Coronavirus response | Health district, Apple Dumplin reach settlement

URBANA — Apple Dumplin’ restaurant in Urbana is now permanently restricted from operating without a valid health permit. That was part of a settlement between the restaurant and county health officials spelled out in a permanent injunction order approved Wednesday morning by Judge Benjamin Dyer. The settlement also included an agreement by restaurant owners Jim and Kathryn Flaningam to comply with all applicable laws, including any notice of requirements issued by the Champaign County Public Health Department. The agreement also included the dismissal of two related cases — a lawsuit the Flaningams filed against the health department and an ordinance-violation case filed against Kathryn Flaningam for operating a food establishment without a valid health permit.

CHAMPAIGN — As lawyers were working on a settlement agreement for Merry-Ann’s Diner calling for indoor dining at that restaurant to cease, public-health officials suspended the health permit at yet another local establishment said to be defying a state order intended to slow down the spread of COVID-19. Champaign-Urbana Public Health District Environmental Health Director Jim Roberts said the health permit for American Legion Post 71, 107 N. Broadway, U, was suspended Tuesday for continuing to serve customers indoors. It was the seventh health permit local health officials recently suspended in Champaign County after owners disregarded warnings and continued indoor service — currently prohibited by the state at bars and restaurants.

Until the checks stop being cashed by DeVore, these ridiculous lawsuits will continue as long as money is flowing. The Champaign County State’s Attorney should charge the owners with reckless endangerment. It is a Class A misdemeanor. Also, someone ought to file a complaint with the ARDC and seek to suspend DeVore’s license to peddle snake oil. Devore needs to be sanctioned and either have his license suspended or he needs to be disbarred. I don’t dispute Mr DeVore’s right to vigorously defend his clients, but what he is doing is encouraging businesses to openly violate the law so that he has clients.
