After months online, RI court is now in session PROVIDENCE Jury trials are set to resume this month in Superior Court, with a distinctly different look, sound and feel, now more than a year into a pandemic that has altered almost all aspects of everyday life. There will be three courtrooms needed, not just one. Jurors will sit in the jury box separated by plexiglass. A sound system will pipe audio. Air filters will purr. Masks will be worn, and the public can tune in from home. “It’s forcing all kinds of innovations and ideas,” Craig N. Berke, spokesman for the judiciary, said during a tour of the newly outfitted courtrooms last week. 

Private schools get state aid for mandate compliance, court rules

In a split decision, the Michigan Supreme Court on Monday upheld a legislative appropriation to reimburse nonpublic schools for state-mandated practices, funding that had been opposed by public schools advocates.  GOP-nominated Justices Stephen Markman, Brian Zahra and David Viviano said the appropriation complied with both the religious clause of the First Amendment of the U.S. Constitution and a 1970 state constitutional amendment that bans public funding to private schools.  Because the legislative appropriation does not appropriate funds for nonpublic-school education services, it remains in compliance with the 1970 amendment, the three justices wrote. Supporters had argued the appropriation was reimbursement not the funding or aid banned by the 1970 amendment.

The court’s decision was 3-3, which means an opinion in favor of private schools by the state appeals court will stand. At issue was whether more than $5 million authorized by lawmakers during Gov. Rick Snyder’s administration conflicts with the Michigan Constitution, which says “no public monies or property” can be used to “aid or maintain” private schools.
