On April 20, a U.S. District Court issued an opinion in Arsenault v Way, 3:16cv-1854, striking down the New Jersey residence requirement for petitioners who wish to circulate petitions for candidates running in primaries. Here is the 21-page decision. The case had been filed in 2016 when Rocky De La Fuente was running in Democratic presidential primaries. He needed 1,000 signatures of registered Democrats in order to get on the New Jersey Democratic presidential primary. He did not get on that ballot; the only candidates who appeared on that ballot were Hillary Clinton and Bernie Sanders.
Originally the U.S. District Court had upheld the restriction, but then the Third Circuit had remanded it and said the lower court should have used the strict scrutiny test. On January 26, Rocky De La Fuente filed this response in the U.S. Supreme Court in De La Fuente v Simon, 20-612. The issue is the state law that gives political parties complete control over which candidates may appear on their presidential primary ballots. The Minnesota Republican Party in 2020 kept all candidates except President Donald Trump off its presidential primary ballot.
The Supreme Court will consider whether to hear this case at its conference of February 19.
NEW ELECTION RULES IN MAINE, TEXAS, AND UTAH BOOSTED MINOR PARTY 2020 VOTE
In November 2020, different election rules in Maine, Texas, and Utah were in effect for the first time. As expected, in all three states, the new rules boosted the minor party vote. In Maine, the new rule was the use of ranked choice voting for president. In Texas and Utah, the new rules were the elimination of the straight-ticket device. Texas eliminated it in 2018 but the change was not effective until 2020. Utah eliminated it in 2020.

Kanye West burst into the 2020 campaign picture on July 4, with a tweet declaring his candidacy for president. But even though he qualified for the ballot in a dozen states, he failed to make any discernible impact on the race, garnering just 0.04% of votes nationally.
West’s 66,636 total votes, according to an NBC News tally on Dec 10, placed him behind six other candidates, including President-Elect Joe Biden, incumbent president Donald Trump, Libertarian Jo Jorgensen (1.2% total vote), the Green Party’s Howie Hawkins (0.3%), Alliance Party candidate Rocky De La Fuente (0.1%), and Party for Socialism and Liberation candidate Gloria La Riva (0.1%).
