Lowville opts out of retail cannabis, but public action could delay enactment

LOWVILLE — Cannabis dispensaries and weed cafes will not be coming to the town of Lowville unless residents decide to do something about it. On June 17, it became the first municipality in Lewis County to pass an “opt out” law. Opt out laws are subject to “permissive referendum” — an action unique to New York state that makes it possible for local residents to petition to have the board-approved local law on the November ballot to let the general population decide whether it should be enacted. For a referendum petition to be successful, it must have the names, addresses and signatures of 10% of the total number of people who voted in the last gubernatorial election and be filed within 45 days of the law’s passing, town lawyer Raymond Meier told the board in their June meeting.
