Former Madison County employee settles sexual harassment suit for $850K

Wolf Madison County paid former employee Kristen Poshard and her attorneys $850,000 to settle a lawsuit alleging she was wrongfully terminated for resisting sexual harassment by former county board member Phil Chapman.  According to the settlement agreement obtained pursuant to the Freedom of Information Act, Poshard received $100,000 for back wages and $402,894.44 for other losses. Poshard’s attorneys with Silverstein & Wolf LLC received $347,105.56 for fees and court costs.  Despite the settlement, the agreement states that defendants Kurt Prenzler, Doug Hulme, Phil Chapman and Madison County deny all allegations of wrongdoing.  Poshard voluntarily dismissed the case with prejudice on June 21 through attorney Ferne Wolf. 

Magistrate orders bone density scan for deckhand injured by steel cable

Kennedy EAST ST. LOUIS – Watco Transloading may test the bone density of tugboat deckhand Kevin Beam, U.S. Magistrate Judge Gilbert Sison ruled on June 21.  He found good cause for an independent medical examination.  Watco previously admitted liability for an accident that injured Beam in 2017, but it doesn’t admit liability for all the damages he has requested.  Sison resolved a dispute over the bone scan upon referral by District Judge Staci Yandle, who plans to hold trial in December.  Beam, a Randolph County resident, helped load coal into barges at Watco’s terminal on Route 3 in Rockwood.  In 2017, a steel cable snapped and struck his back.

McGlynn vacates $3 7M default judgment for California insurance defendants accused of fraud, defamation

Ripplinger EAST ST. LOUIS – Belleville lawyer George Ripplinger entered an appearance for difficult clients in time to rescue them from a $3.7 million default judgment, District Judge Stephen McGlynn ruled on Feb. 18. McGlynn vacated an entry of default against Tracey Keiser and Robert Frazier of California, and denied a motion to enter judgment. Two lawyers previously quit defending Keiser and Frazier against fraud and defamation claims due to communication breakdown and failure to pay. McGlynn wrote, “While the defaulted defendants do not have the best history of timely locating new counsel, there is no evidence that the default was willful or the result of gross negligence.”
