove them. The town settled, and is now paying his attorney fees.

Portsmouth political sign lawsuit settled with ACLU

PORTSMOUTH  A lawsuit filed by a Portsmouth homeowner who claimed the town deprived and restricted his right to free speech after he was ordered to remove political lawn signs from one of his properties has been settled. Michael DiPaola, with the backing of the American Civil Liberties Union of Rhode Island, filed suit in federal court in January. On or around Jan. 11, DiPaola posted a sign on his property at 184 Bristol Ferry Rd., “which expressed his opinions criticizing perceived selective and corrupt code enforcement by the town,” according to the lawsuit. After nine signs had been erected, DiPaola received a violation notice from the town on Jan. 14 that said they violated a zoning ordinance and called for their removal within seven days, citing potential fines of up to $500 per sign for each day of the violation, the lawsuit says.
