Maratha reservation: SC to begin final hearing both physically and virtually from March 8

The pleas will be taken up in a hybrid manner, which means it will be a combination of both physical and virtual hearing. A five-judge constitution bench led by Justice Ashok Bhushan said if physical hearing would resume in the court, the parties can argue physically and if anyone wishes to make arguments virtually, he can do that. “Be that as it may, the hearing in these matters will start from March 8, 2021, by physical or virtual mode,” the bench, also comprising Justices L Nageswara Rao, S Abdul Nazeer, Hemant Gupta and S Ravindra Bhat, said in its order.

More important, the top court has drawn up a calendar to wrap up the proceedings in March itself. The Socially and Educationally Backward Classes (SEBC) Act, 2018, was enacted to grant reservation to Maratha community in Maharashtra in jobs and admissions. The bench said it would also hear arguments on the issue of whether the landmark verdict in the Indira Sahwney case, also known as the Mandal verdict , should be re-looked at or not.

NEW DELHI: The Supreme Court on Wednesday said it would decide on February 5 the schedule of hearing on the pleas pertaining to the 2018 Maharashtra law granting reservation to Marathas in education and jobs after the state government said a case of this nature be heard once physical hearing commences. The apex court is presently hearing matters through video-conferencing since March last year amid the Covid-19 pandemic. A five-judge constitution bench headed by Justice Ashok Bhushan was told by senior advocate Mukul Rohatgi, who was appearing for Maharashtra, that the state is requesting for an adjournment and the matter be heard in March.
