Federal judge temporarily blocks Gov. Greg Abbott’s order to pull over vehicles with migrants, which drew racial profiling concerns

U.S. District Judge Kathleen Cardone granted a temporary restraining order against Abbott’s move, meaning it will be blocked while the case continues to unfold. The U.S. Justice Department sued Abbott and Texas on Friday, a day after U.S. Attorney General Merrick Garland threatened to take legal action if Abbott didn’t rescind his order, calling it “dangerous and unlawful.”
According to court documents, an average of over 1,100 migrants are transferred every day from Customs and Border Protection custody at the southwest border “almost exclusively by contractors.”
“The sheer number of noncitizens encountered by CBP along the southwest border and transferred to ICE custody makes it impossible for it to use law enforcement officers as opposed to contractors to transport them while still executing its law enforcement responsibilities,” Russell Hott , an ICE Enforcement and Removal Operations assistant director, said in court filings.
Brian Hastings, chief patrol agent for U.S. Border Patrol, said in court filings that if the executive order prevents the transport of migrant children and families, it would cause them to be held for longer periods within Border Patrol facilities, violating federal rules. It would also crowd the facilities and worsen the chance of COVID-19 spread, he said.

A federal judge in El Paso on Tuesday temporarily halted Texas Governor Greg Abbott s plan to use state law enforcement to stop vehicles suspected of transporting migrants released from U.S. border custody.
U.S. District Judge Kathleen Cardone issued an order blocking Texas authorities from enforcing Abbott s directive until at least August 13, saying the order could be unconstitutional.
Tuesday s ruling, while temporary, is a triumph for the Biden administration, which has been engaged in an escalating political and legal conflict with Texas over the fate of the country s border and immigration policies.

AUSTIN, Texas A federal judge has ordered Texas to keep state troopers from stopping vehicles that are carrying migrants on the grounds that the migrants may spread the coronavirus.
The temporary restraining order handed down Tuesday by U.S. District Judge Kathleen Cardone comes as coronavirus infections are rising along the U.S.-Mexico border.
Texas Gov. Greg Abbott last week authorized Texas growing presence of state troopers along the border to stop any vehicle upon reasonable suspicion that it transports migrants.
The Biden administration accused Abbott of potentially worsening the spread of the coronavirus. It argued that impeding the movement of migrants would prolong the detention of unaccompanied children in increasingly crowded facilities.
