Judges slam ‘rude’ lawyer, ‘obstructive’ witness By Kennedy Mudzuli Share Pretoria - Two judges, in separate cases, in no uncertain terms voiced their displeasure at the conduct they were shown as judicial officers by parties involved in cases before them. Both a “rude” lawyer and an “obstructive” soon-to-be divorcee received more than a slap on the wrist for their attitudes towards the judges. The lawyer got more than he bargained on when Gauteng High Court, Pretoria Judge Bert Bam found him to be in contempt of court and slapped him with a R30 000 fine or 30 days in jail. In the other case, Judge Nicolene Janse van Nieuwenhuizen ordered a woman in a divorce case to foot the entire legal bill for missing two days of court, simply because the woman steadfastly refused to subject herself to a virtual court hearing.

FORMER crime intelligence boss Richard Mdluli appeared in the North Gauteng High Court in Tshwane yesterday to submit an application to have Judge Bert Bam recused. But his application was dismissed. Bam said the application bordered on mala fide, or intention to deceive, and the defence’s argument was without substance. Initially, Bam was meant to preside over the NPA’s application which sought to bar Mdluli from causing any delays in his pending corruption and theft court case related to the police’s secret slush fund.

They have been charged with multiple counts of fraud, corruption, and theft. On Tuesday morning, Mdluli lost a bid to have a High Court judge recuse himself.  Former Crime Intelligence boss Richard Mdluli has lost a bid to have a Gauteng High Court judge recuse himself.  In his recusal application, which was heard on Tuesday morning, Mdluli accused Judge Bert Bam of bias.   They alleged that he did not apply his mind correctly. He took the States word as is and did not adequately check with Correctional Services about Mdluli s non-attendance to [sic] court on the 3 March and prior.

Former Crime Intelligence boss, Richard Mdluli, filed an application on Tuesday for the recusal of Judge Bert Bam in the Pretoria High Court, where he is facing charges of fraud, corruption and theft, related to the police’s secret slush fund. Investigating Directorate spokesperson Sindisiwe Twala said Bam had dismissed the application for his recusal, ruling that they were bordering on malafide and that their argument was without substance. Twala said the detailed judgment would be handed down next week.
