DMK approaches HC over I-T Dept decision to transfer files

Judge directs counsel to obtain necessary instructions by Feb. 18 The Dravida Munnetra Kazhagam (DMK) and the DMK Charitable Trust have moved the Madras High Court challenging orders passed by the Commissioner of Income Tax (Exemptions) to transfer their files from one Assessment Officer to another, who has been investigating the 2019 search and seizures with respect to the party’s general secretary Duraimurugan and others. Justice Anita Sumanth directed senior standing counsel Hema Muralikrishnan, A.P. Srinivas and A.N.R. Jeyaprathap to take notice on behalf of the I-T officials and obtain necessary instructions by February 18. The judge gave a short adjournment since senior counsel P. Wilson, representing the petitioner, insisted upon staying the operation of the Commissioner’s order.

DAPE wholly Tax-Neutral, if Agent paid Remuneration on ALP: ITAT

By Mariya Paliwala - On January 31, 2021 4:49 pm The Income Tax Appellate Tribunal (ITAT), Mumbai Bench held that the dependent agent permanent establishment (DAPE) is wholly tax-neutral if the Agent paid remuneration on Arm’s Length Price (ALP). The assessee, Asia Today Limited is a foreign telecasting company incorporated in Mauritius and having a tax residency certificate of Mauritius. It sells advertising time and collects subscription revenues through its Indian affiliates Zee Telefilms Limited and El Zee, but its claim was that since it does not have any permanent establishment in India, no part of its income was taxable in India.
