The change would require primary legislation but will be enacted ‘as soon as parliamentary time allows’. The mandatory retirement age would be raised from 70 to 75, with the legislation also making it possible for magistrates to serve until 75 ‘where there is a demonstrable business need’. Legislation will also reform judges’ pension arrangements to improve retention rates Ministers intend to make provision for judges retiring later through the Public Service Pensions and Judicial Offices Bill. This is also intended to put judicial allowances ‘on a firmer legal footing’ by reforming their pension arrangements, the government has said.
