In his judgement, Judge Garry Barkle referenced a submission from Heal s lawyer, Wayne Jones. “You had been badly assaulted that evening, and the purpose of mentioning the firearm was thinking that police would respond in greater numbers, and that s what happened. “Five police staff responded to that incident, prepared for what had been suggested by you. “The injuries are referred to as being a badly bruised eye, and face covered in blood. But as a consequence of your actions you were arrested.” The submission described how Heal s offending had “tailed off significantly” in recent years, as he cut down his drinking and stepped up to being a father.
Todd threw a cup of drink at the victim, and then spat on him as the man called the police. Todd told police the man had approached him aggressively, and he had defended himself with what he had at the time. On April 24, there was an incident involving Todd’s neighbour on Weka St, Nelson. When the neighbour and two friends left her address, they saw Todd on his driveway with what appeared to be a firearm. “As the victims lost sight of [Todd], he began discharging the firearm, which was in fact a paintball gun, in the direction of the victim’s address.”
“I started to speed up a bit . and I noticed he sped up behind me so I started jogging a bit, and broke into a run, and he yelled out to me and said along the lines of, ‘oi’, so I immediately got quite panicked,” the woman said. “I started running, and he said, ‘you b.., you’re coming home with me tonight, s.,’ and I was running quite fast and not looking back.” As the man closed in, the woman realised she would lead him to the house where she was staying alone and changed course. When she reached a more shadowy part of the street she was able to hide between a fence and a bush, she said.
