Industry experts have welcomed the senior judiciary’s decision to give the green light to compulsory mediation – but warned against trying to do it on the cheap.
The Civil Justice Council last week reported that mandatory ADR was compatible with Article 6 of the European Convention on Human Rights and therefore lawful. The report was commissioned by the master of the rolls, a keen advocate for ADR, and is likely to herald a major shift in dispute resolution.
Lady Justice Asplin, chair of the judicial/ADR liaison committee, said the report provides a chance to initiate a ‘change of culture’ in civil justice.

One senior government figure closely involved in weekend discussions with the BBC said that while governance rules had changed and been improved since 1995, it would not be enough for ministers simply to step back and say it is now a different and improved institution.
âWhen you have a future king of England attacking in a pretty strong fashion the state-owned broadcaster, then the government needs to be seen to be taking that seriously,â a government minister said. âWhile there is now stronger internal management than there was then and stronger external regulation, there is a long way to go to change the culture of the BBC.â

The federal government will amend the Sex Discrimination Act to include politicians and judges, who have previously been exempt from the laws.
More than a year after receiving the Respect at Work report, the government has announced it will adopt the 55 recommendations either in full, in part or in principle.
Of the 55 it has agreed to 40, agreed in principle to five, agreed in part to one and noted nine.
