Brindisi sent a letter to Lamica and the village board in late March stating that his client had not yet been given a chance to see or respond to the complaint and calling for a retraction of any and all defamatory statements against him. The letter warned of the possibility of legal action against the village.
Brindisi’s letter also included a request under the Freedom of Information Law for copies of any complaints against Conover, investigations into the complaint or complaints and copies of any policies and procedures he is alleged to have violated, as well as copies of any written notifications informing Conover he is the potential subject of disciplinary action as outlined in the collective bargaining agreement.
