M&S wants Aldi caterpillar cake withdrawn 16-04-2021 21-09-2018 Marks & Spencer (M&S) is suing German supermarket chain Aldi at the UK High Court over a cake which it says infringes its ‘Colin the Caterpillar’ brand. According to M&S, Aldi’s ‘Cuthbert the Caterpillar’ cake is likely to confuse consumers and “rides on the coat-tails” of the UK retailer’s brand. “M&S is concerned that this could be a classic case of mistaken identity as far as shoppers are concerned and they have decided to take action to clear things up,” said Mark Caddle, partner at European IP firm Withers & Rogers.

M&S is taking legal action against Aldi over Colin The Caterpillar

People really love a Colin cake. It wouldn t be a birthday without the smiling face of Colin (and people arguing whether the birthday boy/girl gets the face or not). Now, Marks & Spencer is taking legal action against Aldi. They claim that Aldi s Cuthbert the Caterpillar cake infringes its Colin the Caterpillar trademark. M&S says the similarities between the two cakes would make customers believe they are of the same standard. They believe Cuthbert rides on the coat-tails of M&S s reputation with Colin. An intellectual property claim was lodged with the High Court this week. M&S wants Aldi to remove the product from sale. They also want them to agree not to sell anything similar going forward.
