The jury was previously told that Kustra and Mr Miecnikowski had both been homeless and would regularly drink outside Westcliff Library on the road. The court heard that another man that they drank with had accused Mr Miecnikowski of stealing his phone, a claim that he denied. But after the man questioned him about this, Kustra allegedly attacked him, and Mr Miecnikowski was found with blood on his head and surrounding him on the pavement. Mr Gair asked Dr Cieka what his cause of death was. The doctor replied: “The cause of death was severe blunt force head injuries.” Mr Miecznikowski was flown to the Royal London Hospital via air ambulance, but was declared dead on September 25 last year.

Lucasz Kustra is standing trial for the murder of Wojciech Miecznikowski following an incident in Fleetwood Avenue, near Westcliff Library, last year. It is alleged that the 37-year-old defendant, of no fixed address, attacked Mr Miecznikowski when they were drinking in the street with other men outside the library on September 22. Basildon Crown Court heard that a woman was walking by the scene at around 12.30pm where she saw the victim lying on the pavement with a pool of blood around his head.

Mr Marshall and Mr Moore turned up at the defendant s address but were both chased away by Constantinou before the altercation between Constantinou and Mr Moore.
In his evidence to the jury Constantinou said it had been a tug-of-war-struggle during which Mr Moore was fatally stabbed.
Constantinou said he feared that if he let go of the baseball bat he would be in for an absolute beating and also feared what might happen to his mother.
The defendant, who said he picked up a knife which had dropped to the floor in one hand, said he tried to push Mr Moore away before the victim went quite limp .
Judge Anthony Bate adjourned sentencing until May 20.
The trial, which has been running since April 26, heard that in the weeks leading up to the fatal stabbing the defendant and Mr Marshall “had a bit of a falling out”.
A murder investigation was launched in North Walsham after the incident.

Peter Gair, prosecuting, said it had been due to the “failure of this defendant to pay a £10 debt” for cannabis.
Mr Marshall texted Constantinou to say he would visit his mum to get the cash back and inform her of his drugs habit to which the defendant texted back “I will gut you .
