North Carolina opts to keep century-old law against adultery

North Carolina opts to keep century-old law against adultery Updated Apr 29, 2021; By Lucille Sherman, The News & Observer (Raleigh, N.C.) (TNS) North Carolinians can still sue a person who has an affair with their spouse, after a handful of lawmakers killed a bill that would have repealed a state law at least a century old. In a hearing Wednesday morning, members of a House judiciary committee split in a 4-4 vote on whether to advance House Bill 485 and eliminate the state’s “criminal conversations” law. The tie vote kept the bill from moving forward. This isn’t the first time lawmakers have attempted to remove North Carolina from a list of just six states where husbands or wives can sue a third party for having an affair with their spouse. England abolished the centuries-old law, which originated when men still considered women as property, in the 1850s.

Divorces would be quicker, alienation of affection suits a thing of the past under NC proposals

When it comes to divorce, the outcomes may be the same, but the causes can differ. Democrats have filed bills in the state House and Senate that would end North Carolina s controversial alienation of affection law. Senate Bill 459 and companion House Bill 489 also would shorten the waiting period for getting a divorce to six months. Now, the waiting period is 12 months.  For couples without children, the six-month period could be waived if the divorce is uncontested and both parties agree. The bills would allow for divorce proceedings to continue even if the couple remains in the same household for financial reasons, or have occasional sex.

Former Alamance senator Gunn to settle alienation of affection suit

Former state senator Rick Gunn is settling an alienation of affection suit from a legislative aide’s husband, according to the Associated Press. Arthur Johns sued Gunn in August claiming the then District 24 senator carried on a years-long affair with his now estranged wife, Karen Johns, and used his office to damage Arthur Johns’ reputation and discredit him. Johns’ lawyer, Richard Gantt, said the suit would be formally dismissed once Johns received a financial settlement, according to the Associated Press. Gunn’s lawyer, Nathaniel Smith, confirmed there was a settlement and pending dismissal to the News & Observer, but did not say whether or not Gunn had agreed to pay Johns.
