Firms Can t Be Roped Into RICO Suit With Client, Judge Told
Law360 (April 7, 2021, 9:47 PM EDT) Two Florida law firms that represented American Enterprise Bank in foreclosure actions have urged an Illinois federal court to toss claims that they participated in an alleged fraudulent loan scheme, saying lawyers can t be held liable under federal racketeering law for providing legal services.
The now-defunct Bishop Partnership LLC defaulted on a nearly $1.7 million business loan from AEB to renovate condominiums in Chicago, which had been secured by Florida condominiums owned by two individual plaintiffs and used as collateral, according to filings in the case.
