Liberia s Judiciary in the Crosshairs of Adverse International Opinion?

The latest US State Department Human Rights Report has for the umpteenth time drawn the Liberian Judiciary into its crosshairs singling out Judge Eva Mappy Morgan for stinging criticism virtually accusing her of official misconduct. And the case referenced was that of the Monrovia Oil Trading Company (MOTC) vs Ducor Petroleum. Based on her handling of the case before the empaneled 3-man Board of Judges over which she presided as Chairperson, Amos Brosius representing the Ducor Petroleum, wrote a letter of complaint to the Judicial Inquiry Commission alleging that Judge Mappy, who had placed a freeze on his accounts due to action filed by the MOTC, had without his knowledge and or consent ordered the withdrawal of US$3 million from his account.

Commercial Court Judge Suspended for One Year

-Held liable for illegal transfer of over US$1 million Days after the US State Department released its 2020 Human Rights Report on Liberia implicating judges and magistrates of the Judiciary Branch of the Government of bribery, the Chief Judge of the Commercial Court has been found guilty of withdrawing over US$1 million illegally.  The Judicial Inquiry Commission that investigated Judge Eva Mappy Morgan and found her liable has therefore recommended a year suspension for her without pay and benefits. The Supreme Court’s disciplinary commission, the JIC, after eight months of Investigation on Wednesday, April 7 said, “Eva Mappy Morgan, respondent, recklessly abused her discretion when she illegally ordered the President of the Liberia Bank for Development and Investment (LBDI) to unfreeze the accounts of Ducor Petroleum Inc.

The JIC’s recommendation against the head judge of the Commercial Court comes after eight months of investigation into a complaint filed against her by businessman and manager of Liberian owned Ducor Petroleum Company alleging that over US$3 million was withdrawn from his company’s account and given to the Monrovia Oil Trading Company (MOTC) on order of Judge Morgan while the case was pending before the court.

JIC Expected to Rule in Claim against Judge Morgan Today

Credible information reaching the Daily Observer Newspaper has it that the Judicial Inquiry Commission (JIC) will on today, April 6, release its investigative findings into allegations that Judge Eva Mappy Morgan of the Commercial Court authorized the illegal withdrawal of over US$3 million from the account of Ducor Petroleum Inc, while the matter was still pending undecided. Wednesday’s scheduled release of the report comes after the matter has been pending before the JIC for a period of eight months, beginning August 2020, when both Judge Morgan and her accuser, Amos Brosius of Ducor Petroleum Inc, testified during the Investigation. This latest  development also comes barely a week after the US State Department on Human Rights released its 2020 reports, where it highlighted serious lapses of the JIC.
