This comes after a tribunal ruled on Wednesday June 2 that Alternative Futures Group, which has facilities in Blackburn, Burnley and Accrington, did not have the right to take disciplinary action against staff who took part in strikes. The ruling, which will affect workers across the entire care sector, was prompted over a case brought by AFG care worker Fiona Mercer who said that her employers disciplined, suspended, and prevented from going into work after she took part in a long-running dispute over the care providers plans to cut payment for sleep-in shifts.
BRITISH bosses can no longer bully and victimise workers who take part in industrial action, following a groundbreaking tribunal ruling.
Public service union Unison won the ruling on Wednesday after challenging care services provider AFG, which runs care homes and hospitals in north-west England.
Workers took strike action when AFG, which is a registered charity, cut payments to staff who have to stay overnight with people they care for.
Unison told an employment appeals tribunal (EAT) that employee Fiona Mercer, who helped organise the action, was disciplined, suspended and prevented from going into work by her employer.
Ms Mercer lost the case at an employment tribunal but the union appealed against the ruling.
