Custer County Repeals Guns In Courthouse

Custer County South Dakota law lays out who can carry weapons in county courthouses. But that same chapter allows county commissioners to waive those restrictions. That s what the Custer County Commission has done. Anyone not prohibited by law can now carry guns in the Custer County Courthouse except in the areas where the Unified Judicial System conducts its business. Chairman Jim Lintz says commissioners passed the resolution to make the courthouse safer and to affirm gun rights before the next presidential administration takes office. Victoria Wicks has more. SD Supreme Court sides with decision to move court proceedings News StaffJanuary 18, 2021News SD Judicial SystemSD Supreme Court RAPID CITY, S.D. – The South Dakota Supreme Court has reviewed the recently-passed resolution by the Custer County Commission that allows for the carrying of firearms in the Custer County Courthouse and has issued an ordered affirming the Seventh Judicial Circuit Court’s decision to stop holding court in Custer County because of the ordinance. The state Legislature in 2020 passed a law that allows county courthouse employees to have guns in courthouses, but not in courtrooms. The Custer County ordinance- passed in November 2020 –  allowed members of the public to do the same because the commission said in the ordinance that,  “it recognizes the right to bear arms” and “believes it is in the best interest of Custer County to allow persons to possess firearms in or on the county courthouse and county properties in Custer County.”

Pfeifle has SD Supreme Court support in Custer County Courthouse order

Presiding Seventh Circuit Judge Craig Pfeifle signed an order on Thursday affirming the move of all Custer County court proceedings to Pennington County. The decision comes with the backing of the South Dakota State Supreme Court. In November, the Custer County Commission adopted Ordinance 2020-18, which would allow firearms to be carried into the Custer County Courthouse. Legal gun owners would be allowed to carry in the building itself, but not in courtrooms or other offices. South Dakota’s Constitutional Carry Law was passed back in 2019, allowing registered owners to carry without a permit.

The Board created an ordinance to allow people to legally carry personal firearms in the County Courthouse, as allowed by law.  In effect, the ordinance removes the legal prohibition on people carrying firearms in the courthouse. There have not been any problems.
