Law360 ADVERTISEMENT DOJ Wins Emergency Block Of Texas Migrant Transport Order Law360 (August 3, 2021, 9:55 PM EDT) A Texas federal judge on Tuesday granted the Biden administration s request for an emergency order temporarily blocking Gov. Greg Abbott s executive order restricting ground transportation of migrants detained at the border amid the COVID-19 pandemic, ruling that the order is likely to be found unconstitutional. U.S. District Judge Kathleen Cardone said that the federal government is likely to prevail on its claim that Abbott s July 28 order violates the supremacy clause of the Constitution because it conflicts and interferes with federal immigration law. The executive order causes irreparable injury to the United States and to individuals the United States is charged.

Cuomo urged to resign after probe finds he harassed 11 women NEW YORK (AP) — New York Gov. Andrew Cuomo faced mounting pressure Tuesday to resign, including from President Joe Biden and other onetime Democratic allies, after an investigation found he sexually harassed nearly a dozen women and worked to retaliate against one of his accusers. “I think he should resign,” Biden told reporters Tuesday, echoing House Speaker Nancy Pelosi and New York s U.S. Sens. Chuck Schumer and Kirsten Gillibrand, all Democrats. The leader of the state Assembly, which has the power to bring impeachment charges, said it was clear Cuomo could no longer remain in office. Speaker Carl Heastie, a Democrat, said he would move to complete an impeachment inquiry as quickly as possible.”

Greg Abbott s (R) order that state troopers stop vehicles carrying migrants, siding with the Biden administration. The Justice Department sued Abbott and Texas on Friday, two days after Abbott issued his latest controversial immigration order and one day after Attorney General Merrick Garland called that order dangerous and unlawful. Abbott spokeswoman Renae Eze underscored that U.S. District Judge Kathleen Cardone s injunction is temporary and based on limited evidence. Last week, Abbott authorized Department of Public Safety troopers to stop any vehicle upon reasonable suspicion that it transports migrants, then either impound the vehicle or reroute it back to its point of origin. Abbott portrayed his most recent order as a way to limit the spread of COVID-19 amid an influx of migrants at the Texas-Mexico border, but the Justice Department argued stopping contractors from moving

Judge temporarily blocks Texas order targeting suspected migrants

News Break By Harper Neidig  1 day ago A federal judge on Tuesday temporarily blocked the Texas governor s executive order that directed state law enforcement to target suspected migrants, ruling that it will likely fail against a legal challenge from the Biden administration. District Judge Kathleen Cardone issued a brief two-page decision forbidding Texas officials from carrying out Gov. Greg Abbott s (R) directive while the lawsuit plays out. The Executive Order causes irreparable injury to the United States and to individuals the United States is charged with protecting, jeopardizing the health and safety of non-citizens in federal custody, risking the safety of federal law enforcement personnel and their families, and exacerbating the spread of COVID-19, Cardone, a George W. Bush appointee, wrote.
