Drug Return Co., Execs Want 3rd Circ. To Undo $94M Verdict
Law360 (March 16, 2021, 7:37 PM EDT) Reverse pharmaceutical company Devos Ltd. and two of its former executives urged the Third Circuit on Tuesday to overturn their criminal convictions for stealing $94 million in drug refunds, arguing that the government s probe was facilitated in part by an overly broad search warrant.
During oral arguments before a three-judge panel, an attorney for former Devos Chief Financial Officer Donna Fallon blasted a court-approved warrant that he said told agents virtually nothing about the subject matter they were authorized to search for during an April 2011 raid on Devos premises, which included Fallon s private office.
