Top revenue officials made this appeal after the first division of the Court of Tax Appeals (CTA) approved the judicial compromise agreement between the BIR and Reliv Philippines, Inc. of Chino Roces Ave., Makati City.
The health food store initially protested before the CTA the P10.3-million deficiency tax assessment it received from the BIR in 2004 as well as its income and expanded withholding taxes.
The company ultimately sought an out-of-court settlement to end the protracted and expensive court litigation.
The BIR accepted the reduced and compromised payment of P4.2 million, or 40 percent of the total indebtedness as prescribed under Section 204 (A) of the Tax Code and implemented by Revenue Regulations 9-2013.

The Court of Tax Appeals (CTA) has scrapped the P78-million deficiency tax assessment slapped by the Bureau of Internal Revenue (BIR) against a major supplier of commercial kitchen equipment for failure of the former to indicate in the assessment notices when the liabilities should be paid.
The court’s second division stated that the due dates for the payment of deficiency taxes were not indicated in separate notices sent to Fabtech Kitchens Unlimited Inc. of Magallanes Commercial Center, Makati City.
It said the space for the due date for the payment of deficiency income, value-added and improperly accumulated earnings taxes for 2012 was left blank.
