CITING the 3rd degree familial relationship threshold of the law, Superior Court Associate Judge Joseph N. Camacho on Friday denied the Office of the Attorney Generalâs motion to recuse or disqualify himself from hearing the case against a 17-year-old defendant who was charged with sexual assault and other crimes.
Judge Camacho also denied the Office of the AGâs request to vacate the preliminary hearing.
For his part, the defendantâs attorney said Chief Prosecutor John Bradley and Assistant Attorney General Samantha Vickery should be held in contempt of court for their âscandalous accusationsâ against the court.
Judge Camacho said he will âtake the issue under advisement to allow the government attorneys to file a written response.â
Rudolph Rudolph
He will also be placed on 10 years probation and must register with the CNMI sex offender registry.
Rudolph was also ordered not to have any direct contact with the minor victim for 30 years.
Represented by court-appointed counsel Anthony Aguon, Rudolph pled guilty to one count of sexual abuse of a minor in the first degree.
According to the factual basis for the plea agreement, on or about July 1, 2020, Rudolph engaged in sexual penetration of a minor.
Rudolph was initially charged with three counts of sexual abuse of a minor in the first degree, and four counts of sexual abuse of a minor in the second degree.
CITING the expiration of the statute of limitations among other reasons, Chief Prosecutor John Bradley on Wednesday informed Attorney General Edward Manibusan that the Office of the AGâs criminal division will not prosecute Rep. Edwin Propst who has been accused of sexual misconduct.
In a memorandum, Bradley said the Department of Public Safety âinitiated an investigation into allegations that Propst had engaged in sexual contact/intercourse with several underage females approximately 20 years ago while employed as an educator for Marianas High School and Northern Marianas College.â
Bradley said the investigation âidentified eight potential female victims, all but one of whom provided some details of the allegations. The names of the women are not being released, as that is the practice for victims of sexual assault and they have all indicated they do not want to pursue any charges or become identified in public after so many years after the incidents.â
