ALBANY, N.Y. (WHCU) – New York Attorney General Letitia James has issued guidance to the State Sheriffs’ Association with reminders on law enforcement’s role in the eviction process during the ongoing pandemic.
Protections have been provided to tenants at risk of eviction, including an automatic stay of eviction on cases through May 1
st if the tenant files a hardship declaration.
Tenants are allowed to provide that declaration at any point in the eviction process, and upon receipt of the declaration, law enforcement officials are prohibited from evicting the tenant and occupants.
The Office of the Attorney General encourages sheriffs and other law enforcement officers who execute eviction warrants to provide declarations to all occupants as the pandemic continues.
