KUALA LUMPUR: The hearing of the lawsuit filed by 10 Gombak voters against their MP Datuk Seri Azmin Ali over alleged breach of fiduciary duty will start in June next year after the High Court here dismissed the senior minister’s application to strike it out.
Justice Akhtar Tahir also dismissed a similar application by the 10 voters to strike out parts of Azmin’s statement of defence against their suit.
In his decision delivered in an online session, the judge dismissed Azmin’s application as the court found the matter needed to be heard in a full hearing as there were triable issues raised by the voters.

KUALA LUMPUR, June 30 The High Court today set hearing dates in June 2022 for the case against Senior Minister Datuk Seri Azmin Ali initiated by Gombak voters accusing him of breaching his fiduciary duties and constitutional oaths following his defection from Pakatan Harapan (PH) and PKR.
KUALA LUMPUR: The High Court has fixed June 30 to hear an application by Gombak MP Datuk Seri Azmin Ali who wants to strike out a lawsuit filed against him by 10 constituents over alleged deceit and breach of fiduciary duty.
Deputy Registrar Maslinda Selamat set the date after the case was brought up for case management via e-review on Monday (April 26).
On the same day (June 30), the court will also hear an application by the voters who sought to strike out several paragraphs from Azmin s statement of defence.
According to Azmin s lawyer Nizamuddin Hamid, the said paragraphs - paragraph 13 until 20 - were on Azmin s reasons on why he left PKR.

His lawyer Nizamuddin Hamid, when contacted, said that on the same day, Justice Datuk Akhtar Tahir will also hear the voters’ application to strike out several paragraphs from Mohamed Azmin’s statement of defence.
According to Nizamuddin, the paragraphs in question contained Mohamed Azmin’s reasons on why he left PKR.
KUALA LUMPUR: Gombak MP Datuk Seri Azmin Ali has filed an application to strike out a lawsuit filed against him by 10 constituents over alleged deceit and breach of fiduciary duty.
When contacted, his lawyer Nizamuddin Hamid confirmed that the notice of motion was filed at the High Court here on Friday (March 12). The next case management date is March 24, he added.
In the court document, Azmin said the lawsuit filed against him did not have a reasonable cause of action, was an embarrassment, frivolous and an abuse of the court process.
He also said the lawsuit was ultra vires the Federal Constitution and had violated his right to be in an association as provided under Article 10 (1) (c) of the Constitution.
